Mayor Martin assemnled the meeting st 7:35 P, M. Council members present were Mrs.
Inez Keithley, John J, Biondi Jr, Marshall Tyson, Bill. Bishop, Mr, Watson being the
only absentee.
After a correction of the minutes, inserting Bill Bishop voted against the motion made
and 2nd net to read the letter the City Attorney had sent to the councilmen and Mayor,
Mr, Bishop made motion to approve the minutes 2nd by Mrs. Keithley.
Mr, Marshall asked the minutes show a public hearing was held of the annexation of
a. portion of Mr. Anderson's property in Gay Daughters.
Mr. Marshall advised the Council he had received a letter from Jack Ray, Attorney for
Pincher Bros, stating they would not remove any more soil within the City limits, but
would be hauling sand out side of the City limits and asked the case be dismissed.
Mr. Tyson recommended leave the suit pending and if they have no other exit and use our
City streets would cover the sand with tarp, Mr, Marshall said he would contact Mr.
Ray and let the Council know at their next meeting.
Mr, Marshall then informed the Council he had reveived another letter from the insurance
Co. in reference to Jerry Wayne Upchurch, they again refused to defend. Mr. Marshall
had advised the Insurance Co., Mr, Webb their agency had a notice of the accident at
the time. The Insurance Co. contends it doesn't constitute a notice to them. Mr.
Marshall if they didn't defend, would sue on the policy after the suit is over,
Mr. Tyson advised the Council, Ida Flake had contacted him and asked for two pole
watchers at the up- coming election. The Council agreed to grant this request.
Mr, Tyson made motion to adjourn, 2nd by Mr, Biondi, meeting adjouned at 8:05 P. M.
