MINUTES OF
KENNEDALE CITY COUNCIL
SPECIAL MEETING -OCTOBER 26, 2000
420 BOWMAN SPRINGS RD. -SENIOR CITIZEN CENTER
Mayor Wright called the meeting to order at 7:02 p.m.
Members present: Mayor Wright, Councilmembers Clark, Hoover, Barrett and Vaughn.
Members absent: Councilmember Kovach.
Also present: Planning and Zoning Commissioners Risinger, Cowan, Miller, and Lankhorst.
Staff present: Ted Rowe, Kathy Turner, Margaret Eichelberger, David White and Mort
Wetterling.
Councilmember Barrett gave the invocation.
A. REGULAR ITEMS
1. Consider approval of Ordinance No. 203, Zone Change 00-04 to "R-3" Single Family
Residential District.
Councilmember Vaughn moved to table Ordinance No. 203, seconded by
Councilmember Clark. Motion carried.
2. Consider approval of Ordinance No. 205, to declare certain noise levels to be a nuisance.
Councilmember Clark moved to approve Ordinance No. 205 declaring certain noise
levels to be a nuisance contingent upon amending Section 15-153 by adding a
subparagraph (a) to provide that any single event or maximum sound disturbance
exceeding 85 decibels, and to re-letter the previous subparagraph (a) to (b) and (b) to (c),
seconded by Councilmember Barrett.
Councilmember Clark moved to amend his previous motion to approve Ordinance No.
205 declaring certain noise levels to be a nuisance contingent upon amending Section 15-
153 by adding subparagraph (a) to read any offense as described in Texas Penal Code,
Section 42.01 (a)(5) and (c)(2), and re-letter the existing subparagraph (a) to (b) and (b)
to (c), seconded by Councilmember Barrett. Motion carried.
B. WORKSHOP
1. Update on bid specs for phone system and furniture purchase for new city hall.
Mrs: Margaret Eichelberger and Mr. Dave White presented before Council a proposed
furniture layout reflecting various options for the new city hall. Mr. White replied that
furnishing the CounciUCourt Chamber exceeded what they expected due to the fixed
seating arrangement requested by Judge Lee and requested suggestions or solutions from

Council on how to offset the cost. He said that all office furniture would be
interchangeable between offices and additions could be added at a later date if needed.
In addition, Mr. White said a furniture breakdown along with prices would be presented
to Council in their November packet for review.
Next, Mr. White addressed the phone system and stated that he was waiting on additional
information before an accurate cost would be available. He said bid packets were
expected to come in next week and more information would be provided in the
November packet.
2. Discussion with Planning and Zoning Commissioners regarding upcoming citywide
rezoning.
Mr. Jerry Miller, Chairman of the Planning and Zoning Commission addressed Council
regarding the upcoming citywide rezoning. Mr. Miller said Commissioners reviewed all
annexed areas along with all planned development districts to determine appropriate
zoning classifications.
In addition, Mr. Miller addressed a previous ordinance that Council had approved. He
stated that no matter what type of zoning was placed on those properties that fell within
the area the ordinance governed, the ordinance would take precedence. Mr. Miller went
on to say that Commissioners used the Master Lane Use Plan for a guideline to base their
zoning decisions on as well as recommendations from City Staff.
Next, Mr. Miller spoke about issues raised at the hearings. Those concerns related to the
planned development district and recently annexed areas. Owners of those parcels
preferred the planned development district for the flexibility for use of the land, and
Commissioners felt that since there was no set zoning designated for those areas that it
was best to do away with that type of zoning. Mr. Miller said that other opposition was
received from residents residing in recently annexed areas due to the mixed zoning in
those areas. He said each Commissioner toured the various areas and based their zoning
decision on what the primary use was in that designated area.
Questions and answers then followed with concerns relating to zoning compatibility with
adjoining cities. Again, it was reported that Commissioners did the best that they could
and tried to stick to the Comprehensive Master Land Use Plan for guidelines.
C. STAFF COMMENTS
City Manager Report - Mr. Ted Rowe, City Manager stated that construction on Little School
Road was underway, and that the Texas Highway Department had scheduled a public hearing
for November 30, 2000 on the widening of Mansfield Highway in the Community Center.
Mayor Wright requested that a meeting be scheduled between Council and Wal-Mart
representatives. A meeting was scheduled for Monday, November 6, 2000 at 6:30 p.m.

D. ADJOURNMENT
Mayor Wright adjourned the meeting at 8:30 p.m.
