O76-08CITY OF KENNEDALE ORDINANCE NO. 76-8 AN ORDINANCE RE -ADOPTING CITY OF KENNEDALE ORDINANCES NOS. 74-3 AND 74-8 ANNEXING LAND AND TERRITORY AS DES- CRIBED IN SAID ORDINANCES. WHEREAS, Texas, on June 27, No. 74-3 annexing belonging to Ted W Kennedale; and WHEREAS, Texas, on October No. 74-8 annexing longing to Kenneth City of Kennedale; the City Council of the City of Kennedale,. 1974, adopted City of Kennedale Ordinance land and territory therein described, and . Cox and Patsy A. Cox, to the City of the City Council of the City of Kennedale, 10, 1974, adopted City of Kennedale Ordinance land and terrotiry therein described, and be - Pearce and Delpha Maurine Pearce, to the and WHEREAS, said ordinances were not then recorded be- cause of questions raised as to the right of the City of Kenne- dale to annex such land while certain litigation with the City of Arlington over extraterritorial jurisdiction of the two cities was still pending on appeal; and WHEREAS, said pending litigation has now been compro- mised and settled, whereby all of the land and territory des- cribed in said two ordinances was awarded exclusively to the City of Kennedale as a part of its exclusive extraterritorial jurisdiction; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the previous adoption by this City Council of said City of Kennedale Ordinances Nos. 74-3 and 74-8 is hereby ratified and confirmed, and each of said ordinances is hereby re -adopted so as to eliminate any question as to the validity of such prior annexations. 2. That said two ordinances shall be fortwith recorded in the office of the County Clerk of Tarrant County, Texas, as originally adopted, and said land and territory shall fortwith be placed on the tax rolls of the City of Kennedale, if not al- ready so enrolled, and said land and territory, as described in each of two said ordinances shall constitute an integral part of the City of Kennedale, Texas. PROPERTY OWNERS AND CITIZENS OF SAID CITY, AND SHALL BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED; FURTHER PROVIDING FOR THE AMENDING AND CORRECTING OF THE OFFICIAL BOUNDARIES OF SAID CITY AS HERETOFORE ADOPTED AND AMENDED, TO INCLUDE SAID LAND AND TERRI- TORY; AND FOR AN EFFECTIVE DATE. WHEREAS, after due notice as required by the Texas Municipal Annexation Act, the City Council;of the City of Kennedale, Texas, has duly held public hearing on the ques- tion of whether said City should institute annexation pro- ceedings on the hereinafter described property and territory, giving all interested persons an opportunity to be heard at such hearing; and WHEREAS, said City Council, after public hearing and within the time prescribed by law, has determined that it will be in the best interest of said City of Kennedale, Texas, its inhabitants, and the owners and inhabitants of'the hereinafter described territory, that such land and territory be annexed to the City of Kennedale, Texas; and WHEREAS, at a regular meeting on this loth da.y of October, 1974, said City Council has duly considered such pro- posed annexation, and finds that all the territory hereinafter described is situated within the extraterritorial jurisdiction of the City of Kennedale, that it is adjacent and contiguous to the existing boundaries of said City, that it is not more than one-half mile in width, that all owners thereof have made written application as by law provided for the annexation of same to said City, and that all statutory requirements and con- ditions for annexation of said territory have been fulfilled; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. That the land and territory hereinafter de- scribed lying entirely within the extraterritorial jurisdiction of the City of Kennedale, Texas, and being adjacent and contigu- ous to the existing boundaries of said City, be, and the same is hereby annexed to and brought within the corporate boundar- ies, and hereby made an integral part of the City of Kennedale, Texas, such land and territory hereby annexed being described by metes and bounds as follows, to -wit: BEING a tract of land out of the M. F. Scott Survey, Abstract No. 1450, in Tarrant County, Texas, and being a part of the Tommy L. Gay Land, Veteran Purchase in contract record- ed in Vol. 3035, at Page 46.8, Deed Records of Tarrant County, Texas, and described by metes and bounds as follows: BEGINNING at an iron rod at the Northeast corner of a 1.37 acre tract of land sold by Tommy- L. Gay to Kenneth R. McCutchen, and being in the North line of said Gay purchase; THENCE. South 1 degree 20-3/4 minutes East 226.0 feet with the East line of said McCutchen tract to an iron rod at the South- east corner of said McCutchen Tract in the North line of a road; feet with THENCE North 89 degrees 13-1/2 minutes East 613.3 feet to an iron rod in the West line of a tract owned by Texas Electric THENCE North 0 degrees.46-1/2 minutes West 348.0 feet with said line to an iron rod in the North line of said Gay land; THENCE South 89,degrees 25 minutes West 645.4 feet along a fence to the place of beginning and containing5.06 acres. Section 2. That the owners and inhabitants of the property above described and hereby annexed be, and they are hereby declared entitled to all of the rights and privileges of other property ,owners and citizens of the City of Kennedale, Texas, and shall henceforthbe bound by all of the acts and ordinances of said City'of Kennedale, Texas, which are now in force and effect, and which. may be hereafter adopted. F. Scott Survey, Abstract No. 1450, in Tarrant County, Texas, a part of the Tommy L. Gay land, purchased from the Texas Veteran's Land Board, as described in Vol. 3035, at Page 468, of the Deed Records of Tarrant County, Texas, and more particularly described as follows: BEGINNING at a point, an iron rod, 447.5 feet North 89° 28' 30" East and 60 feet North 3° 44' 30" East of the Northwest corner of Lot 24 of the Gay Daughters Subdivision, as shown in plat filed 5-9-58, recorded in Vol. 388-9, at Page 423, of the Plat Records of Tarrant County, Texas; THENCE North 0° 46' 30" West, 510.1 feet to an iron rod in the South line of a 5.06 acre tract; THENCE North 89° 13' 30" East, 204.9 feet to an iron rod at the Southeast corner of said 5.06 acre tract in the West line of Texas Electric Service Company tract of land (being also in a present Westerly corporate limit line of the City of Ken- nedale, Texas) THENCE South 0d 46' 30" East, 510.25 feet with the West line of said Texas Electric tract (being also in a present Westerly corporate limit line of the City of Kennedale) to a point for corner; THENCE South 89° 28' 30" West, 204.9 feet to the PLACE OF BE- GINNING, and containing 2.40 acres of land, and being a clos- ure of the first tract of land hereby annexed, the ending point and last call being in the Northerly right-of-way line of a 60 feet wide County Road; THENCE, beginning at the ending point of the tract just de- scribed, in a Westerly direction with the Northerly right-of- way line of said 60-foot wide County Road to its point of in- tersection with a present Easterly corporate limit line of the City of Kennedale, Texas; thence in a Southerly direction with the present corporate limit line of the City of Kennedale, Texas, 60 feet more or less, to the intersection of the South- erly right-of-way line of said County Road with the:present corporate limit line of the City of Kennedale, Texas; THENCE Easterly with the Southerly right-of-way line of said 60-foot wide County Road to its intersection with a present Westerly corporate limit line of the City of Kennedale (being also the West line of the Texas Electric tract hereinabove mentioned); THENCE Northerly with the West line of said Texas Electric tract (being also a present Westerly corporate limit line of the City of Kennedale, Texas), to the Southeast corner of the first tract hereinabove described as being annexed by this or- dinance; THENCE South 89° 28' 30" West with the South line of said first tract hereinabove described to its Southwest corner, being also the POINT OF BEGINNING, and being a closure of the second tract hereby annexed. Section 2. It is the intention to hereby annex-_: to, the City of Kennedale, Texas, all of the property of Ted W. Cox and wife, Patsy A. Cox, above described as the First Tract hereby annexed, together with all of the 60-foot wide existing County Road abutting such Cox property on the Cox property South boundary line, and all of said County Road extended Easterly and Westerly to said County Road's inter- section with present corporate limit lines of the City of Kennedale on the East and West, said County Road being here- inabove described as the Second Tract hereby annexed. Section 3. That the owners and inhabitants of the property above described and hereby annexed be, and they are hereby declared entitled to all of the rights and privileges of other property owners and citizens of the City of Kennedale, Texas, and shall henceforth be bound by all of the acts and ordinances of said City of Kennedale, Texas, which are now in force and effect, and which may be hereafter adopted. Section 4. That the official boundaries of the City of Kennedale, Texas, as heretofore adopted and amended, be and they are hereby corrected and amended, so as to include the above described area and territory as a part of the City of Kennedale, Texas. -2- Section S.
