02.19.1977 CC MinutesPage 706 SPECIAL JOINT WORKSESSION OF THE KENNEDALE CITY COUNCIL AND THE ZONING AND PLANNING BOARD, SATURDAY, FEBRUARY 19. 197? Mayor Radakovich assembled the meeting at 9:00 A.M. Council members present were George Lowery, Clara Sanderson, Mayor Radakovich, Bill Bishop and Pat Turner. Stanley Jernigan was absent due to dental surgery. Zoning and Planning board members present were Don Lyon, Chairman, Robert Brown, and James Rodgers, R. E. Flowers, Ned Leonard, and Billy Conatser were absent. Mr. George Lowery gave the invocation. Mr. McElroy, attorney for Mr. Bowlin, was present to present the pro- posed plans for re-platting Lot 6 and a portion of lot 5 Block 3 Briar- wood Addition. The front of the house is one foot on to the utility easement. The proposed plans would call this Lot 6A and west 30 feet of lot 5, block 3, Briarxood addition. He requested the council to vacate the two present utility easements. James Rodgers made a motion to accept the re-platting of Alvin Bowlin's property as proposed, seconded by Robert Brown. Don Lyon voted for the motion. The motion carried. George Lowery made a motion to accept the proposed re-plat- ting as presented, seconded by Clara Sanderson. The motion carried with none opposed. The proposed house moving ordinance was discussed at length. Mayor Radakovich recommended striking the word commercial from section I, (a), Pat Turner had discussed the fees involved in section I, (a) with Stanley Jernigan. They were in agreement that the $ 100.00 fee was too high. Jack Yates suggested reducing it to $ 50.00 and reviewing all application fees for various items later. The council agreed that the fees be reduced to $ 50.00. Jack Yates said that the word building, in section I (d) should be changed to applicant. George Lowery said he felt the 600' in section II (a) was too far. Mayor Radakovich asked each council and planning and zoning board member xhat they felt would be suitable. Pat Turner said 600' Bill Bishop said 200' Clara Sanderson said 200' George Lowery said 200' Don Lyon said 200' Richard Brown said 200' James Rodgers said 200' Section 2 (a) last sentence, was changed to read the moved - in structure at time of occupancy must be of equal or greater; value= size, and appearance as any structure within two hundred feet. Ned Leonard sent a letter stating his opinions on Section 2 (a) footage Page # 707 February 19- 1977 Meeting Cont'd and section 3 (a) (b) and (c). Don Lyon advised that the State Law requires a minimum of 20,000 square feet for a septic tank. Section 2 (c) was amended to reads if sewer is available within one hundred feet of the structure it must be connected, if sewer is not available a perculation test must be county approved at time of application, and the let must be a minimum of 20,000 square feet per county and state require- ments for a septic tank. Section 2 (d), second paragraph was changed only on the footage from 600' to 200'. Section 2 (e) was added: Temporary service, if required, will be furnished and if after ninety (90) days the building is not up to code, the utilities will be discontinued. Section 3 (a) was changed to read: The applicant shall present, with the application, a performance bond provided by the owner of the structure equal to one and one - half the estimated cost of improvements as provided in section 2 (a) of this ordinance and shall be payable to the city. 1 The council instructed Jack Yates to re-draft and set the house moving ordinance for the next regular council meeting. Item # 3, Consideration of C. D. Pincher's moved in building. Mayor Radakovich read Ned Leonard's letter regarding this item. He stated, in his letter, that ignorance of the law is no excuse. He was not in favor of letting him keep the house there. The council unanimously agreed with him. George Lowery made a motion to adjourn, seconded by Bill Bishop.
