A RESOLUTION GRANTING TARRANT COUNTY, TEXAS THE AUTHORITY TO
ACQUIRE AND, IF NECESSARY, ORDER THE CONDEMNATION AND
APPROPRIATION OF CERTAIN EASEMENT RIGHTS, IN, OVER AND THROUGH
PROPERTY SITUATED AT HUDSON VILLAGE CREEK ROAD AND KENNEDALE -NEW
HOPE ROAD, A PORTION OF WHICH PROJECT IS WITHIN THE CITY LIMITS
OF THE CITY OF KENNEDALE, TARRANT COUNTY TEXAS AND NEEDED FOR
DRAINAGE PURPOSES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS:
I.
That the City Council does hereby grant to Tarrant County,
Texas, the authority to determine the required public necessity
for the acquisition of certain interests in property situated at
Hudson Village Creek Road and Kennedale -New Hope Road within the
City of Kennedale, as more specifically depicted by Exhibit "A ",
for drainage purposes; and for this project Tarrant County, Texas
requires the acquisition of certain Easement Rights in, over and
through said land needed for the purpose of constructing said
improvements.
II.
Tarrant County has completed the plans and specifications
and easement documents for the project and Tarrant County is
hereby authorized to determine which property interests within
the City of Kennedale are necessary for the acquisition of
easement rights for this project.
III.
If it is determined that a bona fide offer has been made to
the property owner, in compliance with the law, and that Tarrant
County cannot agree, and has been unable to agree with said
property owner(s) as to the value of the property in question or
as to damages legally allowable by law, and such offers had in
all things been approved, ratified and confirmed, then the City
Council of the City of Kennedale hereby authorizes Tarrant
County, Texas to order the condemnation and appropriation of the
necessary right -of -way interests in, over and through the
property situated at Hudson Village Creek Road and Kennedale -New
Hope Road in the City of Kennedale, Tarrant County, Texas, needed
for drainage purposes by exercising the power of eminent domain
set forth in Chapter 21 of the Property Code, V.T.C.A., and all
applicable provisions of the Charter of the City of Kennedale,
Texas.
IV.
The County Attorney or his designee is hereby authorized to file
the necessary papers and take whatever action is needed for the
prompt acquisition of the required easement rights in the
referenced property location.
V.
Tarrant County, Texas will pay for appraisal fees, closing costs,
the appraised value of the easement rights, court costs, and any
other cost in connection with the acquisition of the easement
rights at Hudson Village Creek and Kennedale -New Hope Road, in
Kennedale, Texas to the extent that funds are made available by
the Commissioners Court of Tarrant County, Texas.
VI.
Tarrant County, Texas will construct the drainage easement at
Hudson Village Creek Road and Kennedale -New Hope Road in
accordance with the plans and specifications as set forth by the
Tarrant County Engineer and approved by the City of Kennedale.
Upon completion of construction by Tarrant County, the County, to
the extent that funds are made available by its Commissioners
Court, will continue maintenance of the drainage easement.
This resolution shall take effect from and after its passage as
provided by law.
