EXECUTIVE SESSION – PRE-COUNCIL CHAMBERS – 4:30 PM WORK SESSION – COUNCIL CHAMBERS – 5:30 PM REGULAR SESSION – COUNCIL CHAMBERS – 7:00 PM CALL TO ORDER ROLL CALL I. RECESS TO EXECUTIVE SESSION – 4:30 PM 1. The City Council will meet in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meetings Act, including discussion on any item posted on the agenda and legal issues regarding amortization of nonconforming uses; reconstruction of Dick Price Road; regulation of sexually oriented businesses; and litigation, settlement offers, and/or claims regarding the following matters: a. H&A Land Corporation, d/b/a Showtime Cabaret v. City of Kennedale; Cause No. 402-CV- 0458-Y b. Jerry Coyel v. City of Kennedale, Cause No. 236-193444-02 c. Reliable Consultants, Inc., etal v. City of Kennedale; Cause No. 4:05-CV-166-A d. H&A Land Corporation, d/b/a/ Showtime Cabaret v. City of Kennedale; Cause No. 4:05- CV-210-Y. e. Cities of Allen, et.al. v. The Railroad Commission of Texas, Cause No. D-1-GV-05-522. 2. The City Council will meet in closed session pursuant to Section 551.072 of the Texas Government Code (Acquisition of Real Property) to deliberate the purchase, exchange, lease, or value of real property. II. RECONVENE FOR OPEN MEETING WORK SESSION – 5:30 PM 1. Discussion on Independent Auditor’s Report for year ended September 30, 2005. 2. Discussion on Comprehensive Land Use Plan. 3. Discussion on City Building and Fire Codes. 4. Discussion on Highway 287 Overlay District. 5. Discussion on any other item on the agenda, if needed. III. RECONVENE INTO REGULAR SESSION – 7:00 PM IV. INVOCATION AND PLEDGE OF ALLEGIANCE V. TAKE ACTION NECESSARY PURSUANT TO EXECUTIVE SESSION. AGENDAPAGE 2 KENNEDALE CITY COUNCIL FEBRUARY 9, 2006 VI. PRESENTATIONS 1. Councilmember Green and Constable Clint C. Burgess will award the American Disaster Response Ribbon to those employees who volunteered their time in the wake of Hurricane Katrina. 2. Introduction by Captain Hull of newly hired/promoted Police Officers, Pinning by Chief Raven, and Ceremonial Oath of Office given by Mayor Norwood. VII. PUBLIC HEARINGS 1. To receive citizens comments regarding an ordinance amending Chapter 17 of the Kennedale City Code (1991), as amended, by revising subdivision design criteria standards governing the maximum length of a cul-de-sac street. 2. To receive citizens comments regarding an ordinance updating the Comprehensive Land Use Plan for the City of Kennedale by amending the former plan in its entirety. VIII. CONSENT AGENDA These following items are considered to be routine and self-explanatory by the Council and will be enacted with one motion. There will be no separate discussion of these items unless a Councilmember requests that an item be removed from the Consent Agenda and be considered, in sequence, as a routine agenda item. 1. Consider approval of minutes: regular meeting dated January 12, 2006. 2. Consider approval of Ordinance No. 325, amending water/sewer ordinance. 3. Consider approval of Independent Auditor’s Report for year ended September 30, 2005. IX. REGULAR ITEMS 4. Consider approval of Ordinance No. 326, amending Chapter 17 of the Kennedale City Code (1991), as amended, by revising subdivision design criteria standards governing the maximum length of a cul-de-sac street. 5. Consider approval of Ordinance No. 327, updating the Comprehensive Land Use Plan for the City of Kennedale by amending the former plan in its entirety. X. VISITOR/CITIZENS FORUM At this time, any person with business before the Council not scheduled on the agenda may speak to the Council. No formal action can be taken on these items at this meeting.
