09.13.1979 CC MinutesPage 882 REGULAR MEETING KENNEDALE CITY COUNCIL September 13, 1979 Mayor Radakovich assembled the meeting at 7:35 P.M. Clyde Marshall gave the invocation. Council members present were Mayor Steve Radakovich, Mayor Pro-Tem Clara Sanderson, Dwight Miller, Charles Kuykendall and Wayne Winters. Councilman George Lowery was absent. Staff members present were Mel Justice, Clyde Marshall, Paul Mathis and Tyne Reflogal. The minutes of the Regular Meeting for August 9, 1979 were approved as read. ITEM N0. 2 TRAILER PARK HEALTH VIOLATIONS REPORT. Mayor Radakovich explained to the council that this was the written report from the County Health Inspector regarding the inspection that had been made at the Village Creek Mobile Home Park during the August flooding of Village Creek. The council discussed the report and any possible action to be taken by the City. It was the consensus of the council that the County Health Department would handle the situation, with the City assisting if needed. ITEM N0. 4 CONSIDERATION OF RESOLUTION CONCERNING CENTRAL TAX APPRATSAL DISTRICT BOARD IN TARRANT COUNTY. Wayne Tainters explained the overall concept of the Tax Appraisal Board and an indepth report as it pertains to Kennedale. Clara Sanderson made a motion to adopt Resolution No. 79-17, seconded by Dwight Miller. Motion carried with none opposed. ITEM N0. 5 CONSIDERATION OF APPOINTMENT OF THE BOARD OF EQUALIZATION. Paul Mathis gave a verbal report on the 1979 City Taxes and advised that an Equalization Board must be appointed. After a question and answer session the council decided to postpone appointing a Board until a later date. ITEM N0. 3 CONSIDERATION OF RESOLUTION REGARDING CITY OF • KENNEDALE'S PARTICIPATION IN TARRANT COUNTY'S SIXTH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM. Mayor Radakovich stated this resolution was to notify Tar- _ rant County that Kennedale did wish to participate in Tar- rant County's Sixth Year Development Program for 1982. Dwight Miller made a motion to adopt Resolution No. 79-18 seconded by Charles Kuykendall. Motion carried with none opposed. Page 883 Regular Meeting Kennedale City Council September 13,1979 con't ITEM N0. 6 CONSIDERATION OF SALARY INCREASE FOR MUNICIPAL COURT JUDGE. The council entered into a short discussion. Dwight Miller made a motion to increase the Municipal Court Judges salary to $200.00 per month, seconded by Charles Kuykendall. Motion carried with none opposed. ITEM N0. 7 CONSIDERATION OF AUTHORIZATION TO ENFORCE KENNEDALE CITY CODE SECTION 8-9. Mel Justice asked for council approval to hire someone to cut weeds sub- ject to Kennedale City Code Section 8-9. The council entered into a len- gthy discussion concerning the overall weed problem. Council gave permission to hire a contractor when necessary and to fur- nish list of outside contractors in weed letter notices. ITEM N0. 1 LARRY LEDBETTER TO DISCUSS DRAINAGE ON PEGGY LANE. Mr. Ledbetter was not present. Mayor Radakovich reported the City was aware of his problem and the problem on Mansfield-Cardinal Road. Mel Justice is getting estimates for both locations. DEPARTT~NTAL REPORTS Mayor Radakovich asked if there were any questions concerning the dep- artmental reports. There were none. OPEN DISCUSSION Mayor Radakovich reported on the Ambulance situation stating that 80% of the ground work had been accomplished and that it was nom time to ask for pledges from the small businesses and the local residences. Mayor Radakovich asked when the council would like to call a special closed meeting to interview applicants for the Chief of Police position. It was decided to have two meetings set one for 9:00 A.M. Tuesday September 18, 1979 and one for 9:00 A.M. Thursday September 20, 1979, in the council chambers. Mayor Radakovich asked if any citizens wanted to speak. The Mayor recon- igized Eugene Garner. Eugene Garner of 101 S. Dick Price Road came before the council and stated "I personally want to apologize to the council and to the Mayor, I jumped the gun the other day and that situation I have investigated myself and found out a lot more facts and I personally want to apologize to you all." Mayor Radakovich recognized Ms. Joyce Smith who had presented the Mayor and council members with letters immediately prior to the opening of the meeting. Ms. Smith resides at Rt. 13 Box 212B Fort Worth. Page 884 Regular Meeting Kennedale City Council September 13,1979 con"t Ms. Joyce Smith came before the council stating "T think the letter I gave all you council speaks for its self. T did con- sult with Phil Burleson who helped me with this letter. Who is on Cullen Davis' defense team. I will definitely be the plaintiff in this." Ms. Smith told the council that two negroes were beaten here in this City Hall and that they have filed a protest with the Human Rights Division in Austin. Ms. Smith again stated she was definitely the plaintiff in the suit but had brought this suit with the full know-ledge of Mr. Davis' defense team and with Phil Burleson's help. She further stated she felt probably the only alternative left to the Catty of Kennedale was for Mr. Steve Radakovich to resign. Again st- ating the letter speaks for its self. Wane Winters asked Ms. Smith if he understood her correctly, "that if the Mayor resigns you won't file this suit." Ms. Smith replied "That is Mr. Cullen Davis' attorney's sugg- estion that if he resigns that they will drop the suit." Wayne Winters asked again "They will drop the suit as long as he resigns." Ms. Smith repeated "That is right." Mel Justice gave an up to date report on the Pate Jones As~- phalt Company sewerage and Zoning Board situation. County Health Department is checking on septic tank and Paul Mathis is working with Zoning Board. Mel Justice reported on the Mansfield-Cardinal Road drain- age problem. Two estimates recieved waiting for one more estimate. All to be in writing. Wayne Winters made a motion to adjourn, seconded by Clara Sanderson. Motion carried with none opposed.
