KENNEDALE ORDINANCE N0. 62-5
AN ORDINANCE RELOCATING THAT PORTION OF
VILLAGE STREET LYING BETWEEN THE SOUTH
LINE OF COUNTY ROAD PROJECT 2051 AND
THE SOUTH LINE OF THE ORIGINAL TOWN OF
KENNEDALE, TARRANT COUNTY, TEXAS.
WHEREAS, the owners of all adjacent property which
would thereby be affected materially, have petitioned the
City Council of the City of Kennedale, Texas, to relocate
that portion of a public street dedicated as Village Street
in the plat of the Original Town of Kennedale, Tarrant
County, Texas, lying between the south line of County Road
Project No. 2051 and the south line of the Original Town of
Kennedale, as same appears of record in the Deed Records
of Tarrant County, Texas; and
WHEREAS, the City Council, after due hearing and
investigation, has found and determined that such portion
of Village Street, although dedicated by plat as a public
street many years ago, has never been used or improved as
a public thoroughfare as located on said original plat,
but that an existing road has been constructed and is being
used across the proposed relocation of said Village Street,
as hereinafter described; that no public use or benefit
would be served by insisting upon the original location of
said Village Street as shown in the original plat and
dedication, but that the public interest would best be
served by relocating said Village Street as it presently
exists and as it is hereinafter described; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS:
1. That the portion of Village Street lying between
the south line of County Road Project 2051 and the south line
of the Original Town of Kennedale, being that portion of
Village Street intervening between Blocks 76, 79 and 96 on
the west, and Blocks 75, 80 and 95 on the east, as same
appears of record in the Original Town of Kennedale, as
recorded in the Deed Records of Tarrant County, Texas,
be, and the same hereby is abandoned as a public street
and thoroughfare, except with regard to that portion of
said Village Street as is included within the relocated
boundaries of said street as set forth in the succeeding
paragraph of this ordinance.
2. That said Village Street be, and the same is
hereby relocated, and shall henceforth be described as.
follows by metes and bounds, with respect to that portion
of said Village Street lying south of County Road Project
2051, to -wit:
BEGINNING at an iron pin 873.0 feet east
of and 20.0 feet south of the southwest
corner of the Original Town of Kennedale,
Texas;
THENCE north, passing the south line -of
the Original Town of Kennedale at 20.0 feet
and continuing in all 71140 feet to an iron
pin in the south right-of-way line of County
Road Project 2051;
THENCE north 60 deg. 09 min. east along said
south line of said County Road Project 2051,
69.0 feet to an iron pin;.
THENCE south passing the south line of the
Original Town of Kennedale at 725.0 feet,
and continuing in all 745.0 feet to an iron
pin in a fence line;
THENCE west with said fence line 60.0 feet
to the place of beginning.
3. That no present need nor necessity exists
for a public street as originally dedicated with respect to
the portion of Village Street hereby vacated, but that the
public interest will best be served by'relocating said
Village Street as hereinabove provided.
4. That attached to this ordinance, and hereby
made a part hereof, is a plat showing the Original Town of
Kennedale, with respect to the portion of Village Street
hereby affected,. and also showing the -relocation of said
Village Street as described by the foregoing metes and
bounds.
5. That the remaining portions of said Village
Street, lying north of County Road Project 2051, shall
remain unchanged, and said dedicated street shall continue
to exist for the benefit of the City of Kennedale as shown
in the Original Town of Kennedale, unless this City Council
shall hereafter otherwise direct.
6. That in order to implement this relocation of
such portion of Village Street, a special warranty deed of
exchange shall be executed and recorded by the City of
Kennedale, Texas, and the present owners of the adjoining
land abutting on such proposed relocated street, to -wit:
John E. Hammack, Loren Hammack, Melba Hammack, Merle S.
Hammack, Lane Hammack, Bern A. Hammack, Londa Fern Hammack
Lindloff, joined pro forma by her husband, Paul W. Lind-
loff, and Irabell Hammack McKenney, joined pro forma by
her husband, Luther A. McKenney; whereby the City of
Kennedale shall convey to the said Hammacks that portion
of Village Street hereby vacated, and said other parties
shall convey to the City of Kennedale the above described
property within the relocated boundaries of said Village
Street, including the portions of Blocks 76, 79 and 96,
Original Town of Kennedale, included within said boundaries.
7. That the Mayor and City Secretary of the
City of Kennedale, Texas, are hereby expressly authorized
to execute, deliver and record the aforesaid special
warranty deed of exchange, and this ordinance relocating
such portion of said Village Street shall not become
effective until said special warranty deed of exchange
is executed and acknowledged by all of theaforesaid parties
and duly recorded in the Deed Records of Tarrant County,
Texas; but immediately upon such recordation Of said deed,
this ordinance shall be in full force and effect.

PETITION FOR RELOCATION OF DEDICATED STREET
TO THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
Now comes John E. Hammack, acting for himself
individually, and also as duly authorized agent for
the other interested property owners, and petitions the
City Council of the City of Kennedale, Texas, to change
the location of Village Street, as shown on the original
plat and dedication of the Original Town of Kennedale,
as recorded in the Deed Records of Tarrant County, Texas,
so that the portion of said Village Street lying south of
north of
County Road Project 2051 and/the south line of the Original
Town of Kennedale shall henceforth be described by metes
and bounds as follows, to -wit:
BEGINNING at an iron pin 873.0 feet east
of and 20.0 feet south of the southwest
corner of the Original Town of Kennedale,
Texas;
THENCE north, passing the south line of
the Original Town of Kennedale at 20.0 feet
and continuing in all 711.0 feet to an iron
pin in the south right-of-way line of County
Road Project 2051;
THENCE north 60 deg. 09 min. east along said
south line of said County Road Project 2051,
69.0 feet to an iron pin;
THENCE south passing the south line of the
Original Town of Kennedale at 725.0 feet,
and continuing in all 745.0 feet to an iron
pin in a fence line;
THENCE west with said fence line 60.0 feet
to the place of beginning.
Attached hereto and incorporated by reference as
a part of this petition is a plat showing the location of
said Village Street on the Original Plat of the Original
Town of Kennedale, as well as the proposed change in location
as described in the aforesaid field notes.
As grounds for such change of location, petitioner
would show said Honorable City Council as follows:
1. Though dedicated and platted as a part of the
Original Town of Kennedale, said Village Street has never
actually been constructed or used by the public, and none
of the other streets shown in the plat and dedication of
the Original Town of Kennedale have been actually opened
and used by the public in the immediate proximity of said
Village Street.
2. The proposed relocation of said Village Street,
between the south line of the Original Town of Kennedale and
the south line of County Road Project 2051, as hereinabove
described and as shown on the plat attached hereto, coincides
with the actual location of a road which is in existence and
being used across said property, and the public convenience
will best be served by relocating said road in accordance
with the existing road therein use.
3. Petitioner John E. Hammack, together with
his brothers and sisters for whom he acts, are the only
owners of real property abutting either side of said Village
Street, either as originally dedicated or as herein described
for proposed relocation, so that the petitioners are the
only persons affected by said proposed change.
4. Petitioners hope, in the near future, to submit
to the City of Kennedale for approval a re -platting of the
property adjoining said Village Street, and any re -platting
will be based upon the herein proposed relocation of said
Village Street.
