PRE-COUNCIL CHAMBERS Mayor Wright called the meeting to order at 5:07 p.m. Members present: Mayor Wright, Council Members Clark, Mitchell, Barrett, and Kovach. Council Member Vaughn arrived at 5:10 p.m. Members absent: None Staff present: David Miller, City Manager; Margaret Eichelberger, Assistant to City Manager; and legal counsel, Wayne K. Olson. A. REGULAR ITEMS 1. Discussion regarding joining the Tarrant Regional Transportation Coalition. Mayor Wright informed Council that the Tarrant Regional Transportation Coalition would be a group of cities joining together to create an advocacy to implement projects and gain more funding in transportation projects. Mr. Miller said the advocacy was not being created to take away from the Regional Transportation Council, but to apply for additional funding outside R.T.C. projects that would apply directly towards Tarrant County. The cities would join together as one single voice so that they could lobby for State and Federal funding for highway additions and air quality issues that may arise. Mr. Miller also discussed membership dues, which would be based on ten cents per citizen with a current yearly amount due of Six Hundred and Ten Dollars ($610.00). He said other changes made to the contract included not making the Coalition open to neighborhood organizations, and to revisit the uses of Chamber of Commerce and making them non voting members. Mr. Miller said that there were two things that the coalition was asking, which is to make a determination if Kennedale would join the organization, and to make an appointment to the Board of Directors (Mayor, City Manager or Council Member) to serve on that board. It was also noted that if a city did not join the coalition, then that city would not be eligible for funding. Council Member Barrett moved to join the coalition, second by Kovach. Motion carried with all members voting in favor. B. EXECUTIVE SESSION Mayor Wright recessed the meeting at 5:25 p.m. The City Council met in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the 2980 City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meetings Act, including discussion on any item posted on the agenda and legal issues regarding amortization of nonconforming uses; reconstruction of Dick Price Road; and litigation, settlement offers, and/or claims regarding the following matters: a. H&A Land Corporation, d/b/a Showtime Cabaret v. City of Kennedale; Cause No. 402-CV- 0458-Y b. Jerry Coyel v. City of Kennedale, Cause No. 236-193444-02 c. Police Department issues. d. County of Tarrant, Texas v. Jerry Coyel; Cause No. 348-185513-00 e. Wheeler's Motor Service v. Board of Adjustment; Cause No. 153-201934-03 f. Interlocal Agreement with City of Arlington. g. Refund of Roadway Assessment Fee. h. Discussion regarding settlement agreement with Showtime Cabaret. C. RECONVENE INTO OPEN SESSION AND CONSIDER ACTION, IF ANY, ON ITEMS DISCUSSED IN EXECUTIVE SESSION. Mayor Wright reconvened into open session at 6:09 p.m., with no action taken on executive session items. D.
