02.11.1971 CC Minutes509 REGULAR MEETING OF THE KENNEDALE CITY OOUNCIL FEB. L1, 1971 Mayor Platt assembled the meeting at 7:40 P. M. Council memb ers present were Homer Jenkins, John J. Biondi, Jr., A. L. Bulin, J. H. Martin and Charles Knotts. The minutes from the previous meeting were read and approved. Cecil Hodge appeared before the Council, asking their decision of the Boy Scouts, Rangers and Troop 235 picking up trash in the City. Mr. Marshall advised them there would be no legal involvement. Mr. Knotts made motion to pay them $2.00 per 55 gallon barrel, Mr. Martin 2nd motion, motion carried unanimously. Mayor Platt advised him would not be a limit of how many barrels, but come by the office and cold ect each Monday. Mrs. Jordon from Jordon Butane Gas Co. came before the Council, saying Jack Allen who lives in one of her trailers was stopped by the Police Dept. They asked him to come to the Police Offfce, wanted to check him out and when he arrived, they fined him $50.00 for DIP #3, wanted to know if he was drunk, why would they let him drive his car back to the station and release him in two hours, saying the policemen talked terrible to him, and refused to let him call a lawyer. He paid the $50.00 fine, plus $15.00 for wL'ecker fee. Mayor Platt advised her would have a discussion on this matter and see what they oould find out. Royal Derden came before the Council, saying they had elected him Fire Chief and thought we needed more harmony between the Fire Dept. and City; also was experi- encing difficulty in answering the fire phone, suggested who ever answers the phone to leave the line open--- for a few minutes until someone from the Fire Dept. is advised the lacation of the fire. And all they wanted the Police to do is direct traffic; the Fire Dept. would do the fighting of the fires. He asked the Council to make some revision in Ordinance 68-4, he was under the impression the city Council appointed the Fire Chief and Fire Marshall; he was advised the Fire Dept. appointed or elected them with the approval of the City Council. Mr. Bulin made motion to approve Mr. D erden as Fire Chief and Tommy Lowery as Fire Marshall, Mr. Martin 2nd, motion carried unanimously. He then recommended the City give the Fire Dept. and opportunity of assuming payments on the t~osmunity Center and take it over, said it would still be used as a Community Center. He was advised the City couldn't sell the Community Center since it is owned and operated by the City. Mayor Platt read letter from Freese and Nichols in reference of the one bid they had received from Ruff Construction of Dallas for $10,000 storage tank and foun- dation and pipe in the amount of $41,977.00. They recommended reject this bid, and re-advertise for the stvrsge~~tank and for the foundation and pipe. Mr. Biondi made motion to reject this bid, Mr. Jenkins 2nd motion, motion carried unanimously. Mr. Bulin made motion re-advertise for the tank and a bid for the foundation and pipe separately, Mr. Biondi 2nd motion, motion carried unanimously. Mr. John Plumlee and several citizens from Turner Acres were present and said they had a real serious sewer problem that needed to be taken care of. Said they had been before the Council several times and never gotten any promises and satisfaction. Mayor Platt recommended since we were having a total re-valuation on all prmperty and when we received the new valuation which would be completed June 31st would see what could be done. Mr. Jenkins made motion to have our engineer at the earliest date possible and give us figures of the cost. Mr. Knotts 2nd motion, r motion carried unanimously. Mr. Marshall read Ordinance 70-13 amending Ordinance 20 on Fire Works. Mr. Biondi made motion and Fnd by Mr. Martin to adopt Ordinance 70-13; motion carried unanimously. Mr. Marshall read Resolution 70-1 Calling for a Municipal 510 Min. cont. Feb. 11, 1971, Election to elect 3 councilmen for a 2 year term.. Mr. Knotts made motion to adopt Resolution 70-1, 2nd by Mr. Biondi; motion carried unanimously. The Chief of Police asked the Council if they had any question in regard to the complaint Mrs.. Jordan had made, saying part of it was true and part not true. The Chief said Jack Allen did not drive his car back to the police station. Mayor Platt said several months ago, he was appointed to b e responsi- ble for the Police Dept., as he w®rked every day and was out of town a day or two each week. The question then arose of charge account at Buddies and Conoco Filling Station. Mr. Bolin made motion if the Chief can't do what the Mayor tells him to do, then the Mayor asked for his resignation with the approval of the Council. Mr. Knotts 2nd motion, Mr. Jenkins abstained from voting, 4 for, motion carried. The Council then agreed to not have any more charge accounts with Buddies and Conoco, Mayor Platt said he would notify Buddies of the decision and asked the Secretary to notify the Conoco, this being effective as of tonight. Pete Kirkpatrick informed the Council the old tractor had a cracked block; he had taken it to Pat Patterson for repairs and was given a figure of $671.55 for the repairs, saying the tractor wasn't worth that much, Mayor Platt advised Pete to shop around and see what trade he could get on a new or used tractor. Mr. Webb advised the Council the access libility on the police car would be due on the 19th of this month. Mr. Biondi made motion to buy this access libility, 2nd by Mr. Martin, motion carried unanimously. Mr. Knotts made motion to adjourn, 2nd by Mr. Bolin, meeting adjourned at 11 :15 P. M.
