O71~~ ~ ~w~~~:FtLE~ Capp pFFIG1~L ORDINANCE NO. 71 AN ORDINANCE AMENDING SECTIONS 8-76 AND 8-82 OF THE KENNEDALE CI'T'Y CODE (1992), AS AMENDED, BY ADOPTING THE UNIFORM FIRE CODE, 1994 EDITION, VOLUMES 1 & 2, INCLUDING ALL APPENDICES AND STANDARDS; PROVIDING FOR THE ADOPTION OF LOCAL AMENDMENTS THERETO; PROVIDING FOR THE ADOPTION OF FEES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Kennedale, Texas is a Type A general-law municipality located in Tarrant County, created in accordance with the provisions of Chapter 6 of the Local Government Code and operating pursuant to the enabling legislation of the State of Texas; and WHEREAS, the city council of the City of Kennedale deems it necessary to adopt this ordinance regulating conditions hazardous to life and property from fire, hazardous materials or explosion in order to protect the health, safety and welfare of the citizens of the City of Kennedale. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS, THAT: SECTION 1. Section 8-76 of the Kennedale City Code is hereby amended to read as follows: f:Miles\kennedal\ordinanc\ufc (06-06-95) "Sec. 8-76. Adoption of Code. (a) The Uniform Fire Code, 1994 Edition, Volumes 1 & 2, published by the International Fire Code Institute, including all Appendices and U.F.C. standards contained therein, is hereby adopted as the Fire Code of the City of Kennedale. A true and correct copy of the Uniform Fire Code, 1994 Edition, Volumes 1 and 2, adopted herein, is attached to Ordinance No. 71 and identified as Exhibit "A", and fully incorporated by reference as though copied in its entirety. The material contained in Exhibit "A" to Ordinance No. 71, although fully adopted and incorporated by reference, shall not be included in the formal municipal codification of ordinances. The material contained in Exhibit "A" shall instead be maintained as public record in the office of the city secretary, and shall be available for public inspection and copying during regular business hours. (b) The Uniform Fire Code, 1994 Edition, Volumes 1 & 2, as herein adopted, is hereby amended as provided in Exhibit "B", the North Central Texas Council of Government's Regional Amendments, Recommendation and Errata, incorporated in and attached to Ordinance No. 71. The amendments set forth in Exhibit "B" shall be maintained as a public record in the office of the City Secretary, and shall be available for public inspection and copying during regular business hours. The City of Kennedale may from time to time determine that additional local modifications to the Uniform Fire Code, 1994 Edition, are necessary and appropriate to meet the unique construction needs of the City of Kennedale. To effectuate these modifications, the city council may enact individual ordinances amending Exhibit "B" to Ordinance No. 71 fully setting forth the changes to be made in the Uniform Fire Code." SECTION 2. Section 8-82 of the Kennedale City Code is hereby amended to read as follows: "Sec.8-82. Fees. Permit and other fees set forth in the Uniform Fire Code shall be applicable unless otherwise specifically listed in the fee schedule in Section 2-3 of the City Code." f:Miles\kennedal\ordinanc\ufc (06-06-95) 2 SECTION 3. This ordinance shall be cumulative of all provisions of ordinances of the City of Kennedale, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 4. It is hereby declared to be the intention of the city council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the city council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. f:Miles\kennedal\ordinanc\ufc (06-06-95) 3 SECTION 6. All rights and remedies of the City of Kennedale are expressly saved as to any and all violations of the provisions of any ordinances affecting the installation and maintenance of heating, ventilating, cooling and refrigeration systems which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 7. The city secretary of the City of Kennedale is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. SECTION 8. The city secretary of the City of Kennedale is hereby directed to publish the caption, penalty clause, publication clause and effective date clause of this ordinance in every issue of the official newspaper of the City of Kennedale for two days, or one issue of the newspaper if the official newspaper is a weekly newspaper, as authorized by Section 52.011 of the Local Government Code. f:\Piles\kennedal\ordinanc\ufc (06-06-95) 4 1994 UNIFORM 1~tE CODE North Central Texas Council of Governments Regional Amendments. The storage, use and handling of fireworks are prohibited. EXCEPTIONS: ~ 1. The use of fireworks for display is allowed as set forth in Section 7802.4. REASON.• This change is to make the Uniform Fire Code compatible with the prevailing practice in this region. REASON.• Adoption of this appendix chapter will allow fuel users to install above ground storage tanks (currently prohibited for refueling) with reasonable safeguards for the practice.
