02.13.1969 CC Minutes445 RDGULAR MEETING OF THE KENNEDALE CITY O~UNCIL FBB. ls, 1969 Mayor Webb assembled the meeting at 7140 P.M. Council members present were W. C. Kirkpatrick, Don Lyon, J. H. Martin, and H. L. Hatton. Charles Knotts .being the only absentee. The minutes from the previous meeting were read and approved. Mrs. Stevens who owns 18 acres on the Kennedale Little School Road came before the council ind asked why she was prohibited of having topsoil hauled from her place. Mr. Lyon explained that was zoned one family dwelling and he consulted our City Attorney and was advised since it was a one family dwelling, couldn't be used as commercial. That she could 1 evel the land and build if she so desired. Mrs Mott, who waa an interested pasty present, then informed the Council there were two large holes and also the bar ditch needed cleaning out; if the City could make her cover the ho_1es and clan the bar ditch. Mayor Webb advised her, didn't think the City could do anything in regs~t~d to the large holes, but they would see about the bar ditch. r Mr. Gillam with Bill Heater came before the Council, wanting to move a house to 605 Bowman Springs Road, stating Pete had inspected the honer and advised them it didn't have the required floor space, stating they would have to have 1250 ~. feet. Mayor Webb advised then, the Cbnncil couldn't give them permission without going through the Planning Board. Mr. Norwood tCiett came before the Oouncil asking permission to move a mobil e home on his property in the Wood survey stating it was real nice, .two bed room and two baths. Mayos Webb suggested he and any of the other Council that wanted to go with him, go look at it and advise him. Mr. Presson, who had received a traffic citation, appeared before the Council in regard to the misconduct of the Chief of Police, stating he had made threats against him and had a grudge against him. Mr. Lyon advised him, he didn't have any worry of the Chief doing any harm to him. Mayor Webb advised ilr. Presson, he would talk with the Chief. Mr. Rosenberry came before the Council, complaining about not having any signs or reflector at the retainer wall, stating his wife had a car accident on February 30, 1969. The Oouncil advised him the retainer wall. belonged to the school and was on school property, the City was not responsibl e. Charles Jordon came before the Oouncil, asking permission to build a bldg. on East Mansfield Highway, stating he had 3-acres of land, and was going out of the wrecking yard business, the bldg. would be 40 X 60, would have a ten foot solid board fenc¢ and ~ner cars would be visible. Mr. Hatton made motion to grant him permission, stipulating he would give ns a written notorized state- ment verifying he would have the fence and finish the bldg. within 90 days. In 12 months to remove all wrecked cars and no burning. Mr. Jordon is to use the bldg. as n~Ew and used car parts. Mr.'IIyon 2nd motion, motion carried unanimously. Mr. Daniel whose wife is charge night nurse at the nursing home frog it P.M. to 7s00 A.M. complained of some one peeping in the windows and turning the door knobs and disturbing the patients, wanted to know if the City could do something about it. Mr. Lyon suggested to take this matter up with the owners and perhaps if they would have a night watchman fora while, this might help the situation. 446 Regular Meeting Minutes Cont. ' Chief Halverson asked the Council their opinion of a pzevious letter he had written then in regard of° biting a clerk anti af~other patroluan. Mr. Martin' Wade emotion to hire the clezk and Mr. Kirkpatrick 2nd°motion, motion carried unaninc-usly. Mayor Webb asked the Oouncil what they desired to do about paying the Volun- teer Fire Ina. Mr. Lyon made motion City pay the insurance. Mr. Kirkpatrick 2nd lotion, motion carried unanimously. Mr. Hatton wade motion to approve Royal D erden as Fire Marshall, Mr. Martin ` 2nd motion, motion carried unanimously. Mr. Marshall read Resolution 69.1, calling a Municipal Blection for tht pur• pale of electing 3 councilman for a two year term. Mr. Lyon made motion to adopt Resolution 69-1.
