REGULAR MEBTING OF THE KENNEDALE CITY COUNCIL

Mayer Radakovich assembled the meeting at 7:40 P.M. Members
present were Geerge Lowery, Clara Sanderson, Mayer Radakovich,
Stanley Jernigan, Bill Bishop & Pat Turner.
Gesrge Lowery gave the invocation.
Mr. Yates introduced James Pate t• the council. James has been
employed by the Kennedale Police department, as an officer,
since December 9, 1976.
The minutes •f January 13, 1977 were read and approved as written.
The Resolution Relating t• annexation authority •f Texas General
Law Cities was discussed. Mayor Radakovich entertained a motion
t• send a letter t• Austin stating that we approve the Resolution.
Mr. Lowery made a motion t• send a letter from the Mayor t• Austin
approving the Resolution, seconded by Mr. Bishop.
The motion carried with none opposed.
Item #8, Purchase •f the tractor, was discussed and the bids reviewed.
Mr. Yates advised the council that Hatcher tractor Co. would allow
us $750.00 for sir •ld tractor. Mr. Lowery wanted t• keep the
tractor. Neil Jones will put in a used short block, repair the cam shaft,
repair the timing gear. It will cost approximately $1,200.00 t•
repair the •ld tractor.
Mr. Lowery made a motion t• buy the Massey-Ferguson, 35 HP, diesel,
standard transmission for $4,850.00 with a 5' mower $475.00
from Hatcher Tractor Co. Mr. Jernigan second the motion. The
motion carried with none opposed.
Mr. Marshall arrived at 8:07 P.M. Mr. Lowery recommended that we have
Neil Jones repair the •ld tractor for not mmore than $1,300.00 tops.
Mayor asked each council pezsea hew they felt about this notion.
Mrs. Sanderson, Mr. Jernigan, Mr. Bishop, & Mr. Turner all. agreed
with his recomnendaction. Mrs. Sanderson made the notion t• have
Mr. Neil Jones repair the •ld tractor at $1,300.00 tops, second
by Mr. Jernigan. The motion carried with none sppssed.
Mr. Marshall read--Resolution #77-2. calling a municipal election
for Saturday, April 2, 1977 for the purpose •f electing three
councilmen. Mr. Lowery made the motion t• adopt Resolution 77-2,
second by Mr. Bishop. The mmotion carried with ~fsne opposed.
Mayor Radakovich recommended Pauline Platt for Elec. Judge &
Hazel Bulin as alternate for the Municipal Election t• be held
April 2, 1977. Mr. Bishop mmade a mmotion t• accept this recommend-
ation, second by Mrs. Sanderson. The motion carried with gone
opposed.
Mr. Turner mmade a mmotion t• set the date for canvassing the
election .for the regular mmeeting April 14;~ 1977, second ~3y Mrs.
Sanderson. The mmotion carried with none opposed.

Item #6, Consideration •f declaring surplus and nuisance property
and providing for sale, was not ready.
The council discussed codification •f •rdinances. Mayor
Radakovich recommended we approve the bid from Spencer for
$2,900.00 for the codification •f Kennedale's City Ordinances.
Mr. Turner made the motion t• accept Spencer's Code Service
for $2,900.00, second by Mr. Jernigan. The motion carried with
none opposed.
The propsed amendment t• the Sewer use Ordinance was discussed.
Mr. Yates advised the council that a typeographical error was
made in the •rginal •rdinance #~76-10, which needed correction.
Mr. Jernigan made the motion t• adopt •rdinance #77-5 aaending
ordinance #76-10, second by Mr. Bishop. The motion carried with
none opposed.
Mr. Turner made a motion t• accept Periodical Bstimate No. 8
reducing the retainage fee. from 109b t• 5?b (14,729.33) and to
pay $32,521.96 t• Leonard Hazel. Mr. Jernigan seconded the
motion. The motion carried with none opposed.
Periodical estimate #9 reducing retainage fee from 59b to 196
died for lack of a motion.
Mr. Turner made a motion to accept
1004 which is the Bxtra work done,
Station ($456.40) #2. Radlignment
and Station #7+40 (400.00), in the

Item #1, consideration •f dedication •f a portion •f Bowles
Court, was delayed for another meeting. Mr. Marshall & Mr.
Arthur sire t• talk February 11, 1977 t• work out the details.
Mr. Arthur is willing t• dedicate the street. The council
asked Mr. Yates t• get the cost estimates on bnrb and gutter.
Departmental reports were discussed next. Mayor Radakovich
explained t• the council absut the special account that
had been set up at the bank. Paul Mathis asked the councils
persission to apply the earned iaterest from this account
t• the General Fund. The council unaniwously agreed. The
special account is a pass book savings account.
Gerald Bryan, Fire Marshall, and Bob Corcoran, treasurer '
•f Fire Department, came asking the council t• define the
word capitol improvements.
They wanted to know what they could use the 596 tax money
from the city for. They had bought a Walkie Talkie Radio
for $624.00 which they considered a capitol improvement.
The council authorized Mr. Yates to pay for the radio
in the amount of $624.00, and that in the future, the Fire

Department would present their proposed capital expenditure
to the council for approval before they made a purchase
from this fund. Mayor Radakovich advised the council that he
had found out today that Tri States Foundry could get on
sewer. John Reedy, the contractor who has been putting.
in the sewer taps, will do the job for ~'ri-Stat.es for approx. $3000.
Mayor asked the councils permission .to waive the sewer tap fee
($90.00) in this case. He asked permission to run clay pipe
to Tri States driveway, cast iron the rest of the way.
The city has some old 4" 12 year old pipe that we can sell
to Mr. Bowlin for $1.00 per foot. The contractor is not a
licensed plumber, but he has the equipment to install the
sewer line. This line is 18' deep. Mr. Bishop made a motion to
let the contractor install the sewer line for Tri States,
seconded by Mr. Jernigan. The motion carried with none
opposed.
Mr. Marshall advised the council that the minutes of the
Jan. 10 meeting needed to be corrected to read that the
Public Hearing for the annexation of the Linda Miller
& Wayne Winters property will be held at the regular meeting
March 10, 1977. Mr. Jernigan made the motion to correct
the minutes of the Jan. 10, 1977 meeting setting the
public hearing for March 10, 1977, second by Mr. Lowery.
The motion carried with none opposed.
Mr. Marshall read ordinance #77-4 changing the sewer tap
from 50.00 to $90.00 & the price of street cuts. Mr. Lowery
made a motion to adopt ordinance ?7-4, second by Mrs.
Sanderson. The motion carried with none opposed.
Mr. Marshall read ordinance #77-3 which had already been
adopted, but without a penalty clause. Mr. Marshall had
revised the original ordinance including a penalty clause.
He said the ordinance would need to be re-adopted.
Mr. Turner made a motion to re-adopt ordinance 77-3 which
is the Amusement Hall ordinance, seconded by Mr. Lowery.
The motion carried with none opposed. Mr. Marshall said
he needed a motion in the minutes to publish the ordinance by
caption & summary instead of publishing the entire ordinance.,
Mr. Lowery made the motion to publish Kennedale ordinance
#77-3 by caption and summary, seconded by Mr. Jernigan.
The motion carried with none opposed.
Bill Hester came to discuss the house moving ordinance. He
said over a year ago he had an ordinance drawn up, at his
expense, per Mr. Marshall & Mr. Yates request & he had not
had any response to this. He wanted to know what was being
done. Mayor Radakovich told him this was being worked on.
Mr. Yates was assured by the council that this would be
considered immediately. Mayor Radakovich recommended a

worksession within the next two weeks. The council agreed
but no definite date was set.
Mr. Lowery made a motion to adjourn, second by Mr. Turner.
The motion carried with none opposed. The meeting
adjourned at 10:42 P.M.
