RECESS TO EXECUTIVE SESSION – 4:30 PM The City Council will meet in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meetings Act, including discussion on any item posted on the agenda and legal issues regarding amortization of nonconforming uses; reconstruction of Dick Price Road; regulation of sexually oriented businesses; and litigation, settlement offers, and/or claims regarding the following matters: a. H&A Land Corporation, d/b/a Showtime Cabaret v. City of Kennedale; Cause No. 402-CV- 0458-Y b. Jerry Coyel v. City of Kennedale, Cause No. 236-193444-02 c. Police Department issues. d. County of Tarrant, Texas v. Jerry Coyel; Cause No. 348-185513-00 e. Wheeler’s Motor Service v. Board of Adjustment; Cause No. 153-201934-03 f. Southern Salvage, Inc. v. City of Kennedale, Cause No. 153-208208-04 g. Interlocal Agreement with City of Arlington. h. Refund of Roadway Assessment Fee II. RECONVENE FOR OPEN MEETING WORK SESSION – 5:30 PM 1. Discussion with Callahan and Freeman regarding concept plan for Library project. 2. Discussion on any other item on the agenda. III. RECONVENE INTO REGULAR SESSION – 7:00 PM IV. Presentation of awards for Municipal Court Week. VII. PUBLIC HEARINGS 1. City Council will receive citizen comments regarding an amendment to Chapter 17, Article VII, of the Kennedale City Code (1991), as amended, by providing for the erection of subdivision signs. 2. City Council will receive citizen comments regarding an amendment to Chapter 17, Article V, Subdivision Regulations, of the Kennedale City Code (1991), as amended, providing regulations for the establishment of private streets, and providing standards for private streets. VIII. CONSENT AGENDA These following items are considered to be routine and self-explanatory by the Council and will be enacted with one motion. There will be no separate discussion of these items unless a Councilmember requests that an item be removed from the Consent Agenda and be considered, in sequence, as a routine agenda item. 1. Approval of minutes: regular meeting dated October 14, 2004. 2. Consider approval of Resolution No. 183 approving write-off of inactive utility accounts. 3. Consider approval of Ordinance No. 282, clarifying the rates for water service for multiple unit residential units. 4. Consider approval of Ordinance No. 283, amending Chapter 17, Article VIII, of the Kennedale City Code (1991), as amended, by providing for the erection of subdivision signs. 5. Consider approval of Ordinance No. 284, amending Chapter 17, Article V, Subdivision Regulations, of the Kennedale City Code (1991), as amended, providing regulations for the establishment of private streets and providing standards for private streets. 6. Consider approval to select MHS Planning as Consultant for Park Master Plan 7. Consider approval of Policy on Appointed Board/Commission Members. 8. Consider approval to awards bids for health/dental/life and AD & D insurance. IX. REGULAR ITEMS 9. Consider approval of concept plan for Library project. 10. Consider approval of appointment(s) to the Economic Development Corporation. X. VISITOR/CITIZENS FORUM At this time, any person with business before the Council not scheduled on the agenda may speak to the Council. No formal action can be taken on these items at this meeting.
