11.14.2000 CC Minutes - Special2513 MINUTES OF KENNEDALE CITY COUNCIL NOVEMBER 14, 2000 -SPECIAL MEETING 100 E. BROADWAY ST. -COMMUNITY CENTER Mayor Wright called the meeting to order at 6:15 p.m. Members present: Mayor Wright, Councilmembers Clark, Hoover, Barrett, Vaughn, and Kovach. Members absent: None Staff present: Ted Rowe, Kathy Turner, Dave White, Margaret Eichelberger, Linda Royster, Mort Wetterling, and legal counsel, D'Ann Drennen. Councilmember Barrett gave the invocation. A. REGULAR ITEMS Mayor Wright reviewed items two, three and four prior to item one. 2. Consider approval of contract with AA Security/Lock & Safe. Councilmember Hoover moved to approve contract with AA Security/Lock & Safe in the amount of $9,847.95, second by Councilmember Kovach. Motion carried. 3. Consider approval of contract with Doug Keys Services. Councilmember Barrett moved to approve contract with Doug Keys Services in the amount of $840.00, second by Councilmember Hoover. Motion carried. 4. Consider approval of change order #3 for City Hall. Councilmember Clark moved to approve change order #3 for City Hall dated November 8, 2000 in the amount of $15,897.29, second by Councilmember Kovach. Motion carried. 1. Reconsideration of employment contract with City Manager. Councilmember Vaughn moved to reconsider employment contract with City Manager, seconded by Councilmember Hoover. Councilmembers Vaughn, Hoover, Clark and Kovach voted aye, with Councilmember Barrett voting against. Motion carried. Councilmember Vaughn moved to enter into executive session, second by Councilmember Kovach. Motion carried unanimously. Mayor Wright entered into executive session at 6:30 p.m. i~ 2514 B. EXECUTIVE SESSION 1. The City Council met in closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, Section 551.074, Texas Government Code. a. City Manager C. RECONVENE INTO REGULAR SESSION AND CONSIDER ACTION, IF ANY, ON ITEMS DISCUSSED IN EXECUTIVE SESSION. Mayor Wright reconvened into open session at 7:03 p.m. to enter into the public hearing. After the public hearing Mayor Wright re-entered into executive session at 8:35 p.m. and reconvened into open session at 9:58 p.m. Councilmember Clark moved to table the reconsideration of the City Manager's contract. Second by Councilmember Hoover. Motion passed 5-0. Council was reminded that the next meeting would be at 6:15 p.m. on Tuesday, November 21 S`. D. PUBLIC HEARING - 7:00 PM To receive citizen comments regarding the proposed zoning classifications for properties annexed into the city in December 1998, as well as the land that makes up the Oak Crest Addition, which was annexed by the City of Kennedale in May 1999. As a result of annexation, and, per the City Code, heretofore, addressed property received a temporary zoning classification of "R-1" (Single Family Residential). Additionally, all of the city land that has previously been zoned "PD" (Planned Development) is also being rezoned to a classification within the Residential, Commercial, or Industrial categories. Prior to public comments, Mr. Mort Wetterling, Planning and Development gave a brief background on the rezoning case. Mr. Wetterling stated that the Planning and Zoning Commission looked at surrounding properties, land use plan, how zoning would affect property for that area, and looked at the majority use of the land prior to establishing a zoning classification. Next, Mayor Wright opened the public hearing for comments with the following 15 persons registering to speak. In addition, there were seven people who registered during the hearing, but did not wish to address Council. Five of those persons registered against the proposed zoning for their property and two registered in favor. Sterling Adams - 6401 Pennsylvania Avenue - referenced his business Apple Autc Salvage -wanted to know zoning. Informed proposing "I" Industrial. Adams okay with this. Sam Shugart - 6867 Mansfield Cardinal Road -proposing "C2" General Commercial District -Requested "C2" General Commercial District. 2515 1 Bob Nichols - 7257 Mansfield Highway -proposing "R3" Single Family -Runs Tractor Supply -Receives Arlington Water -Requested info regarding utility extension. Mrs. Pat Doescher - 5432 Mansfield Highway -Apache Iron Metal & Auto Salvage - Proposing "C2" General Commercial District -Requested "I" Industrial. Earnest Glen Long - 6733 Oak Crest Dr. W -Proposing "R3" Single Family -Requested "C2" General Commercial District. William A. Jones - 6725 Lindale Rd. (Lives in Fort Worth) -Proposing "R3" Single Family -Has recycle business and junk. -Requested alternative zoning. Roy Boenig - 1020 Kennedale Sublett Road -Commented on property at intersection of Sublett and Little School Road -Proposing "C1" Restricted Commercial -Requested "PD" Planned Development or "Rl - R2" Single Family District until used. Kenneth E. Morris - 607 S. New Hope Road -Proposing "I" Industrial -Requested Residential Paul Ward for Mrs. Dimple Bruce - 804 Mansfield Highway -Addressed property in Oak Crest Addition -Proposing 3 lots as "C2" General Commercial District and 1 lot as "R3" Single Family -Requested all "C2" General Commercial District. Rob Morris - 824 E. Kennedale Sublett Road -Proposing "C2" General Commercial District -Requested "PD" Planned Development District or "AG" Agriculture. Gerald L. Brott - 6951 Eden Tap Road - Proposing "MH" Manufactured Home District - Requested "C2" General Commercial District. Frankie Wheeler - 3159 Mims, Fort Worth -addressed property in Oak Crest -Proposing "C2" General Commercial District and "R3" Single Family -Requested all "C2" General Commercial District. Walter Leonard -Attorney for Pat & Charles Doescher -Apache Iron Metal - Questioned abutting property zoning classification of "I" Industrial as to why proposing "C2" General Commercial District on Apache. Questioned Ordinance No. 187 and addressed special use permit system. Jose A. Torre - 600 Reeves Ln. -addressed zoning regarding A B S 1 wrecking yard - Proposing "R3" Single Family Residential -Questioned why changing? zoning uses on both sides of Mansfield Highway. Charles Doescher - 5432 Mansfield Highway -Apache Iron Metal -Proposing "C2" General Commercial District -Requesting "I" Industrial -Requested Council to review 2516 Mayor Wright closed the public hearing at 8:20 p.m., and re-entered into executive session at 8:35 p.m. E.
