KENNEDALE CITY COUNCIL
PUBLIC HEARING -JANUARY 14, 1999

Mayor Wright called the public hearing to order at 7:31 p.m.
Members present: Mayor Wright, Councilmembers' Clark, Hoover, Barrett, Vaughn and
Kovach.
Members absent: None
Staff present: Ted Rowe, Kathy Turner, Linda Royster, Mort Wetterling, and legal counsel,
Wayne K. Olson.
Public Hearing - To receive citizens comments regazding a request to amend Chapter 17, of the
Kennedale City Code, which addresses Planning and Land Development.
Mr. David Conroy, Chairman of the Planning and Zoning Commission briefed Council regarding
amendments to Chapter 17 of the Kennedale City Code. In speaking with Council, Mr. Conroy
stated the Planning and Zoning Commission voted unanimously to forward the recommendations
which, they had reviewed over the past months.
Mr. Conroy specifically addressed the rear and side yard set backs. Commission members felt
that the existing rear yard set backs were too stringent and limited the use of land for which a
developer could develop it. Therefore, they recommended reducing the 50' foot rear yard to 25'
foot in Single Family Districts (R1).
In addition, the commission maintained a 15' foot side yard per side but allowed fora 5' foot
shift in the build line. Commission members felt that this would benefit the homeowner who
desired aside/rear entry garage, and would allow more room for entry and exiting.
Other amendments Mr. Conroy spoke of included accessory buildings, swimming pools, and
schedule of uses.
Questions raised by council included clarification of language on visibility at intersections, and
the possibility of promoting smaller depth lots if set back requirements were reduced.
Next, Mr. Don Samanie, representing Shady Creek East spoke in favor of the reduced rear yard
set back. Mr. Samanie appeared before the Commission in September 1998 to seek a way to
adjust the rear yard set back to accommodate the architectural ability to lay out a house. He had
four contracts that were requesting rear/side yard entry garages and said that the fifty-foot set
back would not allow for this. At that time, he was advised of the amendments being proposed to
Council and he deferred his plans until such time Council could consider it. In closing, Mr.
Samanie actively pursued Council's concurrence to accept the proposed changes.

Mr. Frank Cde Baca, representing Shady Creek East also signed in to support the proposed
amendments, but did not wish to address Council.
There being no other persons to speak before Council, Mayor Wright adjourned the public
hearing at 7:55 p.m.
