MINUTES OF
KENNEDALE CITY COUNCIL
REGULAR MEETING -AUGUST 9, 2001

Mayor Wright called the meeting to order at 7:35 p.m.
Members present: Mayor Wright, Councilmembers Clark, Hoover, Barrett, Vaughn, and Kovach.
Members absent: None
Staff present: Ted Rowe, Kathy Turner, LiJen Lee, Mort Wetterling, David Geeslin, and legal
counsel, Wayne K. Olson.
Councilmember Barrett gave the invocation.
A. VISITORICITIZENS FORUM
No persons registered to speak during the forum.
B. CONSENT AGENDA
1. Approval of city council minutes: Workshop and regular meeting dated July 12, 2001,
workshop dated July 24, 2001, and workshop dated July 31, 2001.
2. Consider approval of Ordinance No. 216 appointing Municipal Court Judge.
3. Consider approval of Contract No. 01-01, Tarrant County for Ad Valorem Tax
Collections.
Councilmember Barrett moved to approve consent agenda items one through three,
second by Councilmember Clark. Motion carried.
C. REGULAR ITEMS
4. Consider approval of Ordinance No. 213, rezoning of 71.7 acres out of the J.B. Renfro
Survey, Abstract 1260, Tracts SA and SB from "PD" to "R2".
Councilmember Hoover moved to approve Ordinance No. 213, second by
Councilmember Barrett. Motion carried.
5. Consider appointing PATTILLO, BROWN & HILL L.L.P. as the City's independent
auditor and authorize Mayor to execute contract.
Councilmember Kovach moved to appoint PATTILLO, BROWN & HILL, L.L.P. as the
City's independent auditor, second by Councilmember Vaughn.
Councilmember Kovach amended his original motion to add "and authorize the Mayor to
execute contract," second by Councilmember Vaughn. Motion carried.

6. Consider award of contract for reconstruction of East Sublett and Mansfield Cardinal
Roads and budget amendment, if necessary.
Councilmember Hoover moved to table this item and revisit in October 2001, second by
Councilmember Vaughn. Motion carried.
7. Discussion regarding State Infrastructure Bank loan options.
No action was required on this item.
Consideration of action on Texas Municipal Retirement System options:
(a) Approval of ordinance to allow certain employees the buy-back option of his or her
previously forfeited credit.
(b) Approval of ordinance to allow restricted prior service for vesting and retirement
eligibility.
(c) Approval of ordinance to allow credit for up to 5 years of prior active military
service.
Councilmember Barrett moved to approve Texas Municipal Retirement System options A
through C, second by Councilmember Hoover. Councilmembers Barrett, Vaughn,
Kovach, and Hoover voted aye, with Councilmember Clark opposing. Motion carried.
D. STAFF COMMENTS
1. City Manager Report
City Manager, Ted Rowe briefed council on Mr. Jimmy Reed, water department
employee who was in a car accident.
2. Director of Finance Report
Director of Finance, Lijen Lee advised that the city's sales tax revenue was above the
projection for the year.
Council requested that Mrs. Lee provide a listing reflecting monies spent and remaining
balance from the Certificate of Obligation for city hall and street projects.
3. Project Coordinator Report
City Manager, Ted Rowe advised that he had not received an updated report from Dave
White regarding the independent survey on Little"School Road.
E. MAYOR/COUNCIL REPORT/ANNOUNCEMENTS
1. Mayor Report/Announcements
Mayor Wright advised that there was no Regional Transportation Meeting, but felt
Council should send a "Thank You" to Mr. Michael Morris for his support. In addition,
Mayor Wright introduced Judge Lee, Municipal Court Judge.

2. Council Reports/Announcements
Councilmember Barrett reminded everyone of the upcoming Kennedale Library book
sale.
F. EXECUTIVE SESSION
Mayor Wright entered into executive session at 8:35 p.m.
The City Council met in closed session pursuant to Section 551.071 of the Texas
Government Code for consultation with the City Attorney pertaining to (1) any matter in
which the duty of the City Attorney under the Texas Disciplinary Rules of Professional
Conduct may conflict with the Open Meetings Act, including discussion of any item
posted on the agenda; (2) legal issues regarding amortization of nonconforming uses and
(3) litigation, settlement offers, and/or claims.

2. The City Council met in closed session to deliberate the purchase, exchange, or value of
real property, Section 551.072, Texas Government Code.
3. The City Council met in closed session to deliberate the appointment, employment,
evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee,
Section 551.074, Texas Government Code.

G. RECONVENE INTO REGULAR SESSION AND CONSIDER ACTION, IF ANY, ON
ITEMS DISCUSSED IN EXECUTIVE SESSION.
Mayor Wright reconvened into open session at 9:36 p.m. No action was taken on executive
session items.

WORKSHOP -AUGUST 9, 2001

Mayor Wright called the workshop to order at 6:35 p.m.
Members present: Mayor Wright, Councilmembers Hoover, Barrett, Vaughn and Kovach.
Councilmember Clark arrived at 7:00 p.m.
Members absent: None
Staff present: Ted Rowe, Kathy Turner, LiJen Lee, Gwen Bevill, David Geeslin, and Mort
Wetterling,
A. WORKSHOP
1. Overview and discussion on proposed 2001/2002 budget.
Council was provided a listing from the Park Board of items to be considered in this
year's budget, which are reflected under the street department budget, and a listing of
unfunded items.
Next, Council briefly reviewed library and police department request.
Another workshop was scheduled for August 14, 2001.
B. ADJOURNMENT
Mayor Wright adjourned the workshop at 7:30 p.m.
