RESOLUTION NO. 87 SECRETARY'S COPY
A RESOLUTION ESTABLISHING THE DWELLING UNIT FEE TO BE
USED IN CALCULATING THE AMOUNT OF CASH PAYMENT IN LIEU OF
PARK DEDICATION IN THE AREA OF THE SHADY CREEK EAST
SUBDIVISION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance 153 in the City of Kennedale provides that no final
subdivision plat for any property zoned for residential use in the City of Kennedale shall be
approved unless such plat shall include a dedication of land, or a cash payment in lieu of
land dedication, to the City of Kennedale for neighborhood park purposes; and
WHEREAS, Section 2(f) of Ordinance 153 provides that the City Council shall
establish a payment of cash in lieu of a dedication requirement computed on the basis of
a certain dollar amount per dwelling unit, which dollar amount shall be based on the
approximate cost of acquiring one raw acre of vacant land in a developing area of the
community derived from a reasonable study and investigation of the best available
information as to the land values within the community; and
WHEREAS, Section 2(f) of Ordinance 153 further allows the City Council, at its sole
discretion, to establish different fees for different areas of the City; and
WHEREAS, an appraisal performed by Mr. Paul Ondo, S.R.A., on October 30,
1998, indicates that the land value in the area of the Shady Creek East subdivision is
$17,500 per acre of vacant land; and
WHEREAS, the fee per dwelling unit in the area of the Shady Creek East
subdivision shall be $175.00 per lot.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KENNEDALE, TEXAS:
I.
Based on a reasonable study and investigation of the best available information
regarding land values in and near the Shady Creek East subdivision, it is hereby found that

the land value of vacant land in the area of the Shady Creek East subdivision is $17,500
per acre.
II.
In accordance with Ordinance 153, which states that the fee per dwelling unit shall
be calculated by dividing the amount per acre of vacant land by 100 residential units, it is
further hereby declared that the fee per dwelling unit in the area of the Shady Creek East
subdivision is $175.00 ($17,500 = 100 = $175.00).
III.
It is hereby found and determined that the meeting at which this Resolution was
passed was open to the public and that public notice of the time, place, and purpose of
said meeting was given, all as required by law.
IV.
This Resolution shall be effective upon passage.
