ORDINANCE NO. 18
WHEREAS, the City Council of Kennedale, Texas, has determined
that the economic well being of the City of Kennedale is of primary
concern to the City Council, and;
WHEREAS, Chapter 312, Texas Property Tax Code, known as the
Texas Property Redevelopment and Tax Abatement Act, provides that
the City of Kennedale has the authority to create reinvestment
zones within the City for the purpose of economic development, and;
WHEREAS, on November 14, 1991 the City of Kennedale City
Council, by resolution, established certain guidelines and criteria
governing tax abatement agreements and indicated the desire of the
City of Kennedale to become eligible to participate in tax
abatement agreements, and;
WHEREAS, Bill Millhouser (Millhouser and Brimer) has requested
the designation of a reinvestment zone for purposes of tax
abatement of real and personal property for the purposes of
economic development as defined under the Texas Property
Redevelopment and Tax Abatement Act, and;
WHEREAS, on the 6th day of February, 1992, notice was
published in the Kennedale News stating that a public hearing would
be conducted by the City of Kennedale Council on the 13th day of
February, 1992, to consider the request to have the property herein
described in Exhibit "A" designated as a reinvestment zone, and;
WHEREAS, it is the finding of the City Council of the City of
Kennedale that the proposals as presented to the City of Kennedale
meet the applicable guidelines and criteria adopted by the City
Council of November 14, 1991, and;
WHEREAS, it is the finding of the City Council of the City of
Kennedale that the creation of a reinvestment zone for the above
stated property would be a benefit to the said property and the
development anticipated to occur in the proposed zone would
contribute to the economic development of the City of Kennedale,
and;
WHEREAS, it is the finding of the City Council of the City of
Kennedale that the designation of the reinvestment zone would
contribute to the retention or expansion of primary employment
within the City of Kennedale, Texas, and;
WHEREAS, it is the finding of the City Council of the City of
Kennedale that it is in the best interest of the citizens of
Kennedale to grant a variance to allow exemption of the personal
property, and;
WHEREAS, it is the finding of the City Council of the City of
Kennedale that the designation of the reinvestment zone would
attract major investment in the zone, now;
BE IT THEREFORE ORDERED that the City Council of the City of
Kennedale hereby designates as a reinvestment zone property herein
described in Exhibit "A" pursuant to the authority contained in
Section 312.201 of the Texas Property Redevelopment and Tax
Abatement Act and grants a variance to the guidelines adopted on
November 14, 1991 so as to include personal property in the tax
abatement criteria as requested in Exhibit "B ".
Passed in open session of the City Council of the City of
Kennedale this 13th day of February, 1992.

EXHIBIT "A"
BEGINNING at a 1/2" iron in the north line of Bolen Road and the
south line of Interstate Hwy. No. 20, said point being N 89 43'
26" W, 39.75 feet from the old west line of Kennedale- Bowman
Springs Road;
Thence N 89 43' 26" W, along the north line of said Bolen Road,
756.12 feet to a 1/2" iron;
THENCE N 00 06' 24" E, along the east line of said Bolen Road,
202.95 feet to a 1/2" iron in the south line of said Interstate
Hwy. No. 20, said point being the beginning of a non - tangent curve
to the right whose radius is 1412.40 feet and whose long chord
bears S 76 43' 06" E, 337.00 feet;
THENCE along the south line of said I. H. No. 20 as follows:
Along sid curve, in an easterly direction, through a
central angle of 13 42' 12 ", 337.80 feet to a highway
monument at the end of said curve;
S 69 52' E, 182.50 feet to a highway monument at the
beginning of a curve to the left whose radius point bears
N 20 08' E, 974.93 feet;
Along said curve, in an easterly direction, through a
central angle of 14 53' 01 ", 253.26 feet to a 1/2" iron
at the end of said curve;
S 42 42' E, 14.79 feet to the POINT OF BEGINNING and
containing 1.858 acres of land.
