R218 RESOLUTION NO. 218 A RESOLUTION OF THE CITY OF KENNEDALE ADOPTING A POLICY ESTABLISHING THE TIME PERIOD FOR WHICH CONFLICTS DISCLOSURE STATEMENTS AND CONFLICT OF INTEREST QUESTIONNAIRES REQUIRED BY CHAPTER 176 OF THE LOCAL GOVERNMENT CODE SHALL BE POSTED TO THE CITY'S INTERNET WEBSITE. WHEREAS, Chapter 176 of the Texas Local Government Code (Chapter 176) requires each municipal officer to file a conflicts disclosure statement with the City disclosing the officer's business relationships with certain individuals; and WHEREAS, Chapter 176 also requires each person who contracts or seeks to contract with the City for the purchase of property, goods, or services to file with the City a conflict of interest questionnaire disclosing certain affiliations and business relationships with persons associated with the City; and WHEREAS, Chapter 176 requires the City to post on its internet website the disclosure statements and conflict of interest questionnaires required by Chapter 176 to be filed with the City; and WHEREAS, because Section 176.009 does not establish the time period for which conflicts disclosure statements and conflict of interest questionnaires must be available on the City's internet website, the City Council desires to adopt a policy establishing a reasonable and appropriate posting period for these documents; and WHEREAS, the City Council has determined that the time periods established by the Policy set forth below will effectuate the purposes of Chapter 176 in providing the public with access to information about potential conflicts of interest for a sufficient duration, but will not overburden the City's internet website or technical staff by requiring the posting of information that is no longer useful. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS THAT: SECTION 1. The declarations, determinations and findings made in the preamble to this Resolution are hereby adopted and made a part of the operative provisions hereof. SECTION 2. The City hereby adopts the following policy for the availability on its internet website of the conflicts disclosure statements and conflict of interest questionnaires required by Chapter 176 of the Texas Local Government Code: Page 1 r~ (a) A conflicts disclosure statement filed with the City by a City officer as required by Section 176.003 of the Local Government Code shall be made available on the City's Internet website as soon as reasonably practicable after filing, and shall remain available until the City officer ceases to be an officer of the City. (b) A conflict of interest questionnaire filed with the City by a person as required by Section 176.006 of the Local Government Code shall be made available on the City's Internet website as soon as reasonably practicable after filing, and shall remain available until termination of the person's contract with the City or, if no contract is formed, until the City determines that no contract will be formed. SECTION 3. This resolution shall become effective upon passage.
