CITY OF KENNEDALE ORDINANCE NO. 23 AN ORDINANCE OF THE CITY OF KENNEDALE ADOPTING THE 1991 EDITION OF THE UNIFORM MECHANICAL CODE, REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, QUALITY OF MATERIALS, ERECTION, INSTALLA- TION, ALTERATION, REPAIR, LOCATION, RELOCATION, REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF HEATING, VENTILATION, COOLING, REFRIGERATION SYSTEMS, INCINERATORS, OR OTHER MISCEL- LANEOUS HEAT - PRODUCING APPLIANCES IN THE CITY OF KENNEDALE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; REPEALING ORDINANCE NO. 89 -8 OF THE CITY OF KENNEDALE AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH. The City Council of the City of Kennedale does ordain as follows: Section 1. That certain documents, one (1) copy of which is on file in the office of the City Secretary of the City of Kennedale, being marked and designated as "Uniform Mechanical Code," including Appendix Chapter A and Appendix Chapter B, published by the International Conference of Building Officials, be and is hereby adopted as the code of the City of Kennedale for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replace- ment, addition to, use or maintenance of heating, ventilating, cooling, refrigeration systems, incinerators or other miscellaneous heat - producing appliances in the City of Kennedale providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such "Uniform Mechanical Code," 1991 Edition and North Central Texas Council of Governments Regional Amendments to Table 10 -F, and to Sections 1104, and 1903, on file in the office of the Permit Division are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance, except that Sections 104, 105, 106 and 107 are replaced by the Uniform Administrative Code, 1991. Permit fees shall be as set by the City Council from time to time. Section 2. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use or maintain any mechanical systems or equipment or cause or permit the same to be done in violation of this code. Any person, firm, or corporation violating any of the provisions of this Mechanical Code shall be deemed guilty of a misdemeanor; and each and every day or portion thereof during which any violation of any of the provisions of the Mechanical Code is committed to continue, or permitted, shall constitute a distinct and separate offense; and upon conviction of any such violation, any such person shall be punishable by a fine of not more than $2,000.00 Section 3. That Ordinance No. 89 -8 of City of Kennedale entitled Uniform Mechanical Code and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more section, sub- sections, sentences, clauses and phrases be declared unconstitutional. Section 5. That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect on April 9, 1992. Environmental Air Ducts M.,....... • Sec. 1104. Environmental air ducts not regulated by other provisions of this code shall comply with this section. Ducts shall be substantially airtight and shall comply with the provisions of Chapter 10. Exhaust ducts shall terminate outside the building and shall be equipped with back - draft dampers. Environmental air ducts which have an alternate function as a part of an 'approved smoke - control system do not require design as Class 1 product- conveying ducts. Ducts used for domestic kitchen range ventilation and domoslie clothes dryers shall be of metal and shall have smooth interior surfaces. Commercial dryer exhaust ducts shall be installed in accordance with their listing. For additional requirements for deniestie dryer exhaust systems, see Section 1903. EXCEPTION: Approved flexible duct connectors not more than six feet in length may • be used in connection with domestic dryer exhausts. Flexible duct connectors shall not be concealed within construction. Bathroom and laundry room exhaust ducts may bo of gypsum wallboard subject to the limitations of Section 1002 (a).
