A RESOLUTION OF THE CITY OF KENNEDALE, TEXAS
AUTHORIZING LEGAL COUNSEL TO PROCEED WITH
CONDEMNATION OF A 0.104 OF AN ACRE TRACT OF LAND
SITUATED WITHIN THE W.E. HALTOM SURVEY, ABSTRACT 1791,
AND RECORDED IN INSTRUMENT NO. D206297201, DEED
RECORDS OF TARRANT COUNTY, TEXAS; AND A 0.192 OF AN
ACRE TRACT OF LAND SITUATED WITHIN THE W.E. HALTOM
SURVEY, ABSTRACT 1791, AND RECORDED IN INSTRUMENT NO.
0206301482, DEED RECORDS OF TARRANT COUNTY, TEXAS, FOR
A PUBLIC ROADWAY.
WHEREAS, the City of Kennedale ( "the City ") desires to acquire fee simple title
to the property described below in order to construct certain municipal improvements,
specifically a public roadway and /or other public purposes permitted by law, in order to
serve existing and future developments in the City and the citizens of the City; and
WHEREAS, the City made an initial offer to the property owners to purchase the
said property; and
WHEREAS, the City has provided to the property owners a copy of the Land
Owner's Bill of Rights, as required by law; and
WHEREAS, the City and the owners of the said property have been unable to
reach an agreement on the acquisition of this property; and
WHEREAS, the City Council now deems it necessary to authorize the City
Attorney to initiate condemnation proceedings in order to acquire fee simple title to such
property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KENNEDALE, TEXAS:
SECTION 1.
The City Council of the City of Kennedale, Texas, hereby finds and determines
that the recitals made in the preamble to this Resolution are true and correct, and
incorporates such recitals herein.
SECTION 2.
The City Council of the City of Kennedale, Texas, hereby finds and determines
that a public necessity exists for the City of Kennedale, Texas to acquire approximately
0.104 acre tract of land and a 0.192 acre tract of land as described and depicted on the
attached Exhibit "1", Exhibit "2 ", Exhibit "3" and Exhibit "4" for a public roadway and /or
other public purposes permitted by law.
SECTION 3.
The City Manager and City Attorney are authorized to comply with the statutes of
the State of Texas with reference to the necessary legal prerequisites existing or
relating to the exercise of eminent domain to appropriate said property for the purpose
of a water line and /or other public purposes permitted by law.
SECTION 4.
The owners claiming an interest in said property are James F. Acree and wife,
Jimmie Jo Acree, whose mailing address is 5510 Sublett Road, Kennedale, Texas
76060.
SECTION 5.
The City Council finds that such acquisition in this condemnation action is
necessary in order to serve the public health, safety and welfare.

RIGHT -OF -WAY ACQUISITION
Being a 0.104 of an acre tract of land situated within the W.E. Haltom Survey, Abstract No. 1791,
and being a portion of a tract of land described to James F. Acree and Jimmie Jo Acree by deed
recorded in Instrument No. D206297201, Deed Records, Tarrant County, Texas, and being more
particularly described by metes and bounds as follows:
COMMENCING at a 1/2 inch iron rod found for northern most corner of Lot 1, Block 2,
Steeplechase Estates, Section One, an addition to the City of Kennedale, Tarrant County, Texas, as
shown by plat recorded in Cabinet A, Slide 1361, Plat Records, Tarrant County, Texas, same being
on the east line of a tract of land described to James F. Acree and wife, Jimmie To Acree by deed
recorded in Instrument No. D206301482, of said Deed Records, same being on the south right -of-
way line of Kennedale Sublett Road (a variable width right -of -way);
THENCE North 01 °32'36" West, with the east line of said Acree tract, a distance of 41.15 feet to a
point on the approximate centerline of said Kennedale Sublett Road;
THENCE with said approximate centerline, the following courses and distances:
North 69 °32'58" West, a distance of 127.02 feet to a point;
North 79 °07'40" West, a distance of 121.54 feet to a point;
North 88 °40'47" West, a distance of 23.46 feet to a point;
North 00 °27'08" West, a distance of 1.38 feet to the POINT OF BEGINNING and
being the northeast corner of the herein described tract;
THENCE South 00 °27'08" East, with the east line of said Acres tract (Instrument No.
D206297201), a distance of 32.00 feet to a 5/8 inch capped iron rod stamped "TNP" set for the
beginning of a non - tangent curve to the left, having a radius of 740.00 feet, and a chord that bears
North 87 °4729" West, 71.30 feet;
THENCE over and across said Acree tract, the following courses and distances
Along said curve to the left, an arc length of 71.33 feet to a 5/8 inch capped iron rod
stamped "TNP" set for comer;
South 89 °26'50" West, a distance of 63.13 feet to a 5/8 inch capped iron rod stamped
"TNP" set for the beginning of a curve to the left, having a radius of 800.00 feet, and a
chord that bears South 88 °56'53" West, 13.94 feet;
AIong said curve to the left, an arc length of 13.94 feet to a 5/8 inch capped iron rod
stamped "TNP" set for corner on the west line of said Acree tract;
THENCE North 01 °04'26" West, with said west line, a distance of 31.29 feet to a point for the
northwest corner of said Acree tract, and being on the approximate centerline of said Kennedale
Sublett Road;
THENCE South 89 °37'57" East, with approximate centerline, a distance of 135.68 feet to a point
for comer;
THENCE South 88 °39'37" East, a distance of 12.97 feet to the POINT OF BEGINNING and
containing 0.104 of an of land, more or less, of which 0.068 of an acre, appears to lie within the
existing right -of -way of said Kennedale Sublett Road, leaving a net area of 0.036 of an acre of
land more or less.

and being more particularly described by metes and bounds as follows:

THENCE along said curve to the left, continuing over and across said Acree tract, an arc length
of 236.58 feet to a 5/8 inch capped iron rod stamped "TNP" set for corner on the west line of
same;
THENCE North 00 °27'08" West, with said west line, a distance of 30.61 feet to a point for the
northwest comer of said Acree tract, same being on the approximate centerline of said
Kennedale Sublett Road;
THENCE South 88 °40'47" East, with said approximate centerline, a distance of 23.46 feet to a
point for corner;
THENCE South 79 °07'40" East, continuing with said approximate centerline, a distance of
121.54 feet to a point for comer;
THENCE South 69 °32'58" East, continuing with said approximate centerline, a distance of
127.02 feet to a point for the northeast comer of said Acree tract;
THENCE South 01 °32'36" East, with the east line of same, a distance of 34.95 feet to the
POINT OF BEGINNING and containing 0.192 of an of land, more or less, of which 0.125 of
