ORDINANCE FOR ADOPTION OF THE
UNIFOIN MECHANICAL CODE
ORDINANCE NO. 89 - 8
An ordinance of the City of Kennedale adopting the 1988 edition of the
Uniform Mechanical Code, regulating and controlling the design, construction,
quality of materials, erection, installation, alteration, repair, location,
relocation, replacement, addition to, use or maintenance of heating, venti-
lation, cooling, refrigeration systems, incinerators, or other miscellaneous
heat - producing appliances in the City of Kennedale; providing for the is-
suance of permits and collection of fees therefore; repealing Ordinance
No. 84-20 of the City of Kennedale and all other ordinances and parts of the
ordinances in conflict therewith.
The City Council of the City of Kennedale does ordain as follows:
Section 1. That certain documents, one (1) copy of which is on file
in the office of the City Secretary of the City of Kennedale, being marked
and designated as "Uniform Mechanical Code," including Appendix Chapter A
and Appendix Chapter B, published by the International Conference of Building
Officials, be and is hereby adopted as the code of the City of Kennedale for
regulating the design, construction, quality of materials, erection, instal-
lation, alteration, repair, location, relocation, replacement, addition to,
use or maintenance of heating, ventilating, cooling, refrigeration systems,
incinerators or other miscellaneous heat- producing appliances in the City of
Kennedale providing for the issuance of permits and collection of fees there-
fore; and each and all of the regulations, provisions, conditions and terms
of such "Uniform Mechanical Code," 1988 edition on file in the office of the
Permit Division are hereby referred to, adopted and made a part hereof as if
fully set out in this ordinance, except that Sections 104, 105, and 106 are
replaced by the Uniform Administrative Code, 1988, and that Table No. 10 -0,
Insulation of Ducts, par. 3C is deleted.
Section 2. Violations, Section 204. It shall be unlawful for any
person, firm or corporation to erect, construct, enlarge, alter, repair,
move, improve, remove, convert or demolish, equip, use or maintain any
mechanical systems or equipment or cuase or permit the same to be done
in violation of this code.
Any person, firm, or corporation violating any of the provisions of
this Mechanical Code shall be deemed guilty of a misdemeanor; and each and
every day or portion thereof during which any violation of any of the
provisions of the Mechanical Code is committed to continue, or permitted,
shall constitute a distinct and separate offense; and upon conviction of
any such violation, any such person shall be punishable by a fine of not
more than $1,000.00.
Section 3. That Ordinance No. 84 -20 of City of Kennedale entitled
Uniform Mechanical Code and all other ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 4. That if any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be unconstitutional,
such decision shall not affect the validity of the remaining portions of
this ordinance. The City Council hereby declares that it would have passed
this ordinance, and each section, subsection, clause or phrase thereof,
irrespective of the fact that any one or more sections, subsections,
sentences, clauses and phrases be declared unconstitutional.
Section 5. That the City Secretary is hereby ordered and directed
to cause this ordinance to be published.
Section 6. That this ordinance and the rules, regulations, provisions,
requirements, orders and matters established and adopted hereby shall take
effect and be in full force and effect May 11, 1989.

height, area and maintenance of all buildings or structures in the City of
Kennedale; providing for the issuance of permits and collection of fees
therefor; providing for penalties for the violation thereof; repealing
Ordinance No. 84 -20 of the City of Kennedale and all other ordinances and
parts of the ordinances in conflict therewith.
This Ordinance and' the rules, regulations, provisions, requirements,
orders and matters established and adopted hereby shall take effect and
be in full force and effect May 11, 1989.
