O75-05CITY OF KENNE E ORDINANCE NO. 75-5 AN ORDINANCE CREATING THE OFFICE OF CITY INISTRATOR IN THE CITY OF NE i r.E, TEXAS, PROVIDING FOR HIS TENURE OF OFFICE, HIS HOURS, AND DUTIES. REAS, the City Council of the City of Kennedale, Texas, deems it to be in the best interest of the City of Kennedale, its citizens and in- habitants, that an Administr^.tive Assistant be employed by the City of Kennedale toassist,the Mayor and City Council in overseeing the City, its personnel and operation and now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TE SECTION ONE Creation of Office: The office of City Administrator is iie. �h;7 , eated. SECTION TWO Appointment of City Administrator: The City Administrator shall be appointed by majority vote of the City Council for an inde- finite sxexiiaExsxaedx ietldratbandcwinx a 'shall be chosen by the Council solely on the basis of his executive and administrative qual- ifications with special reference to his actual experience in or his knowledge of accepted practice in respect to the duties of his office hereinafter set forth. At the time of his appointment he need not be a resident of the City or the State. However, he will be required to be a resident of the City of Kennedale during his tenure of office. SECTION T1iRS4 R oval of City Administrator: The Council may a ovA the Administratpr fr.0 office in accordance with the following pro- cedures: (a) The Council shall adopt by affirmative vote of a majority of all its members a resolution to suspend or remove the Administrator from his office. A mere lack of confidence on the rart of the City Council shalt be sufficient for re- movais and it shall not he necessary specify any other reason for removal from office. (b) The City Administrator shall continue to receive his salary for two weeks after his being suspended or re- moved from office. The action of the Council in suspending or removing the Administrator shall not be subject to review by any court or agency. (c) The Mayor and any Council member shall have the right to reco rr end removal of the City Administrator, with specify- ing reason therefore, and upon such recommendation , in writing, the City Council shall vote thereon. The City Administrator shall be removed by majority vote on the City Council. SECTION FOUR Powers and Duties of the City Administrator: The Mayor shall remain the Chief Administrative Officer of the City, but the City Administrator shall be the next highest +.«inistrative Offiver of the City, perform- ing functions as delegated to him by the Mayor and City Council. He shall be responsible to the Mayor and City Council for the administra- tion of all City affairs placed in his charge, and under supervision of the Mayor and City Council shall do the following: (a) Appoint, and when he deems necessary for the good of the City, the suspension or removal of all officers and em- ployees of the City. (b) He shall direct and supervise the administration of all departments, offices and agencies of the City; except as otherwise provided by law or ordinances now in effect or here- inafter adopted. (c) He shall, attend all Council meetings, unless excused by the Mayor, and shall have the right to take part in discussion, but not a vote. (d) He shall see that all laws, ordinances and acts of the Council, subject to enforcement by him or by officers sub- ject to his direction and supervision, are faithfully ex- ecuted. (e) He shall prepare and submit the annual budget and capital program of the Council. (f) He shall submit to the Council a compote report on the finances and administrative activities of the City as of the end of each month and fiscal year. (g) He shall make such other reports as the Council may require concerning the operations of Ctty departments,offices and agencies subject to his direction and supervision, (h) He shall keep the Council fully advised as to the financial condition and future needs of the City and make such recommendations to the Council concerns::.r the affairs of the City as he deems desirable. (i) He shall supervise the purchase of all materials, supplies and equipment for which funds, are provided in the budget; provided, however, that he shall be l—nrned by procedures approved by the Mayor and/or City Council as to the nature and ount of such purchases that shall be made with or without bids. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds $1,000 without approval, by the Council. He shall perform such other duties as may be required by the Council. SECTION FIVE Emergencies: In case of accident, disaster, orother circum- staneecreating a public emergency, the City Manager may award contracts and make purchases for the purpose of meeting +sai.d emergency; but he shall file promptly with the Council a certificate showing such-«ergency and the necessity for such action, together with an itemized account of all expenditures. Bond: SECTION SIX The City Administrator shall furnish a surety bond to be approved by the City Council, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the City. SECTION EVEN Coca ensation: The City Administrator shall receive such com- pensation as the City Council shall fix from time to time by ordinance or resolution, SECTION EIGHT Vacancy: Any vacancy in the office of the City Administrator shall be filled at the will and pleasure of the Mayor and City Council, but no vacancy in said office shall require the appoint- ment of a City Administrator until such time as the Mayor and City Council shall elect to do so. SECTION N Savings Clause: If any section, subsection, or sentence, clause or phrase of this ordinance is for any reason held invalid by a court or competent jurisdiction, such decision or decisions shall not affect the validity of the remaining portions of this ordinance. All ordinances of the city prescribing the duties of heads of departments shall remain in full force and effect cept in so far as they conflict with the provisions of this or- dinance in which the case the provisions of this ordinance shall govern.
