EDESTRIAN INFRASTRUCTURE TO PROVIDE ACCESS TO
FELANEY ELEMENTARY AND ARTHUR INTERMEDIATE SCHOOLS

WHEREAS, the City of Kennedale, Texas ("City") is a home rule city acting under
its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and
WHEREAS, it is the intent of the City to protect the public health, safety, and
welfare; and
WHEREAS, the City initiated its Safe Routes to School project to construct safer
pedestrian infrastructure for access to schools within the City; and
WHEREAS, the area in and around Crestdale Subdivision requires improvements
to its pedestrian infrastructure in order to provide safe access to Arthur Intermediate
School and Delaney Elementary School; and
WHEREAS, the City and the Texas Department of Transportation are authorized
by the laws Of the State Of Texas t0 enter into and d0 intend to enter into an Advance
Funding Agreement for the project involving the construction of new pedestrian
infrastructure, including sidewalks, curb ramps, crosswalks, and other features, in this
project area; and
WHEREAS, the AFA Local Government Contribution from the City for this
construction is $406,682.00.
SECTION 1. The City of Kennedale, Texas, may enter into an Advance Funding
Agreement (AFA) with the Texas Department of Transportation (TxDOT) for Congestion
Mitigation and Air Quality Improvement (off -system) for constructing pedestrian
infrastructure in the Crestdale subdivision to provide safer access to Delaney Elementary
and Arthur Intermediate schools (TxDOT CSJ # 0902-90-199). The City of Kennedale
will be 100% responsible for project overruns. Further, the City Manager for the City of
Kennedale is hereby authorized to sign the Agreement.
SECTION 2. Upon adoption of this Resolution, the City Secretary is directed to
give such notice of this resolution as may be required by law.

SECTION 3. The Mayor, City Manager, and City Secretary, in consultation with
the City Attorney, are hereby authorized and directed to take all actions necessary to
effectuate this Resolution.
SECTION 4. This Resolution shall be effective immediately upon its passage.

hereby certify as follows:
1. The City Council of the City (the "City Council") convened in Regular Meeting
on June 21, 2022, at the designated meeting place (the "Meeting"), and the roll was called
of the duly constituted officers and members of the City Council, to wit:

then duly moved and seconded that the Resolution be adopted; and, after due discussion,

2. A true, full and correct copy of the Resolution adopted at the Meeting described
in the above and foregoing paragraph is attached to and follows this Certificate;; the
persons named in the above and foregoing paragraph are the duly chosen, qualified and
acting officers and members of the City Council as indicated therein; each of the officers
and members of the City Council was duly and sufficiently notified officially and personally,
in advance, of the time, place and purpose of the Meeting, and that the Resolution would
be introduced and considered for passage at the Meeting, and each of said officers and
members consented, in advance, to the holding of the Meeting for such purpose; and the
Meeting was open to the public and public notice of the time, place and purpose of the
Meeting was given, all as required by Chapter 551, Texas Government Code.
