REGULAR MEETING OF THE KENNEDALE CITY COUNCIL
Dec. 9, 1971
Meeting opened at 7:35 P. M. by Mayor Martin.
Council members present were John J. Biondi, Jr., Bill Bishop and B. J. Watson,
with Inez Kefthley and Marshall Tyson being absent. '
Due to the City Secretary being sick, the reading of the previous minutes was
dismissed.
Lloyd Hatton advised the Council that square dancing 1 essons were being given at
the Community Center every week. The instructor giving the lessons charges each
person; therefore, making it a commercial business and was not paying a rental fee
for the bldg.
Mr. Hatton advised he gave many hours of his time free of charge -to the young people,
and would like to use the center again on Monday, Tuesday and Wednesday night.
Wanted to see something done about individuals who use the center free of charge,
them use it for commercial purposes. Mr. Biondi made motion that from now on any
time the center is to be used free of charge, should come before the City Council,
2nd by btr. Bishop; carried unanimously.
J. D. Anderson, who is outside the city limits, came before the Council requesting
2 more water taps.
Mr. Bishop stated that all land should be in the city limits before furnished with
water. Mr. Watson feeling the line must be drawn somewhere made a motion the re-
quest be denied unless annexed. Then further discussion - all people outside city
limits with city water should be annexed. Mr. Watson reminded them of his previous
motion, 2nd by Mr. Bishop; carried unanimously. Mr. Biondi then suggested if the
houses and lots were annexed, Mr. Anderson could be furnished with water. Mr.
Anderson being agreeable, he was advised by Mayor Martin to draw a plat, mailing
this with his legal description to the City Attorney, Mr. Marshall. Mr. Marshall
would then proceed with the annexation.
Mr. Marshall presented Resolution 71-9, summary form of Ordinance 7I-11. After it
was studied by the council, Mr. Biondi made motion to except the resolution, 2nd by
Mr. Watson; carried unanimously.
Mr. Biondi read Ordinance 71-10, appo9nting Myra Burke assistant city secretary.
Mr. Watson made motion to adopt 71-10, 2nd by Mr. 3ishop; carried unanimously.
Ordinance 71-12, canvassing the bond election, was presented. Mr. Watson made
motion to adopt 71-I2, 2nd by Mr. Bishop; carried unanimously.
The next two parties on the agenda, Tommy Smith and Mrs. J. D. Pope, were not
present.
Mr. Marshall advised the Council that Jerry Upchurch was suei_ng Mr. Reed, with
Mr. Reed cross filing against Mr. Upchurch and the City.
Mayor Martin gave Mr. Marshall the facts involving the prior accident between the
Kennedale Police wept. and P9r. Reed.
Mayor Martin asked the Council if they would like to skip the regular meeting
of the City Council on December 23, 1971. The decision was to cancel the meeting.
Mayor Martin asked if the city hall employees could close on Monday following
Christmas and New Years day. After discussion, Mr. Watson made motion to close
the Friday prior to Christmas and New Years day, 2nd by Mr. Biondi; carried
unanimously.

Mayor Martin presented applications to hire new employee for the water department.
The new employee would be working for the County, with the City doing the hiring
and firing.
The County would pay the salary; the city the social security, medical insurance
and 61 to the County Retirement Fund - amounting to $65.00 per month.
Mr. Watson made motion to accept the application of Danny Bomar, 2nd by Mr. Biondi;
carried unanimously.
Mayor Martin reminded the City Council that at the last council meeting, he
advised them that he had met with the County Commissioners. The asked each city
to pass a resolution that the city would maintain all its streets, and the county
would buy right-of-way to build throughfares.
Also the County would buy four locations for waste disposal; would be operated
by the County, with cities paying fees for dumping. Would be 3 to 5 years before
these projects are began.
Mayor N,artin stated that we had not passed a resolution, while many other cities
had.
Mayor Martin presented a written proposal from Karl Halverson with 5 questions
in reference to the Police Department.
#1 Will the police officers be given their $2.OG a week uniform allowance the
31st day of December 1971?
Mr. Watson made motion to pay the ~$2.Ot9 per week per officer, 2nd by Mr.
' Bishop, carried unanimously. The officer must be employed 6 months before
he can receive the allowance, and will be paid lst of January and July.
#2 Difference between front office and the Police Dept. We take a day off
sick and we lose a days pay. Does this also apply to the front office?
Mayor Martin advised the Council of the present sick leave plan, 2 weeks
full pay and 2 weeks half pay. It was suggested that the present plan apply
to all departments. Also Mr. Watson recommended that 3 days absence because
of sickness, must bring statement from doctor.
#3 Recommend that all violations of City Ordinances such as:
a. Sewer
b. Buildings
c. .Junk in yards
come under the Building Supt. or Water and Street Dept.
Mr. Watson xecommended that "a" be taken care of by Norman Burris, with "b"
and "c" remaining under Karl Halverson.
#4 Received information that we are running a speed trap. we have never run
a speed trap in Kennedale.
According to the monthly police report 200 tickets were given in less than 30
days, from this the Council did not believe operating a speed trap.
#5 Is it possible to raise Police Dept. personnel 5%?
Mr. Watson made motion to leave salaries as were, discuss at a later date, 2nd
by Mr. Bishop; carried unanimously.
Mayor Martin advised the Council we had received letters from the state comptroler
asking if we would like to join with them against two businesses in the city limits
with delinquent tax. Mr. Watson thought we should wait to see what the state did
about it, would be more of an expense to the City than tax due. Mayor Martin
thought that the State would probably collect the tax for the City. Mr. Marshall
was asked. to write the state and inquire.

Mr. Bishop inquired about the municipal charge due the City by Avalon Mobile
Home Club and South 287 Trailer Park. He was advised it had not been paid;
Mr. Marshall said to collect we would have to file suit or refuse to renew
their permits in January, 1972.
Mayor Martin presented written requisition from Karl Halverson requesting certain
`equipment since the front offices were being locked at night. Mr. Watson siad if
Chief';s actions continued, he would make a motion he be dismissed. Motion died
for lack of 2nd.
Mr. Watson recommended have a key made giving the Police Department excess to the
drinking fountain and men's restroom. But it was decided by the council that the
offices would continue locked under the present system.
Motion to adjourn made by Mr. Watson, 2nd by Mr. Bishop. Meeting adjourned at
