01/12/1984, Regular Meeting MinutesPage 1241 REGULAR MEETING KENNEDALE CITY COUNCIL JANUARY 12, 1984 Mayor Radakovich assembled the meeting at 7:35 p. m. Bi11 Reynolds gave the invocation. Members present were Mayor Steve Radakovich, Mayor Pro-Tem Doyle Riley, Councilme~bers Allan Elrod and J. D. Kirkpatrick. Members .absent were Wayne Winters and Richard Bennett. .Staff present were Mel Justice, Clyde Marshall and Tyne Reflo- ga1. The minutes of the two Public Hearings and the Regular Meet- ing of December 8, 1883 were approved as presented. Item No. l: CONFIRMATION OF FIRE DEPARTMENT OFFICER ELECTIONS. Fire Chief Jim Smith was present. and asked Council to confirm the election of Jim Smith as Fire Chief, Jerry Kirkpatrick as Asst. Fire Chief and Darrell Barnes as Fire Marshall. Allan Elrod made a motion to confirm the appointments, second- ed by Doyle Riley. Motio n carried with none opposed. It ern No. 2: MARK WRIGHT OF KYA TO DISCUSS BALL FIELD GENERAL IMPROVEMENTS. , Mark Wright, David Thomas and Dan Vaughn were present to rep- resent KYA. Mark Wright presented the following list to Coun- cil. 1. City purchase Balan for control of stickers on baseball fields. 2. Remove four truck loads of dirt from Bronco field. 3. Extend fence on both fields-along foul lines to the outfield. fence approximately 200 feet of chain link fence and posts. 4. Move water rr~eter to allow vehicle traffic behind concession stand. 5. Place "NO PARKING" sign on other side of village street. b. Place barrier along fence line near parking area to stop water drainage from upper vil- lage Street. City purchase Amdro for fire ant control. Council entered into a discussion with the KYA representatives and the results of that discussion was as follows: 1. City to purchase Balan. 2. City to request the County to remove the four dirt piles. 3. Mr. Justice to get cost estimates for 200 feet of 4 foot chain link fence and poles. 4. Mr. Justice to get cost of estimates for 150 feet of 4 foot fence and poles for road and cost estimates to build parking lot and road to practice field. 5. No discussion of parking signs. 6. P•'ir, Justice to contact County concerning feasibility of a drainage ditch along south property line from Village St. to creek. 7. No discussion of barriers on north property line. 8. City to purchase Amdro for control of fire ants. Council discussed the problem of trash being dumped on Village St. The City will clean up. Mr. Kirkpatrick will make arrangements for gravel and KYA will make arrangements for trucks to haul the gravel. J. D. Kirkpatrick made a motion to purchase the Balan and the Amdro, ask the County to help with the construction work and get estimates for the fencing, seconded by Doyle Riley. Mo- tion carried with none opposed. Item No. 3: FINAL PLATS ~'OR SHADY CREEK PHASE T, SHADY CREEK PHASE II AND WILLIAN~SBURG SQUARE. Gary Cooper, John Levitts and Don Samanie were present. Mel Justice reported the Planning and Zoning Board had approved the final plats and recommended Council's approval. Mr. Cooper discussed the possibility of a day care center and a stop and go type market. on lots 2 and 3 of Williamsburg Square, with a shopping center in the middle of lot 4. Mr. Cooper further stated the builders in the Woodland Addition were required to build a stockade fence on lots abuting Williamsburg Square. Page 1243 RECxULAR P~EETING JANUARY 12, 1984 Contd. Council and Mr. Cooper discussed the possibility of a co- operative effort between the City, the developer and the land owners to widen Little School Road. John Levitts stated they were planning to la,y an 8" water line from the well lot on Crestview to the curve in the 400 block of Sublett Road. Mr. Levitts asked the Council to share the cost of the 8" line from the 400 block of Sublett Road to Little School Road. The total cost estimated to be $32,550. City cost would be approximatel~,= $15,000 to $16,000. Allan Elrod made a motion to approve City participation of 50% for an 8" water line from the 400 block of Sublett Road east to Little School Road, seconded by J. D. Kirkpatrick. Motion carried with none opposed. J. D. Kirkpatrick made a motion to approve the final plats for Shady Creek Phase I, Shady Creek Phase II and Williams- burg Square, seconded by Doyle Riley. Motion carried with none opposed. Item No. 4: CONST_DERATION OF CHANCE IN FORT WORTH WATER CON- TRACT. Mr. Justice reported the water contract must be amended to delete the paragraph requiring the City of Kennedale to charge its customers 10% higher rates than the City of Fort Worth charges its customers. Mr. Justice further reported the estimated cost to connect to the Fort Worth water line has increased by $35,000. Doyle Riley made a motion to authorize the Mayor sign the amended contract., seconded by Allan Elrod. Motion carried with none opposed. Doyle Riley made ~, motion to approve the additional payments of $35,000, seconded by J. D, Kirkpatrick. Motion carried with none opposed. Item No. 5: CONSIDERATION OF BIDS ON WATER TOWER CONTRACT. Mr. Sustice reported sealed bids were taken on cleaning and repairing the 55,000 gallon overhead tank. Kirkpatrick made a motion to accept the low bid of Pitts- burg Tank & Tower Co. of $5,885, seconded by Allan Elrod. Mo- tion carried with none opposed. No. 6: CONSIDERATION OF BIDS ON PUMP MOTOR CONTRACT. Mr. Justice reported only one bid was received. The only bid was from Smith Pump Co. of Waco, Texas in the amount of $9,440. J. D. Kirkpatrick made a motion to accept the bid of Smith Pump Co. in the amount of $9,440, seconded by Doyle Riley. Motion carried with none opposed. Item No. 7: CONSIDERATION OF PLANNING AND ZONING BOARD RECOM- MENDATION ON STREET IMPROVEMENTS. The Planning and Zoning Board made the following recommenda- tions: a. Study plans to obtain funds through initiation of a capital improvement program, Federal Grants, State CTrants and developers contributions. b. Require developers to post monies either b,y cash, letter of credit or land and/or deed donation in the amounts of a certain per- centage of total street costs for road improve- menu with the stipulation such funds would be used within a three to five year period or re- funded. c. Have plans for road improvements prepared by an engineer to reflect road expansions, type road required,. estimated costs, etc. This would need to be done before a capital improvement program was initiated. d. Select roads for improvements/expansions on a priority basis, the most critical need first, etc., and follow such priorities. e. It was stated by the Board that it is not their intent that study of this item delay any progress on projects now on-going nor any future projects which may occur prior to finalization of this item. Mr. Justice reported he was scheduled to attend a meeting with the State Highway Department concerning feeder roads connect- ing the interstate highways. Mr. Justice will check on possi- ble grants and report to Council at the February meeting. Item No. 8: CONSIDERATION OF ESTABLISHMENT OF "G-1" LIGHT INDUSTRIAL ZONING CLASSIFICATION. The Planning and Zoning Board recommended Council establish a new Zoning Classification as follows: 1. Use Regulations: In the "G-1" Light Industrial District, no buildings or land shall be used .and no buildings shall be hereafter erected, altered or .enlarged, unless ®therwise provided in this ordi- nance, except for one or more off' the following uses. a. Any uses permitted in the "F" District. b. Bakeries - Wholes~.le. c. Body and fender work for automobiles and horse trailers. d. Cleaning, dying, pressing works, laundry and washateria. e. Cold storage plants. f. Dog and cat hospitals, and kennels, when not less than 100 feet from an "A", "B", "C", "D", "E" or "F" District. g. Furniture repair. h. Machine shops, provided power not to exceed twenty five (25) horse-power is .employed in the. operation of any one machine and all ma- chinery, supplies and material are contained within a closed building at all times. i. Paper box manufacture. j. Pattern shops. k. Sheet metal shops using sheet metal of sixteen (16) gauge or thinner and all machinery and material are contained within a closed build- ing at all times. 1. Truck trailer parking only terminals. Welding shops, custom work, not including structural welding. n. Accessory buildings and uses customarily incidential to the above. o. Any operation in which the sound decibel level of fifty (50) is exceeded is prohib- ited. 2. Height and Area Regulations: Tn the "G-1" Light Industrial District the height of buildings and the minimum dimensions of yards shall be as follows: pro- vided, however, that buildings. erected, reconstructed, altered or enlarged exclusively for dwellings purposes shall comely with the front, side and rear yard regulations of the "B" Multi-Family District. a. Height: No building hereafter erected, recon- structed, altered or enlarged, shall exceed two (2) stories, nor shall it exceed thirty five (35) feet. b. Front Yard: Same as District "F". c. Rear Yard: No rear yard shall be required except where the "G-1" District abuts on a Dwell- ing District, in ?~rhich case there shall be a rear ,yard of_ not less than ten (10) feet. d. Side Yard: Same as District "F". e. Lot Area Per Family: Same as District "B", if used for dwelling purposes. f. Suitable screening will be required if "G-1" zoning areas abut a dwelling district. Planning and Zoning further recommended the following property be rezoned to "G-1": a. From Alma Lane South to Liberty Baptist Church and East 500 feet from the Highway 287 right-of-way. b. From TESCO right-of-way at Liberty Baptist Church Southeast along the South side of TESCO right-of-way to Mansfield Cardinal Road. c. South a1_ong Mansfield Cardinal Road to Eden Road. d. North along Highway 287 to TESCO right-of- way at Liberty Baptist Church. 1 Doyle Riley made a motion to accept the Planning and Zoning Board recommendation on a new zoning classification and to schedule a public hearing for February 9, 1884, seconded by Allan Elrod. Motion carried with none opposed. Item No. g and 10: CONSIDERATION OF INCREASING WATER AND SEWER TAP FEES. Mr. Justice recommended Council consider increasing the Sewer Tap fees to $275.00 and increasing the Water Tap fees as follows: 3/4 inch meter $200.00 1 inch meter 275,00 1%2 inch meter 450.00 2 inch meter 575.00 Larger meters and compound meters should. remain the same since charges are made based on cost. Doyle Riley made a motion to adopt Ordinance No. 84-1, "ANDS ORDINANCE INCREASING THE WATER AND SEWER TAP FEES EFFECTIVE JANUARY 13, 1984", seconded by J. D. Kirkpatrick. Kirkpatrick made a motion to amend the City Code 1977, ,~ ~ Chapter 3, to increase the permit fee charges as recommended, ,~ a seconded by Doyle Riley. Motion carried with none opposed. ~'~ 0 Mr. Thomas further recommended Council adopt the 1882 Building, ~ Plumbing, Electrical and Mechanical Code Books. Also Council to ~ ~ cancel the requirements for contractor's bonds. It was the Q-~ consensus of the Council to consider this request at a later date. N o ~ OPEN DISCUSSION: Mr. Justice reported the-bids for the City Hall roof will be ready for the February meeting. Mr. Justice was instructed to have„the ceiling and insulation installed in the Ambulance Shelter, also the utility sink. Mr. Albert Soto complained about the 12" water line on Village Street freezing each winter for-the past three (3) years and asked if Council would authorize a larger line. Mr. Justice was instructed to get cost estimates for a 6" line from the well lot to Mr. S©to's house and a 2" line from Mr. Soto's to Averett Road. Mr. Soto also asked for a street sign at Village and Averett. Council discussed water service lines from the mains to the meter boxes. J. D. Mr. Marshall reported another request. to release lot 4, block 14 Oakcrest Addition property belonging to Pate Jones. Allan Elrod made a motion to authorize Mr. Marshall withdraw the complaint concerning lot 4, block 14, Oakcrest Addition, seconded by Doyle Riley. Motion carried with none opposed. Doyle Riley made a motion to recess regular session and go into closed session, seconded by Allan Elrod. Motion carried with none opposed. Council entered closed session at 12:15 a. m. Allan Elrod made a motion to adjourn closed session and re- convene regular session at 12:40 ~., m., seconded by Doyle Riley. Motion carried with-none opposed. Council discussed the increased work load on the City Hall employees with the utility companies closing collection offices operated by the utility companies. It was the consensus of the Council to cancel all contracts with Southwestern Be11, TESC~, Lone star Gas Company and Storer Cable T. V. Company concerning the City of Kennedale collecting payments of utility bills. A11an Elrod made a motion to adjourn, seconded by Doyle Riley. Motion carried w~,th -none opposed.
