REGULAR MEETING OF THE KENNEDALE CITY COUNCIL
MARCH 10, 1977
Mayor Radakovich assembled the meeting at 7:30 P.M. Council members
present were George Lowery, Clara Sanderson, Stanley Jernigan, Bill
Bishop and Pat Turner. Pat Turner gave the invocation.
The minutes of the Regular meeting, February 10, 1977, were approved
with no corrections.
Item # 1. Consideration of the house moving ordinance was postponed
until Mr. Marshall arrived.
Item # 2. Consideration of Resolution authorizing purchase of high
speed teletype. Mayor Radakovich presented the proposal for the
system as shown in the packet. Stanley Jernigan asked if the increased
income would offset the cost. The council discussed this at length
and noted that it would not be a money making thing but would save
time thus making for a more efficient operation. This item was
postponed for a special meeting.
The house moving ordinance was discussed next since Mr. Marshall had
arrived. Mr. Marshall said he had dictated the ordinance but his
secretary dial not have it typed. Pat Turner said he thought we had
been long enough preparing this ordinance, and he felt we should have
acted on it tonight. Mr. Marshall said they could act on the copy
that was prepared in the worksession. Pat Turner made a motion to
adopt ordinance No. 77-6 according to the notes for house moving pre-
pared in the special worksession. George Lowery seconded the motion.
The motion carried with none opposed.
Mayor Radakovich explained item # 3 to the council concerning the
dedication of Right of Way in Tract 31, West of Village Creek in
the David Strickland Survey. Mayor Radakovich read a letter from
Texas Electric Service Company pertaining to the verbal agreement
between himself and Jerry Foreman for the city to build a concrete
retainer wall in front of the one leg of the one tower that would
be within four feet of the Right of Way. George Lowery made a motion
to accept the Right of Way dedication in Tract 31 and to adopt Re-
solution No. 77-3 agreeing to construct a concrete barrier to protect
the Texas Electric tower located within four feet of the proposed
Right of Way. Bill Bishop seconded the motion. The motion carried
with none opposed. Mayor Radakovich advised the council that he
had talked with Dick Anderson, Commissioner of Precint 1 about
constructing this road. He is to meet with him and work out the
details.
Mayor Radakovich read proposed ordinance No. 77-7 declaring Nuisance
property and providing for disposition. Pat Turner made a motion to
adopt ordinance No. 77-7- seconded by Stanley Jernigan. The motion
carried with none opposed.
Mayor Radakovich read proposed resolution No. 77-4 declaring surplus
and nuisance property and providing for sale. Bill Bishop made a
motion to adopt resolution No. 77-4, seconded by Clara Sanderson

The motion carried with none apposed.
Jack Yates advised the council that he would publish a notice of the
Public Auction, to be held March 19. 1977. in the newspaper.
George Lowery made a motion to accept the dedication of the extension
of Bowles Ct. by Mr. and Mrs. James A~ Arthur and to have Clyde Marshall
record this dedication. Stanley Jernigan seconded the motion. The
motion carried with none opposed.
Bill Bishop made a motion to declare specific utility accounts as
uncollectable in the total amount of $ 285.93. Clara Sanderson seconded
the motion. The motion carried with none opposed. A copy of these
accounts will be attached to the minutes. Mr. Marshall stated that
we could still collect these accounts if these people should move
back into Kennedale by refusing them water service until their previous
bill was paid.
The Public Hearing began at this time for the annexation of Tract 5,
M. F. Scott Survey belonging to Wayne Winters. This tract is nine
(9) acres of lots 5 & 6. The Public Hearing was also for the annex-
ation of tract 9, J. M. Estes belonging to Linda Miller., George
Lowery made a motion to adopt annexation ordinance No. 77-8 annexing
tract 5, M. F. Scott Survey belonging to Wayne Winters. Bill Bishop
seconded the motion. The motion carried with none opposed.
Clara Sanderson made a motion to adopt annexation ordinance No. ?7-9
annexing tract 9, J. M. Estes belonging to Linda Miller. George
Lowery seconded the motion. The motion carried with none opposed.
Mr. Marshall made mention of the fact that five (5) feet of her
property is already in the city.
The Public Hearing ended and the regular meeting began again at this
time.
Mayor Radakovich read the proposed Resolution No. 77-5 between The
City of Kennedale and The City of Forest Hill pertaining to the
extra territorial jurisdiction between Forest Hill and Kennedale subject
to a change on the map and boundary with mutual agreement of entire
council. George Lowery seconded the motion. The motion carried
unanimously. A signed copy of this report will be delivered to
the City of Forest Hill to be considered at their next regular
council meeting.
Mayor Radakovich advised the council that he and Stanley Jernigan had
attended a mayor's council meeting recently and had asked the mayor's
council if there was a possibility of Kennedale receiving county plan-
ning assistance in upgrading the old section of Kennedale. The
county expressed their desire to assist and will send their people
out within six weeks to two months to begin this study. They are
trying to complete their present fiscal year paper work before
beginning another fiscal years program.

Mayor Radakovich told the council that Jack was preparing a list of
property owners to aquire easements for the extension and upgrading
of the water system.
Departmental reports were discussed.
The council authorized Paul Mathis to pay Leonard Hammel the retainage
held by the city in the amount of $ 2,954.33 Per contract stipulation,
Jack Yates advised the council that they were to have breakfast with
Pantego at eight o'clock A.M. March 26, 1977.
The council felt we should have a special meeting to discuss the pur-
chase of the teletype. Jack Yates is to get in touch with Pantego and
find out if they are going to share the cost of the teletype. The
council also felt this item should be considered in the 1978-1979
Budget.
George Lowery made a motion to adjourn, seconded by Stanley Jernigan.
The motion carried with none opposed. The meeting adjourned at
10:30 P.M.
