ORDINANCE FOR ADOPTION OF THE
UNIFORM BUILDING CODE AND
UNIFORM BUILDING CODE STANDARDS
An ordinance of the City of Kennedale adopting the 1988 edition of the
Uniform Building Code and the 1988 edition of the Uniform Building Code
Standards regulating the erection, construction, enlargement, alteration,
repair, moving, removal, demolition, conversion, occupany, equipment, use,
height, area and maintenance of all buildings or structures in the City of
Kennedale; providing for the issuance of permits and collection of fees
therefor; providing for penalties for the violation thereof, repealing
Ordinance No. 84 -20 of the City of Kennedale and all other ordinances and
parts of the ordinances in conflict therewith.
The City Council of the City of Kennedale does ordain as follows:
Section 1. That certain documents, one (1) copy of which is on file
and open for inspection of the public in the office of the City Secretary
of the City of Kennedale, being marked and designated as:
Uniform Building Code, 1988 Edition, published by the International
Conference of Building Officials, including the generic fire- resistive
assemblies listed in the Fire Resistance Design Manual, Eleventh Edition,
dated October, 1984, published by the Gypsum Association as referenced in
Tables Nos. 43 -A, 43 -B and 43 -C of the specified Uniform Building Code,
including all Appendix Chapters except Chapters 7, 23, and 35, and the
following amendments: Ordinance 89 -2, Ordinance 89 -4, COG amendments for
Sections 503(d), 2516(f), 3203, 3305, 5406 and 1987 NFPA #13, Standard
for Installation of Sprinkler Systems replaces UBC Standard #38 -1.
Uniform Building Code Standards, 1988 Edition, published by the
International Conference of Building Officials, including (i) Structural
Welding Code -- Reinforcing Steel, AWS D1.4 -79 (U.B.C. Standard No. 26 -8);
(ii) Structural Welding Code -- Steel, ANSI /AWS D1. 1 -84 (U.B.C. Standard
No. 27 -6); and (iii) Structural Welding Code- -Sheet Steel, ANSI /AWS D1. 3 -81
(U.B.C. Standard No. 27 -13) published by the American Welding Society, Inc.,
as modified or amended in the Uniform Building Code Standards referenced
herein:
be and the same are hereby adopted as the code of the City of
Kennedale for regulating the erection, construction, enlargement, alteration,
repair, moving, removal, demolition, conversion, occupancy, equipment, use,
height, area and maintenance of all buildings or structures in the City of
Kennedale providing for issuance of permits and collection of fees therefor;
and each and all of the regulations, provisions, conditions and terms of
such Uniform Building Code, 1988 Edition, and Uniform Building Code
Standards, 1988 Edition, published by the International Conference of
Building Officials, and the secondary publications referenced above, all
of which are on file in the office of the City Secretary are hereby referred
to, adopted and made a part hereof as if fully set out in this ordinance
except that sections 104 through 107 are replaced by the Uniform Administrative
Code, 1988.
Section 2. Violations. It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair, move, improve, remove,
convert or demolish, equip, use, occupy or maintain any building or structure
or cause or permit the same to be done in violation of this code.
Any person, firm, or corporation violating any of the provisions of this
Building Code shall be deemed guilty of a misdemeanor; and each and every day
or portion thereof during which any violation of any of the provisions of this
Building Code is committed continued, or permitted, shall constitute a distinct
and separate offense; and upon conviction of any such violation, any such
person shall be punishable by a fine of not more than $1,000.00
Section 3. That Ordinance No. 84 -20 of City of Kennedale entitled
Uniform Building Code, 1982 Edition and all other ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 4. That if any section, subsection, sentence, clause or phrase
of this ordinance is, for any reason, held to be invalid or unconstitutional,
such decision shall not affect the validity or constitutionality of the remain-
ing portions of this ordinance. The City Council hereby declares that it would
have passed this ordinance, and each section, subsection, clause or phrase
hereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses and phrases be declared unconstitutional.
Section 5. That the City Secretary is hereby ordered and directed to
cause this ordinance to be published as required by law.
Section 6. That this ordinance and the rules, regulations, provisions,
requirements, orders and matters established and adopted hereby shall take
effect and be in full force and effect May 11, 1989 from and after the date
of its final passage and adoption. J

GENERAL CONSTRUCTION REQUIRII
Sec. 2516 (f) 4B(ii) Fire and Draft Stops -- Exception #2 to read as follows:
Attic draftstops may be omitted above one tenant separation wall and intervening
corridor walls provided the area between draftstops does not exceed 3000 square
feet and not more than two tenant spaces are directly below any undivided attic
area.
COVERING REQUIREMENTS
Sec. 3203 -- Add the following paragraphs:
"Fire retardant Class C roof coverings are required on all multi - family and
townhouse units regardless of the size and height of the units. Fire retardant
Class C roofing materials are defined as any roofing material which meets
ASTM E -108 Fire Test Specifications for roofing and has been tested and
approved by a nationally recognized testing laboratory.
In those cases where it proves necessary to replace all or part of an ordinary
wood shingle roof, Class C composition shingles may be overlaid on the wood
shingles."

Sec. 3305 (g) Construction EXCEPTION (5) Reword as follows:
Corridor walls and ceilings need not be of fire- resistive construction within
office spaces having- an- eeeapant- lead.- ef- iAg -er -less when the entire story
in which the space is located is equipped with an automatic sprinkler system
throughout the smoke detectors are installed within the corridor in accordance
with their listing.
SAFETY GLAZING
Sec. 5406 (d) Hazardous Locations - Add Exception #5 to read as follows:
Windows where there is not a walking surface within three feet on both sides.
PROPOSED REGIONAL AMENDMENT TO THE
1988 UNIFORM BUILDING CODE STANDARDS
NCTCOG endorses the 1987 Edition of National Fire Protection Association 13,
"Standard for the Installation of Sprinkler Standards, " in place of Uniform
Building Code Standard No. 38 -1, "Installation of Sprinkler Systems."
