AN ORDIANCE PRESCRIBING THE RATE TO BE CHARGED EACH USER
BY THE CITY OF KENNEDALE, TEXAS, FOR CONNECTING VARIOUS
SIZE PRIVATE WATER T,TNES TO THE MAIN WATER LINE AND FOR
SETTING A METER AND FOR FURNISHING THE LABOR AND OTHER
NECESSARY EQUIPMENT IN CONNECTION THEREWITH: AND PROVIDING FOR
A DISCOUNT OF SAID CHARGES IF SAID. USER MAKES PAYMENT PRIOR
TO SPECIFIED TIME: AND PRESCRIBING A FEE OF g*5.00 METER DE-
POSIT TO BE ESCROWED BY THE USER WITH THE CITY DURING THE PER-
IOD OF USE OF THE METER BY THE USER.
WHEREAS, the City of Kennedale, Texas, is. at the present time in the
process of installing a water system, in the City of Kennedale, Texas, and will
within a reasonable time hereafter make water available to the citizens of Kenne-
dale as users of the system and water therefrom; and
WHEREAS, the City of Kennedale will incur certain expense in the con-
nection of each private water line to the main line by way of required equip-
ment, labor and meters; and
WHEREAS, the City of Kennedale will be able to connect said private
water lines to the main water line at less costs if said connection is made while
the main water line is still open and prior to it being covered with dirt; and
WHEREAS, the City of Kennedale will incur more expense in the connection
of private lines to the main line where the user requires a line larger than 3/4
inch in diameter; and
WHEREAS, it is necessary for the city to require a water meter deposit
to be escrowed by each user with the cityto prevent users terminating water ser-
vice from not paying accrued water charges at time of termination of said service.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS, AS FOLLOWS:
SECTION I
1. There shall be assessed, charged and collected a fee of $40.00 from
each user of water as charges and expense for connecting a private water line of
3/4 inches in diameter, or less to the main water line; said services to be rendered
by the city to the user for and in consideration of above stated consideration
shall be as follows: (1) opening and closing ditch between main line and point of
water meter (2) furnishing and installing copper tubing between main line and meter
(3)-furnishing and installing a water tap (4) furnishing and installin• curb and
cock (5) furnishing and installing meter box (6) furnishing and installing meter
and 17J furnishing labor.
2. There shall be assessed, charged and collected a fee of 555.00 from
each user of water as charges and expense for connecting a private water line of
1 inch or above to the main line; said services to berendered by the city to the
user for and in consideration of above stated consideration shall be as follows:
(1) opening and closing ditch between main line and point of water meter (2)
furnishing and installing copper tubing between main line and meter (3) furnishing
and installing a water tap (4) furnishing and installing curb and cock (5) furn-
ishing and installing meter box (6) furnishing and installing meter and (7) furn-
ishing labor.
3. That in each case where a water user pays the abovementioned fees to
the City of Kennedale while the main water line is still open and within sufficient
time prior to closing of said main water line ditch for the city to place a work
order and to perform work on said connection of said private water line sought, said
exact time to be fixed within the discretion of the City Council, the charges to
be assessed, charged and collected for the services to be rendered by the city and
specified in paragraph 1 and 2 herein above shall be reduced by 510.00.
SECTION II
There shall be required of each user of water from the city water works
that he place in escrow with the city the sum of 55.00 meter deposit for each con-
nection requiring a meter and that said deposit be made prior to the installation of
a water meter by said city; that the city shall keep accurate records of the money
deposited with it under this escrow requirement and will, at the time said user ceases
to use said water, refund said deposit to said user; provided, however, that upon
said termination date, should the user owe the city any money for use of water furnished
the city may deduct said charge from the deposit before makeing a refund of said de-
posit.
SECTION III.
Should any part, portion, section or part of a :section of this ordinance
be declared invalid or inoperative or void for any reason by a court of competent
jurisdiction, such decision, opinion or judgnent shall in no way affect the remain-
ing portions, parts, sections or parts of sections of this ordinance, which provision
shall be, remain and continue to be in Bill force and effect.
SECTION IV.
This ordinance shall become effective and be in full force and effect from
and after the date of its adoption.
