MINUTES
REGULAR MEETING
August 4, 2015

I. CALL TO ORDER
Mr. Vader called the meeting to order at 7:00 PM.

A quorum was present.
Jeff Nevarez was asked to serve as a regular member for the meeting.
Staff present: Sandra Johnson (building official); Charles Comeaux (code enforcement officer); Katherine
Rountree (board secretary); Rachel Roberts (city planner).
III. MINUTES APPROVAL
A. Consider approval of minutes from July 7, 2015 Building Board of Appeals meeting.
Mr. Madrid motioned to approve the minutes. The motion was seconded by Mr. Young and passed with all
in favor.
IV. REGULAR ITEMS
A. CASE BBA # 15 -01 Public hearing and consideration of demolition approval regarding a city -
initiated request for demolition of an "R -3" Single family residential home located on approximately
.26 acres at 1012 Harrison St, legal description of Hilldale Addn Lot 4, Blk 5.
1. Staff Presentation
Sandra Johnson, building official for Kennedale, said the case was postponed from the last meeting on
July 7, 2015. She said the city wants to demolish the house since the potential buyer has not
purchased it.
2. Property Owner Presentation
The property owner did not attend the meeting.
3. Public Hearing
Larry Whittington, 3120 N. Buckner St. Dallas, TX 75228, said that he has not purchased the property
yet. He said that he had authorization from the property owner and cleaned up the house pending the
purchase of the home. Kelly Rogala, 1120 West Ave A Garland, TX 75040, said the mortgage
company did not include the appraisal on the home and it postponed the purchase of the property. Mr.
Whittington provided an estimated timeline to the board for the repair of the property. He said it will be
between thirty (30) to 120 days. He said once he has completed the purchase of the home, he will start
on repairs according to the timeline.
4. Property Owner Response
The property owner did not attend the meeting.
5. Staff Response and Summary
Ms. Johnson went over the plans that would most likely be submitted if he purchased the property and
stated that depending on what is submitted, the time line could not be accurate. Staff recommended
demolition.
6. Action by the Building Board of Appeals
Mr. Madrid motioned to postpone the case to next month on September 1, 2015. The motion was
seconded by Mr. Young and passed with all in favor.
B. CASE BBA # 15 -02 Public hearing and consideration of approval regarding a city- initiated request
for demolition of a "MH" Manufactured Home located on approximately .34 acres at 4325 Danny
Dr, legal description of Hudson, Wade H Survey A 716 Tr 2B16.
1. Staff Presentation
Sandra Johnson, building official for Kennedale, said the mobile home had a fire on September of
2014. She said the house is an eye sore for surrounding properties and there have been multiple
complaints made to the city.
2. Property Owner Presentation
Judy Pettigrew, 12116 Rolling Ridge Dr. Burleson, TX 76028, said that she had a dumpster on the
property full of trash from cleaning up the property and that she had multiple people help her. She said
that her electricity was shut off to her storage unit to the back of the property since the fire took place
and was not turned back on. She said that she was not living at the property when the house caught
fire.
3. Public Hearing
No one signed up to speak.
4. Property Owner Response
There was not a public hearing so there was not a response.
5. Staff Response and Summary
Ms. Johnson said that city code requires that a primary structure have electricity before a secondary
building have electricity released. Staff recommended demolition.
6. Action by the Building Board of Appeals
The board has determined that the building does not meet the City's minimum building standards.
Mr. Madrid motioned for the property owner to demolish the building and clear the lot of debris within
30 days and, if not demolished and the lot cleared within 30 days, then the city may demolish and
charge the property owner. The motion was seconded by Mr. Young and passed with all in favor.
V. REPORTS /ANNOUNCEMENTS
There were no announcements.
VI. ADJOURNMENT
Mr. Nevarez motioned to adjourn. The motion was seconded by Mr. Madrid and passed with all in favor.
The meeting adjourned at 7:44 PM.
