O63-01ALE ORDINANCE NO. 63-1 AN ORDINANCE VACATING AND ABANDONING _ T PORTION OF HUDSON.S ": 'rT _LYING BET' BLOCKS FIFTY-ONE (51) AND FIFTY-TWO (52), ORIGINAL TOWN OF .. _MALE, TARRANT COUNTY, TEXAS. WHEREAS, the owners of all adjacent property which would_ thereby be affected have petitioned the City Council of the City of Kennedale, Texas, to vacate and abandon that portion of a public street dedicated as Hudson Street in the plat of the Original Town of Kennedale, Tarrant County, Texas, lying between Blocks Fifty -One (51) and Fifty -Two (52), Town of Kennedale, Tarrant County, Texas, assame appears of record in the Deed Records of Tarrant County, Texas; and WHEREAS, the City Council, after due hearing and investigation, has found and determined that such portion of Hudson Street, although dedicated by plat as a public street many years ago, has never been used or improved as a public thoroughfare, but has been con- tinuously under fence and devoted to private use since such dedication; that no public use or benefit would be served by the opening and improving of such portion of said dedicated street at this time, but that it would be to the public interest and convenience that such unused and abandoned portion of said dedicated street be vacated, so that the same can be developed and improved for private use; now, therefore: IT ORDA OF a SALE, TEXAS: N NO BY THE CITY COUNCIL OF THE CITY to : t the portion of Hudson Street lying between Blocks. Fifty -One (51) and Fifty -Two (52) of the Original Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant Cou ty, Texas, bounded on the north by the projected north boundary lines of said Blocks Fifty -One (51) and Fifty -Two (52),, and bounded on the south by the northerly right-of-way line of the Old Mansfield Road (shown as Broadway on the original plat), be, and such portion of said Hudson Street is hereby abandoned and vacated as a public street and thoroughfare. 2. ea.=.t no present need or necessity exists for a public street across such property, that such property has never been devoted or used as a public street, but has been continuously under fence -and devoted to private use since its dedication, and that the public interest and necessity would best be served by the vacation of such portion of said street so t',,:-t said property can be improved and developed for private purposes. 3. That title to the portion of said street hereby vacated shall revert to the abutting property owners of Blocks Fifty -One (51) and Fifty -Two (52), or the portion thereof abutting such vacated street: respec- tively. TO THE MAYOR AND CITY COUNCIL, OF 'HK CITY OF KENNEDALE, TEXAS: We, the undersigned, being all of the owners of adjoining property which would be thereby affected, hereby make application to and petition the said 2layor and City Council of the City of Kennedale, Tarrant County, Texas, for the vacation of that portion of Hudson Street in the plat of the Original Town of Kenned, le, Tarrant County, Texas, as sale appears of record in the Deed Records of Tarrant County, Texas, and lying between Blocks 29 and 30, Town of Kennedale, .rrant County, xas, and Njlso between Third Street and Fourth Street as shown on said plat, and as grounds therefor would show the following: I. Although dedicated as public street many years ago, the aforesaid portion of Hudson Street hereby sought to be vacated has never been improved or used as a public street, and there is no public convenience or necessity that would be served ii developing said portion of Hudson Street as a public thoroughfare at the present or any future time. 2. The only portion of Hudson Street hereby sought to be vacated lies between Block 30 on the West and Block 29 on the East, and between Third Street on the North and Fourth Street on the South, or. the Original Town of Kennedale, Tarrant County, Texas the said Third and Fourth Streets both being public thoroughfares presently so use.. 3. e vacation of such portion.. of Hudson Street will enable the adjoining owners to make improvements for the better use of their property, resulting in taxation benefits to the City of Kennedale, and the public convenience and necessity would best be sold by closing and vacating said portion of said street. WHEREFORE, petitioners pray that the Mayor and City Council of the City of Kennedale, Texas, adopt an ordinance vacating and abandoning that portion of Hudson Street herein described, and that said ordinance provide that title to the portion of said dedicated streets so vacated shall revert to the present owners of abutting property.
