AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR. VEHICLES UNDER THE PROVISIONS. OF
SECTION 8.OF ARTICLE 827 a, VERNON'S TEXAS PENAL
CODE, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC
INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS,
OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF
THE CITY OF KENNEDALE, AS SET OUT IN THIS ORDINANCE;
AMENDING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE; AND PROVIDING A PENALTY
BY FINE NOT TO EXCEED $100.00 FOR THE VIOLATION OF
THIS ORDINANCE.
WHEREAS, Section 8 of Article 827 a, Vernon's Penal
Code of the State of Texas, provides that whenever the
governing body of the City shall determine upon the basis of an
engineering and traffic investigation that any prima facie
speed therein set forth is greater or less than is reasonable
or safe under the conditions found to exist at any intersection
or other place or upon any part of a street or highway within
the City, taking into consideration the width and condition of
the pavement and other circumstances on such portion of said
street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of an
Ordinance, which shall be effective when appropriate signs
giving notice thereof are erected at such intersection or other
place or part of the street or highway, now therefore:
BE IT ORDAINED BY THE CITY COUNCIL"OF THE CITY OF
KENNEDALE, TEXAS:
SECTION 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions of
Section 8 of Article 827 a, Vernon's Texas Penal Code, the
following prima facie speed limits hereafter indicated for
vehicles are hereby determined and declared to be reasonable and
safe; and such speed limits are hereby fixed at the rates of
speed indicated for vehicles travelling upon the named streets
and highways, or parts thereof, described as follows;
(1) On United States Highway 287 from a point where
said Highway enters said City of Kennedale in the North
Western boundary -thereof in a South Eastern direction
along said Highway 0.79 miles, 50 miles per hour.
(2) On United States Highway No.287 from a point 0.79
miles South East from where said Highway enters the North
Western boundary of said City of Kennedale in a South
Eastern direction a distance of 0.97 miles, 45 miles per
hour.
(3) On United States Highway No.287 from a point 1.76
miles South East from where said Highway enters the
North Western boundary of said City of Kennedale in a
Southerly or South Western direction a distance of 0.27
miles to the South Eastern boundary of said City on said
Highway, 55 miles per hour.
(4) On United States Highway No.287 for a distance of
0.25 milesadjacent to the Kennedale Public School (said
0.25 mile strip beginning 1.05 miles South Easterly on
said Highway from the point that said Highway enters the
North Western boundary of said City of Kennedale, and
ending 0.73 miles in a Northerly or North Easterly direction
on said Highway from the point that said Highway enters the
South Eastern boundary of said City of Kennedale), during
school hours and while a portable school warning sign is
placed along said strip of Highway, 30 miles per hour.
At other than school hours, the speed limit along said
0.25 mile strip of said Highway shall be 45 miles per
hour.
(5) On all other streets, highways, roads and alleys in
the City of Kennedale, save and except U.S. Highway No.287,
as hereinabove provided, the speed limit shall be as
designated in -other applicable 0rdianees of the City of
Kennedale.
SECTION 2. This Ordinance is intended to amend that
speed zone Ordinance heretofore enacted by the City Council of
the City of Kennedale, Texas, on the 17th day of September,
1953, and that certain Ordinance enacted by the City Council of
the City of Kennedaleon the day ofA
1956, changing
the speed limits on U.S. Highway No.287 during a period of
construction, as well as any and all other Ordinances in direct
conflict with the provisions hereof, but this Ordinance shall
be cumulative of any and all Ordinances prescribing speed limits
for other streets within the City of Kennedale which are not in
conflict with the provisions hereof.
SECTION 3. This Ordinance shall be in full force
and effect immediately upon its passage and publication, as by
law provided.
SECTION 4. Any person violating any of the provisions
of this Ordinance shall, upon conviction thereof, be fined in
any sum not more than $100.00.

ing maximum speed limits upon
U.S. Highway No. 287 within
the City. Beginning at the'point
that said highway enters the
City : of Kennedale on the north
(that is, at Village Creek), this
speed limit is set at fifty miles
per hour for the first 0.79 miles
of said highway proceeding in
a southerly direction, at 45 miles
per hours for the .,next 0.26 miles
of said highway, at thirty miles.

of said highway when signs are
erected during school hours and.
at forty-five miles per hour at
all other times, at forty-five
miles per hours for the next 0.46
miles ofsaid highway, and at
fifty-five miles per hour for the

able, upon conviction, by fine

00. The ordinance is declared
to be effective. upon publication
of this notice.
