08.09.1973 CC Minutes596 REGULAR MEETING OF THE KENNEDALE CITY COUNCIL & PUBLIC ZONING HEARING AUGUST 9. 1973 Mayor Childres assembled the meeting at 7s45 P.M. Bro. Ron Bearden gave the invocation. Roll was called. Council members present were George Lowery, Steve Radakovich, Mayor Childres, Stanley Jernigan, Bill Bishop and Lloyd Blanscet. The minutes of the previous meeting were read and approved as read. Mrs. Peterman came before the council concerning a drainage problem that she has. She said the water comes across her yard and is damaging the foundation of her house. Mayor Childres advised her that Mr. Godfrey said he would look at her property and see what could be done. Mayor Childres said he would get with the county and see what they will do. Mrs. Peterman agreed to this. Joe McKinley came before the council concerning Mr. Britts property. He said the grass is higher than his head on some of the property and is a fire hazard. He said the mosquitoes are very bad down there and they have killed several snakes. He said Mr. Britt has torn the old house down and scattered it all over the place. Mayor Childres asked if a letter had been written to Mr. Britt concerning this. Mrs. Templeton told him she thought a letter had been written. Mayor Childres informed him that he would call Mr. Britt tomorrow. Mr. McKinley agreed to this. Mr. Paul Mathis gave report on planning meeting, July 5. 1973. and read the minutes. Mayor Childres declared this portion of the meeting to be a public hearing to discuss the re-zoning of Tract 2A & 2B in the Franklin Wood Survey from A to G. Matthew Blair came before the council, in the absence of his father Dr. Leon Blair, to object to the zoning change. Dr. Blair's property adjoins the property to be re-zoned. He read a letter that his father had written. Mr, Mathis pointed out o~ the map the property Dr. Blair owns. Dr, Blair's main objection was the lack of proper sewage. Mr. Radakovich asked. Mr, Blair if there would be any objection to the re-zoning; if the sewage problem were corrected, Mr. Blair said there would :got. Mr, Radakovich informed him that if his father would. come down and file a complaint we would look .into the littering and. car body s~tuati..on that he mentioned, Mr. Radakovich made a motion to approve the zoning change that had been made and approved in 1969 but no action had been taken on it. Mr. John Biondi asked if we were talking about re-zoning from A to Commercial or Industrial. He was in- formed that it was Industrial. Mr. Radakovich again made motion to approve the zoning change and Mr. Jernigan seconded the motion. Mayor Childres recessed the public hearing for check of 1969 minutes concerning re-zoning. Bill Arber asked that his part of the meeting be deffered until another meeting. The council agreed. Mr. Halverson presented to the council the changes he thought necessary concerning the speed limits and stop signs. After brief discussion, Mayor Childres main- tained a motion that Mr. Marshall prepare the proper ordinance. !~~. Lowery made the motion and Mr. Bishop seconded it. The motion carried unanimously. Kenneth Pearce came before the council stating that a wrecker permit had been issued that did not comply with the ordinance, Mayor Childres advised him that the ordinance would be studied and reported on at the next meeting. Mayor Childres asked Mr, Arber about the permit forms needed, and Mr. Arber ad- vised changes would be needed and should be corrected. Mayor Childres advised the council that the Pentecostal Church still wants to use the Community Center. The council agreed to let them continue on a temporary basis. Mayor Childres asked Mr. Lowery to report on the land that Mr. Johnson has. Mr. Lowery said the land looked like it would take care of our needs, and that Mr, Johnson said he would give us a three (3) year lease. Mr. Mathis gave the report of his meeting with the County concerning the land fill. He and Mr. Graham met with Mr. Johnson. They looked at the land saying it had not been properly handled. He said. a permit would not be issued. to use land that had already been filled. (over) S97 Mr. Mathis gave report on the school he attended in Denton. The Public hearing begins again at this point. Mr. Ra.dakovich makes a motion to adopt Ordinance 73-?, seconded by Mr. Jernigan. Mr. Biondi interupts and said he wa~a s it put into the records that "I, John Biondi, was here this night in behalf of the previous Counc;~l, myself and the Mayor to say that if you can't f°:d the ev'dence how can you sit there and act on it." Mayor Childres said we would find the records, and. that he had read them. Mayor Childres asked for a vote on the adoption of Ordinance 73-7. All voted to adopt this Ordinance which changed the Zoning of the property in quistion from A residential to G Industrial. Bill Arber asked that a special meeting be set up for work session on Bldg. codes. The meeting was set for August 16, at 7:30 P.M. Mayor Childres entertained motion to adjourn, Mr. Lowery made the motion to adjourn, seconded by Mr. Bishop. Meeting adjourned at 9:40 P.M. Approved ~""`~ T.
