12.11.1975 CC MinutesPage 1 of 2 REGULAR MEETING OF THE KENNEDALE CITY COUNCIL December 11, 1975 ~5~ Mayor Childres assembled the meeting at 735 P.M. Pat Turner gave the invocation. Members present were George Lowery, Steve Radakovich, Mayor Childres, Stanley Jernigan, Bill Bishop and Pat Turner. The minutes of the previous meeting were read and approved as read. Mr. J~ R~ Walden came to discuss the letter he had received concerning the 1957 Chevrolet and 1950 Model Plymouth he has in his yard. He said he does not consider these to be junked vehicles. The 1957 Chevrolet belongs to his son, who is in service. The 1950 Plymouth is Mr. Waldens, which he plans to restore. He said he could not get the cars out of sight. Mr. Turner made a motion to grant Mr. Walden thirty (30) days to do something about the cars. Mr. Jernigan seconded the motion. The motion carried unanimously. Mrs. Irene McDavid asked the council to allow her to operate a sewing shop in the building at 230 W, Mansfield Highway. Mr. Yates advised the council that the building does not have water, sexer, or a driveway. Mrs. McD~,vid said she just wanted a place away from the telephone to sew. Mayor Childres recommended that she be granted a sjx (6) month temporary hardship permit. Mr. Bishop made the motion, seconded by Mr. Lowery. The motion carried unanimously. Mrs. Nancy Esters presented the rules for the Bicentennial City Seal Contest, The rules state that anyone interested in Kennedale can enter the contest. Mr. Jernigan read the list of rules. Mr. Yates said the City would give $100.00 to the winner. Mr. Jernigan made a motion to accept these rules and. that the City will accept the responsibility to advertise this in the Local newspaper every week until the contest deadline. Mr. Turner seconded the motion, The motion carried. unanimously. The Judges will be named at a later date, The council discussed whether to seek funds for a City Traffic sign grant. Mr. Turner made a motion to adopt Resolution # 75-13, authorizing Mr. Yates to request grant assistance for traffic signs for Kennedale. Mr. Bishop seconded the motion. The motion carried unanimously. Mr. Bishop asked why plastic pipe cannot be used when all other cities use it. Mayor Childres suggested that this item be shelved until Mr. Yates could find out more about this. Mr. Marshall presented the Tax Ordinance. Mr. Lowery made a motion to adopt Tax Ordinance # 75-9, seconded by Mr. Bishop. The motion carried unanimously. Mr. Yates asked that the council wait on the appointing of a planning and Zoning board member. Mr. Jernigan made a motion to appoint Frankie Luttrell, Robert Patterson, Joel Murphy, instead of Ken Elmore who was named in the minutes of the November 13 meeting in error, Verlin Arter, Mrs. Irene McDavid to serve as Park Board members and that Mr. Stephen Love serve as a non-voting advisory member since he lives outside the city limits of Kennedale. Mr. Turner seconded the motion. The. motion carried unanimously. 655 Page 2 of 2 Regular Meeting, December 11, 1975, continued Mr. Yates asked that a work day for the Park be scheduled for Saturday, January 10, 1976. Mayor Childres suggested that Jack and Stan get the Park Board committee together and determine if this would be possible. Mr. Marshall asked if the council wanted him to proceed with the annexation of Wayne Winters property. The council discussed the outside city limit water taps. Mr. Turner made a recommendation to allow some flexibility for property that could be annexed when the Arlington Suit is settled. Mayor Childres suggested that he let his recommendation ride until later. Mayor Childres said that if Mr. Marshall felt we shouldn't go ahead with the annexation of Wayne Winters property until after the courts decision, then we would wait. Mr. Yates asked the council to determine the permit fees for Public build- ings and. what buildings would. be considered "Public Buildings." The council determined that Schools and Churches would not be charged. permit fees, but would have to comply w~.th the inspections and codes of the city. Mr. Yates gave the council a review of all the insurance coverage of the City, The Mayor said for the council to read the review and conseder this later. Mr. Yates said this would be considered in the preparation of the next budget. Mr. Yates presented a proposed ordinance consolidating several water ordinances and the changes he had made. After a thorough discussion, Mr. Jernigan made a motion to accept Ordinance # 75-10, as re-written, to be effective January 1, 1976. Mr. Lowery seconded the motion. The motion carried unanimously. Mayor Childres suggested that we hold the consideration of the sewer ordinance until the next meeting. The departmental reports were given. This included the garbage rates. The twenty cent charge the city has been receiving was discussed. Mr. Haley's contract gives him a new rate of $2.80 per residential pick-up. The city does the collecting and all clerical work on his accounts. The garbage fee would have to be $3.00 per month for residential customers in order for the city to receive its twenty cents (20¢) per customer. Mr. Lowery made a motion to raise the garbage rates to $3.00 per month, effective January 1, 1976, for residential customers, seconded by Mr. Bishop. The motion carried unanimously. Mr. Yates asked for the day after Christmas off, to be designated as a swing holiday or a day to be made up. Mr. Turner made a motion to designate the day after Christmas as a Holiday for the City Employees this year only. Mr. Lowery seconded the motion, Mr, Lowery, Mr. Jernigan, Mr. Bishop and Mr, Turner voted yes, Mr. Radakovich voted no. The motion carried. Mr, Bobby Roberts came to complain about the ticket his wife received for burning trash, He was advised that the ordinance had been published in the paper several. times, Mayor Childres said we would. re-run the ordinance in the paper. Mr. Puny Warren. advised the council that he had received a letter about his junked cars, and also a ticket. The council asked Jack to check into the ticket, since he had removed his cars.
