Page 104 REGULAR MEETING KENNEDALE CITY .COUNCIL JULY 14, 1983 Mayor Radakovich assembled the meeting at 7:45 p. m. Members present were Mayor Steve Radakovich, Mayor Pro-Tem Doyle Riley, Councilmembers A11an Elrod, Wayne Winters, Pete Kirkpatrick and Richard Bennett. Staff present were Mel Justice, Clyde Marshall and Tyne Reflo- gal. Clyde Marshall gave the invocation. The minutes of the meetings of June 4, June 9, June 11, June 18 and June 27, 1883 were approved as presented. Item No. l: CONSIDERATION OF PETITION ON THE ANNEXATION OF 37.7 ACRES OF LAND OUT OF THE T. J. ROGERS SURVEY, ABSTRACT 1363 AND THE W. E. HALTOM SURVEY, ABSTRACT 731, LOCATED EAST OF LITTLE ROAD AND NORTH OF BORDER LAND IN THE CITY OF KENNE- DALE. Mayor Radakovich asked Mr. Couch if he was requesting annex- ation on Sts own merits with no strings attached. Mr. Couch said yes he was. Pete Kirkpatrick made a motion to annex subject property with Ordinance No. 83-8, seconded by Richard Bennett. Motion car- vied with none opposed. Item No. 2: CONSIDERATION OF CHANGE TN ZONING ORDINANCE INVOLVING CHANGES IN ZONING OF WOODLANDS ADDITION. Wayne Winters made a motion to change the zoning from "C" and rrErt to "A-1" with Ordinance No. 83-g, seconded by Richard Ben- nett. Motion carried with none opposed. Item No. 3: CONSIDERATION OF TRINITY WELL REPAIR. Mayor Radakovich asked for Council permission to pay for re- pairs on the Trinity Well in the amount of $17,016. Richard Bennett made a motion to authorize payment, seconded by A11an Elrod. Motion carried with none opposed. Item No. 4: CONSIDERATION OF THE COLLECTION OF DELINQUENT TAXES. Mayor Radakovich reported to Council that the staff, through delinquent tax statements and control of building permits, has substantially reduced delinquent taxes prior to 1g82. However, recent attempts to reduce this. balance further has produced negative results. It is the recommendation of the staff that the delinquent accounts be turned over to the City Attorney or Page 12 ~5 REGULAR MEETING JULY 14, 1883 Contd. other attorney for collection by judicial means if necessary. After a discussion of alternatives Council instructed Mr. Justice to send letters advising the property owners that the accounts will be turned over to an attorney for collection if not paid. Open Discussion: Jerry Ford discussed with the Council the possibility of the Chamber of Commerce using one of the rooms at City Hall. It was the consensus of the Council that the Chamber of Com- merce could use one of the rooms with the City repairing the roof and the Chamber of Commerce renovating the subject room. Mel Justice was instructed to advertize for bids for a gable roof. Gary Cooper asked Council if the City would be willing to pay half the cost of paving Crestview in front of the elementary school. The CityTs cost would be approximately $14,000. Council stated they could not spend over $5,000. without get- ting bids. Mr. Cooper said he would pay the difference if Council would be willing to pay the $5,000. H..chard Bennett made a motion to accept Mr. Cooper's offer and authorize $5,000. payment for repaving and curbs and gut- ters on Crestview and 'Mistletoe at the elementary school, se- conded by Pete Kirkpatrick. Motion carried with none opposed. Mayor Radakovich reported the County does not recommend a sidewalk be installed on Bowman Springs due to space available for sidewalk and drainage ditch. Council discussed the width of the road, bar-ditch and side- walk. Gary Cooper said he would ask his engineer to look at the sight and make a recommendation. Pete Kirkpatrick asked to be notified of sealed bid openings. Mr. Moniz asked if the business at 1117 East Mansfield Highway had a variance to operate. Council discussed the zoning of Mansfield Highway and it was discovered an oversight had occured and a variance would be necessary. Mrs. Bennett asked about the dog ordinance and was informed Page 1206 REGULAR MEETING JULY 14, 1883 Contd. she would need to file a complaint with the Police Department. Council discussed the weed and fire ordinance and decided to increase the mowing charge once a fire hazard has been declared from $20.00 per hour to $50.00 per hour. Mayor Radakovich questioned the repairing of mobile homes at 216 East Mansfield Highway. Mr. Justice reported the business was suppose to have retail sales only. Mr. Justice was in- structed to contact the owner and advise hirn he could not do this type repair work in "E" zoning. Mayor Radakovich also asked about the building that was moved onto Mr. Keeton's property. Mr. Justice stated Mr. Keeton had been notified to remove it. Wayne Winters asked Mr. Justice to investigate and take appro- porate action on a trailer, whioh has been placed on the Brewer property on Bowman Springs Road. Mayor Radakovich reported the new Police Chief Charles Carter will report for duty Monday July 18th. Council called a special j©int meeting of the Council and the Planning and Zoning Board for 10:30 a. m. July 16, 1983, to review and study the zoning in the City. At 8:50 p. m. Wayne Winters made a motion to recess regular session and enter closed session, seconded by Allan Elrod. Motion carried with none opposed. Allan Elrod .made a motion to adjourn closed session and recon- vene regular meeting, seconded by Doyle Riley. Motion carried with none opposed.
