O022 City of Kennedale Ordinance No. 22 AN ORDINANCE OF THE CITY OF KENNEDALE ADOPTING THE 1991 EDITION OF THE "UNIFORM PLUMBING CODE" AND THE 1991 EDITION OF THE "IAPMO INSTALLATIONS STANDARDS" REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, QUALITY OF MATERIALS, ERECTION, INSTALLATION, ALTERATION, REPAIR, LOCATION, RELOCATION, REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF ANY PLUMBING SYSTEM IN THE CITY OF KENNEDALE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; REPEALING ORDINANCE NO. 89 -7 OF THE CITY OF KENNEDALE AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED by the City Council of the City of Kennedale, Texas, that: Section 1. That certain documents, three (3) copies of which are on file in the office of the City Secretary of the City of Kennedale, being marked and designated as "Uniform Plumbing Code ", (including Appendix Chapters A, B, C, D, E, H, and I) and the COG amendments for Sections 711, 1003, 1010, and 1212, and "IAPMO Installation Standards" published by the International Association of Plumbing and Mechanical Officials, be and are hereby adopted as the code of the City of Kennedale for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the City of Kennedale providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such "Uniform Plumbing Code ", 1991 edition, and "IAPMO Installation Standards ", 1991 edition, published by the International Association of Plumbing and Mechanical Officials, on file in the office of the City Secretary are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. The Uniform Administrative Code, 1991, is hereby substituted for all appropriate administrative sections. Fees will be as set by the City Council from time to time. Section 2. Violations. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, or maintain any plumbing or permit the same to be done in violation of this Code. Any person, firm, or corporation violating any provision of this Code shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine and /or imprisonment set forth by the governing laws of the jurisdiction. Each separate day or any portion thereof, during which any violation of the Code occurs or continues, shall be deemed to constitute a separate offense, and upon conviction of any such violation, any such person shall be punishable by a fine of not more than $2,000. Section 3. That Ordinance No. 89 -7 of City of Kennedale entitled Kennedale Plumbing Code and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such perfoined by him in the enforcement of any provision of this Code shall decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Section 5. That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect April 9, 1992 from and after the date of its final passage and adoption. PVC gas pipe proponents have not sought or gained approval from any jurisdiction in this region because there is no local demand. Given that few parts of the nation use it and that local plumbers have doubts about its ability to y safely transport low /medium pressure gas and resist puncturing, these references in the UPC could lead to an assumption by some plumbers that the material can be used without formal approval being first established.
