BROADWAY ST. -COMMUNITY CENTER Mayor Wright called the meeting to order at 6:16 p.m. Members present: Mayor Wright, Councilmembers Clark, Barrett, Vaughn and Kovach. Members absent: Councilmember Hoover. Staff present: Ted Rowe, Kathy Turner, Dave White, and legal counsel, D'Ann Drennen. A. REGULAR ITEMS 1. Award of contract for furniture for new Municipal Building. Councilmember Barrett moved to award contract for furniture for new Municipal Building, to Dallas Desk in the amount of $65,704.00, second by Councilmember Kovach. Motion carried. 2. Award of contract for phone system for new Municipal Building. Councilmember Barrett moved to award contract for phone system for new Municipal Building to Comtech in the amount of $14,860.00, second by Councilmember Vaughn. Motion carried. 3. Consideration of extending employment contracts to city department heads. Councilmember Kovach moved to enter into executive session to consider extending employment contracts to city department heads, second by Councilmember Vaughn. Motion carried. B. EXECUTIVE SESSION -Mayor Wright entered into executive session at 6:28 p.m. 1. The City Council met in closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, Section 551.074, Texas Government Code. a. City Manager b. Police Chief c. City Secretary d. Director of Finance e. Fire Chief 2518 C. RECONVENE INTO REGULAR SESSION AND CONSIDER ACTION, IF ANY, ON ITEMS DISCUSSED IN EXECUTIVE SESSION. Mayor Wright reconvened into open session at 7:03 p.m. to enter into the public hearing at 7:05 p.m. After the public hearing, Mayor Wright re-entered into executive session at 7:56 p.m. and reconvened into open session at 8:51 p.m. Councilmember Clark moved to ratify the Police Chief Contract dated November 9, 2000, second by Councilmember Kovach. Motion carried. Councilmember Clark moved to modify the City Manager's contract to provide for a two year contract to expire in October 2002 with the second year of the contract being an option year with an annual performance review to occur in October 2001, and include provisions in the contract for termination upon a no confidence vote of the council requiring the affirmative vote of four members of the council. Second by Councilmember Kovach with all members present voting in favor. D. PUBLIC HEARING To receive citizen comments regarding the proposed zoning classifications for properties annexed into the city in December 1998, as well as the land that makes up the Oak Crest Addition, which was annexed by the City of Kennedale in May 1999. As a result of annexation, and, per the City Code, heretofore, addressed property received a temporary zoning classification of "R-1" (Single Family Residential). Additionally, all of the city land that has previously been zoned "PD" (Planned Development) is also being rezoned to a classification within the Residential, Commercial, or Industrial categories. The following persons addressed Council during the public hearing. Comments ranged from gathering more information as to what type of zoning is being placed on certain properties, opposition to the proposed zoning classification, water/sewer extension, and specific use permits. Mr. Bearl Mathews of 6917 Miramar Circle, Fort Worth, Texas spoke on behalf of his mother-in-law, Gladys Sellers of 5746 Eden Road East, Kennedale, Texas. Mr. Mathews stated that Ms. Sellers has 10 acres and is requesting that the city allow her to continue raising cattle on her property. Property is currently zoned temporary "R1" Single Family and the city is proposing "R3" Single Family. Ms. Diann Walker of 160 Lace Lane, Burleson, Texas inherited properly along and on the corner of Little School Road and Sublett Road. Property is currently zoned Planned Development and she is requesting residential zoning. City is proposing "C2" General Commercial. Ms. Pat Doescher of 5432 Mansfield Highway, Fort Worth, Texas addressed council regarding Apache Iron Metal and Auto Salvage and stated that Apache meets all EPA regulations and resents that the City of Kennedale is trying to close her business down. Mrs. Doescher requested Council revisit the zoning classification of her property as well as surrounding properties. 2519 Mr. Jim Milligan of 4010 Eden Road, Kennedale, Texas addressed Council regarding annexation of Hawk Steel Industries, Inc. Mr. Milligan stated that since the annexation of his business into the city, he has only faced opposition and feels that the city should try and be a neighbor before imposing restrictions, and if the city does not want his business, then the city should pay him for what his business is worth and he would be willing to move elsewhere. Mr. Walter Leonard of 2400 Scott Avenue, Fort Worth, Texas addressed Council on behalf of Apache Auto Salvage. Mr. Leonard spoke of opposition to the proposed zoning of Apache and requested Council review zoning and impose an "I" Industrial classification. He also addressed the overlay zoning for the property referring to Ordinance No. 187 and questioned the validity of the ordinance. He said that the city has imposed an "I" Industrial zoning by allowing Fort Worth Tower, Inc. and US Galvanizing to establish business, therefore defeating the purpose of beautification of the entrance into the city and creating an industrial district. Mr. Leonard stated that by imposing the proposed zoning the city is only trying to eliminate nuisances, businesses that the city doesn't want. He said that if council would review the surrounding property they will find that the surrounding property is Industrial, not General Commercial. Mr. Leonard also presented Council a letter regarding proposed rezoning of annexed properties and pictures of "fumes" from US Galvanizing. Mr. Grady Clifton of 5409 Sun Valley Drive, Fort Worth, Texas addressed Council regarding his property on Little School Road. Mr. Clifton requested "R2" or "R3" Single Family Residential. City is proposing "C2" General Commercial District. Mr. John Johnson of 6911 F Mansfield Cardinal Road, Kennedale, Texas addressed Council regarding the proposed zoning of his property to "MH" Manufactured Housing District. Mr. Johnson requested residential to allow him to build a new home. He also addressed sewer hook-up since annexation. Ms. Lois Flynn of 6812 Oakcrest Drive West, Kenndale, Texas addressed Council in favor of the proposed "R3" Single Family District zoning. Mr. Rob Morris of 824 E. Kennedale Sublett Road, Kennedale, Texas addressed Council in regards to sending the proposed zone change back to the Planning and Zoning Commission for further review and recommended keeping the Planned Development zoning district or changing it to "AG" Agriculture. Mr. Roy Cooper of 4024 View Point Drive, Granbury, Texas spoke of the property his sister, Diann Walker addressed earlier stating that he was against the proposed zoning of commercial. Mr. Cooper recommended keeping the Planned Development zoning district. Mr. Ron Sturgeon of 1208 E. Mansfield Highway, Kennedale, Texas addressed Council regarding Budget American and Import. Mr. Sturgeon stated that when he was annexed he was told that he would be a legal conforming use and obtained all required city permits to operate. Mr. Sturgeon spoke of opposition to the proposed zoning and referenced Ordinance No. 187 with concerns over obtaining specific use permits from the Board of Adjustment to operate. 2520 In addition, the following six persons registered during the public hearing but did not wish to address council. Ms. Ruby Busby of 6704 Oakcrest Drive E, Kennedale, Texas - in favor of proposed "R3" Single Family Zoning. City is proposing "R3" Single Family District. Mr. William Jones of 6725 Lindale Road, Kennedale, Texas -opposed "R3" Single Family District. Requesting "C2" General Commercial District. Mr. Charles Doescher of 5432 Mansfield Highway, Kennedale, Texas -opposed "C2" General Commercial District. Requesting "I" Industrial District. Mr. G. L. Brott of 6951 Eden Tap Road, Kennedale, Texas -opposed "MH" Manufactured Housing District. Requesting "C2" General Commercial District. Mrs. Leann Morris of 824 E. Kennedale Sublett Road, Kennedale, Texas -opposed "C2" General Commercial District. Requesting "PD" Planned Development District. Ms. Darla Smitherman of 3917 S. New Hope Road, Kennedale, Texas -opposed "C2" General Commercial District. Requesting a residential zoning classification. Mayor Wright closed the public hearing at 7:45 p.m., and re-entered into executive session at 7:56 p.m. E. ADJOURNMENT Councilmember Vaughn moved to adjourn the meeting at 8:55 p.m., seconded by Councilmember Kovach.
