AN ORDINANCE OF THE CITY OF KENNEDALE, REPEALING
SECTION 5 OF ORDINANCE NO. 178; CONFIRMING AND
READOPTING THE ASSESSMENT AND COLLECTION OF THE
MUNICIPAL COURT TECHNOLOGY FUND FEE; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
NROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Kennedale, Texas is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Local Government Code; and
WHEREAS, the City of Kennedale, Texas has previously adopted a Municipal Court
Technology Fund; and
WHEREAS, Ordinance No. 178, sets forth specific municipal court fees as authorized
by State law; and
WHEREAS, it is important to amend and update the miscellaneous municipal court fees
in order to reflect changes in State law; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF KENNEDALE, TEXAS:
SECTION 1.
That Ordinance No. 178 is hereby amended by repealing Section 5 thereof.
SECTION 2.
l'he Municipal Court Technology Fund heretofore adopted and set forth in Section 14-6
of the Kennedale City Code is confirmed and re-adopted and the fees set forth in that section
shall continue to be assessed and collected. Any funds in the Municipal Court Technology Fund
pursuant to Ordinance No. 178 shall continue to be used and administered as required by that
ordinance.
SECTION 3.
-Phis Ordinance shall be cumulative of all other ordinances of the City of Kennedale, and
shall not repeal any of the provision of such ordinances except in those instances when

provisions of such ordinances are in direct conflict with the provisions of this ordinance, in
which the event the conflicting provisions of such ordinances are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
•j udgme~It or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 5.
I~his ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Kennedale,
