O341OEF~C~AL CfTY SECRE.TARY'S COPY ORDINANCE NO. 341 AN ORDINANCE AMENDING CHAPTER 16 OF THE KENNEDALE CITY CODE; PROVIDING FOR THE CREATION AND APPOINTMENT OF ALTERNATE PARK AND RECREATION BOARD MEMBERS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Kennedale, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, Chapter 16, Article II, of the City Code establishes a Park and Recreation Board; and WHEREAS, Chapter 16, Article II of the City Code sets forth the membership of the Park and Recreation Board; and WHEREAS, the City Council desires to allow for the appointment of alternative members to the Park and Recreation Board; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS. Section 1. Section 16-10 of the Kennedale City Code, is hereby amended to read as follows: Sec. 16-10. Created. There is hereby created and established a park and recreation board to be composed of five (5) regular members and three (3) alternate members. Such board shall be officially designated as the Park and Recreation Board of the City of Kennedale, Texas. Section 2. Section 16-11 of the Kennedale City Code, is hereby amended to read as follows: W:\Kennedale\ORDINANC\PazksBoardAlternates.doc (07/14/06) Page 1 Sec. 16-11. Membership; appointments, qualifications, terms, vacancy. (a) The five (5) regular members are hereby designated by places, being place 1 through 5, and the three (3) alternate members, places 6 through 8, on the park and recreation board. Each city council member may appoint one (1) regular park board member to the park board place corresponding to the city council member's place. The three (3) alternate members shall be appointed by majority vote of the city council. (b) Corresponding with the terms of office of the corresponding city council member: (1) The initial term for regular board members serving in places 1, 3 and 5 shall be until May of 1995. Thereafter, places 1, 3 and 5 shall be appointed in May of each odd-numbered year. Alternate board member 7 shall also be appointed in each odd- numbered year. (2) The initial term for board members serving in places 2 and 4 shall be until May of 1996. Thereafter, places 2 and 4 shall be appointed in May of each even- numbered year. Alternate board members 6 and 8 shall also be appointed in each even-numbered year. (c) The alternate members shall attend each meeting and shall, on a rotating basis, act in the place of an absent regular member. If no standing member is absent, the alternate members shall not vote on any matter. (d) In the event of a vacancy on the park and recreation board, such vacancy shall be filled in accordance with this section. (e) If a city council member fails to make an appointment within ninety (90) calendar days of the date of the vacancy or date of expiration, the city council may by majority vote make an appointment. (f) The members of the park and recreation board shall be resident citizens within the corporate limits of the city, taxpayers, and qualified voters of the City of Kennedale, Texas. (g) Aboard member may be removed by a majority vote of the city council for cause or without cause. W:\Kennedale\ORDINANC\ParksBoardAlternates.doc (07/14/06) Page 2 Section 3. This ordinance shall be cumulative of all provisions of ordinances and of the Kennedale City Code, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. Section 4. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. Section 5. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
