Why do you feel you should be reappointed to serve on the YAC for another term?*
I believe I should be reappointed on the YAC because this past year has been amazing and I believe I was beneficial
to some of the successes and should be granted the opportunity to continue next year.I have a few ideas that would
help get more of the high school students involved in Kennedale that I believe would benefit the city.
I have also learned many things about how the city runs and have become very interested in government lately.
Being in YAC again next year would be another great learning experience for me.
Which YAC projects have you been involved with over the last year?What was your involvement in these
projects?*
I have been involved in:
The Movie Night as help for Advertisement and as Historian taking photos
The YAC Food Truck Event as helping plan,advertise,set up as well as doing my job as Historian by taking photos
Tour of the Fire Department as Historian taking photos
The National League of Cities Trip as Historian taking photos

If you are reappointed,what specific projects and events would you like to see the YAC focus on next year?*
I would like to see the continuation of the Food Truck event as well as expanding it. I hope to also make the family
movie night events a tradition to involve the whole community and get people to visit our beautiful park.
In addition to these events, I hope for YAC to make a lasting impact on the city and really change our community by
involving all citizens in bigger events and programs.

Why do you feel you should be reappointed to serve on the YAC for another term?*
I feel that I should be reappointed to the Youth Advisory Council because I have,throughout the year, played a role in
the organization and execution of every Youth Advisory Council project.I have worked with the current chair of the
Youth Advisory Council,Ashley Luu,to better prepare myself as a potential leader and role model for next year's
Youth Advisory Council. I plan to continue with my commitment to the success of the Kennedale Youth Advisory
Council into the coming year.
Which YAC projects have you been involved with over the last year?What was your involvement in these
projects?*
In the past year, I have been involved in several of the Kennedale Youth Advisory Council's projects.The most
notable projects that I have participated in are the Youth Advisory Council's Movie Night and Food Truck Event.For
the Movie Night 1,along with my fellow YAC members,assisted with advertisement,set up,clean up,food sales,
and general organization. During the planning process for the YAC's Food Truck Events, my primary responsibility
has been to contact potential vendors. However, I have also assisted in organization and general execution such as
set-up,clean-up, and advertisement.
If you are reappointed,what specific projects and events would you like to see the YAC focus on next year?*
I would like to see the YAC continue with the Movie Night Event as well as the Food Truck Events.However,in the
coming year my greatest goal is to implement a more active position concerning volunteer work as well as involve
the Youth Advisory Council in more community betterment programs. I would also like to see the YAC become better
educated on the daily happenings of the Kennedale City Government so as to become better advisers to it.

Why do you feel you should be reappointed to serve on the YAC for another term?*
As secretary of the 2014-2015 Youth Advisory Council, I gained knowledge and experience that went far beyond
anything I could ever learn in school. I learned procedures,meeting etiquette,and departments of the city that I knew
little about before I started. I am eager to receive another opportunity to learn more about the city of Kennedale. If
reappointed, I would be prepared to step up in more leadership positions as a second year member.Additionally, I
have many projects and ideas involving many people that could benefit our city. I sincerely hope the city council
considers reappointing me for the next term.
Which YAC projects have you been involved with over the last year?What was your involvement in these
projects?*
This year, I was involved with all of the YAC projects.My favorite was one that we had never attempted before:a
movie night directed toward kids of elementary and middle school ages. I was on the advertisement committee; I
hung up flyers around the city and encouraged everyone I knew to attend the event. During the movie, I served
concessions and was delighted to meet the kids from all over the city.Additionally, I had the privilege of serving as a
youth delegate at the National League of Cities conference,where I represented the Kennedale YAC and attended
seminars and other workshops that furthered my knowledge of city government. Next month, I plan on helping at the
Brickworks festival in the newly re-designed kids area. I am looking forward to this event,as it combines the
Independence Day parade and Art in the Park and thus could combine people of all ages and backgrounds together.

If you are reappointed,what specific projects and events would you like to see the YAC focus on next year?*
For the 2015-2016 year, I believe there are many projects the YAC could choose to focus on.The two most
important are the planning of some kind of outdoor recreational activity,such as a volleyball court(a project we
started last year)and an event that would get youth from outside of the YAC involved with the city.The public works
project is important because there is a generous amount of available land in Kennedale,and it would be extremely
beneficial if we could devote that space to an activity that would be promote healthy lifestyles within our city.
Additionally, I would like to focus on an event that would encourage youth involvement with in the city,such as a
mass service project or city career day.This way,the youth could truly see that they can have an impact on their
own community.

I believe hard work and dedication will lead to prosperity and with that mind set I would like to think I could help the
YAC in any area I am assigned too.
Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
Everyone you will every encounter will always has,at least,one different opinion than you.With that said,
compromise is always the best way to go.Trying to find a good balance in-between each other persons idea will lead
to better understanding of each others opinion,while at the same time reaching a unified goal.

Describe how you handle multiple responsibilities.For example, balancing schoolwork,afterschool activities,
family,etc.*
I personally like to"knock out"each subject one at a time,so that in the process my mind is not going in 5 different
direction at once. I believe organization and goals are the best way to achieve what you have set out to do.

I would like to say I'm a very motivational guy, I like to help others through inspiration. I am also very family oriented,

Essay
Why do I think participating in my local government and community is important?I
believe that it will help me get a better understanding of how our city works,while at
the same time helping improve the community in the process. Helping the community
not only allows for activities and work but it allows the city to form a bond with those
who dwell within our city,who could very well be our neighbors. It is important to
make this relationship with the community so that we can better understand the
problems that occur,allowing us to act on those problems and fixing them in a quick
and loving manner.What kind of impact do I hope to leave on Kennedale as a member
of the YAC?I hope that I can leave the position and look back on the experience
thinking that I did everything in my power to do the best for this city and community. I
don't want to leave this position, if I am chosen,and have nothing to show for it. I
want to leave a lasting impression on this community,one that will guide it in its future
years to better prosperity.

Youth Advisory Council. I have known Aaron for some four years through the Church
youth program at Covenant Life Baptist Church, Kennedale. Aaron works well with
the youth and adults in our church. He has participated on both a mission trip and

raise funds for both trips. During these times he has worked long hours with a great

How do you feel your personality and leadership style would help the YAC to achieve its goals?
I feel as if I could bring a positive attitude and open mind to the YAC. I am always willing to hear others ideas,as
well as presenting my own ideas. I also feel as if I could take on the role of leading my peers as well as being lead
by them.As a member of YAC I might have to take on multiple different roles, I think it is very important to be
flexible with in the organization.

Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
I face adversity everyday,a time that sticks out in my head though is home coming week. During homecoming week
multiple decisions have to be agreed on by me and all my peers.That is not always easy to come by.One major
conflict we had was choosing the theme to decorate our hallway.Some people wanted Hawaiian others, including
me,wanted candy land.As a class officer it was my job to resolve this, I did this by taking a class vote. I resolved
the issue calmly and timely even if though my theme didn't win.

Describe how you handle multiple responsibilities.For example, balancing schoolwork,afterschool activities,
family,etc.*
As a student-athlete, I have to balance school work and sports all the time.The way I do this is to prioritize my
responsibilities. For example student comes first and athlete comes second,therefore schoolwork is my first priority.
Sometimes, I have to work with my coach in order to figure out a good academic schedule for both me and him. By
prioritizing, I can keep all my responsibilities in order.
What values do you publicly display through social networking sites, blogs, pictures,bumper stickers,
clothing,etc. How do you present yourself to the world?*
Social Networking is something that can make you or break you. In my opinion I think it is more than important to
present myself as well educated and an over all great person. Everything you post on social media is public,others
can see it. I always think"would i want my grandmother to see this?"or"is this relevant?" , Because I stick to
those two things my social media accounts are appropriate and relevant.
Are there specific areas of city government and the City Council decision making process that you find exciting
and would like to be a part of?*
I think being involved in my City's council is so valuable. Having a say in what goes on in my community is a great
opportunity. I think bringing together the community is something that is very exciting. I would love to get the chance
to bring my community together more often. I would love to do more events like food truck night. In general,all
aspects of my city's government is exciting.
In what other activities are you currently involved(sports,clubs,groups,job,etc)?How much time do you
expect to devote to YAC meetings and activities?*
I am currently involved in student council,leadership(Sophomore class officer),varsity softball,FCA and club softball 11
expect to devote as much time as necessary to YAC,as long as I prioritize my activities. Most of the activities i
participate in are flexible.So I think managing all my activities does not post an issue.

I think participating in my local government is important because,without students
participating adults do not get the chance to hear what we have to say. By being
involved in Youth Advisory Council I could help the adult leaders of my community
understand what it is like to be student leader,along with areas we could improve in.
Being able to voice your opinion with in your community is priceless. I also think the
chance to improve on speaking skills among adults and your peers is a great
opportunity.Another reason being a part of my city's youth council would be beneficial
is because I would get a taste of what real politics were like.Stepping up and leading
in my community run events would be great also.Such as food truck night, helping
bring my community together is something that I greatly hope to accomplish as a
Youth Advisory Council member. I hope to bring great ideas to the table and maybe
have more chances to bring everyone together. I hope to leave a great impact on the
youth advisory council. I hope I get the chance to make a difference in my
community.Overall I think being a part of the Youth Advisory Council would strongly
benefit me as a person. I believe I could grow as a young leader though this
opportunity. I could also benefit the organization by bringing an open mind and positive
attitude. I am willing to listen to others idea's and give my opinion on them as well as

I am usually described as calm and responsible and I make careful,calculated decisions regarding important issues.
As the president of my class I lead very intentionally but do not hesitate to seek guidance from other officers,adult
sponsors,and members of my class.

Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
When deciding on the layout and color of our class shirts, my officers and I were at a disagreement. Each of the four
of us had a different opinion on what the shirt should look like,and each was adamant in his or her belief.To resolve
the situation, I sought advice from the senior class officers,who had experience in shirt designing.With their help,
we were able to compromise and decide on a design that everyone appreciated.This example may seem trivial,but
it is an example of the importance of council and compromise.
Describe how you handle multiple responsibilities.For example, balancing schoolwork,afterschool activities,
family,etc.*
When I balance multiple activities, I create a priority checklist to ensure the most important aspects of each part of
my life are attended to in an efficient manner. I am able to be successful in multiple areas because of my time
management skills. Balancing activities is always slightly challenging,but it is an important life skill which I have
always been successful with it in the past.

I always try to depict myself in the most respectable and honest way p ossible. I don't typically spend an extraneous

occasionally communicate with friends. I always like to dress respectfully and maturely at and outside of school. I
make an effort to not be offensive in any way I present myself.

I would love to be a part of the decision making process involving the beautification and infrastructure of Kennedale.
Also,as a student at Kennedale High School,any decisions involving any school in the Kennedale School District

I believe that getting Kennedale's youth involved with city government is of utmost
importance. To educate the future generation of politicians is to ensure security in our
government for the future. The majority of the decisions made by city council and other city
government positions directly affects everyone in the city including the youth, so I believe that it
is vital for students such as myself to be included and be able to give opinions regarding certain
issues. As a YAC member I would seek to represent the voice of all of my peers, collecting and
sharing their ideas.
When I graduate from high school, I hope I will have left a lasting visible imprint on
Kennedale. I want to be an active part of a council that is known for accomplishing great things,
despite our youth. I believe that I have the necessary skills to be a productive member of the
council. I enjoy group discussion and have valuable ideas that can result in meaningful and in-
depth conversations. I also have organizational and time management skills that would make
me a valuable asset to the team.
I am a firm believer in the principle that there is always room for improvement. It is my
belief that being a part of such a prestigious organization requires the active analysis of issues,
and providing useful and practical solutions for them. I am excited to even think about being part
of such a prestigious organization and making a positive difference in my community. I hope my

Youth Advisory Council,
This year, I have had the honor and privilege of being a part of Carson Ham's educational
experience at Kennedale High School. I have served as Carson's Leadership teacher and Student Council
advisory. Being able to observe Carson in these rolls had shown me what a great leader, student, and
representative of KHS he is, and will be, in the future.
Carson has been a part of many of the clubs/organizations at Kennedale and has gained valuable
experience from these groups. Carson has served as class president for 2 years.This shows his ability to
guide, and gain respect, of his classmates. Carson has also been a member of the KHS Key Club for two
years,and Student Council representative for 2 years. Both of these clubs have allowed Carson the
opportunity to complete many hours of community service,which have allowed him to grow as a
person.
Aside from his club participation, Carson has also been a member of the Kennedale High band
that placed 5th in State this year. Being a member of the band had taught Carson how to work together
with many different personalities and come together for a mutual goal.
Carson is also very active in our academic teams at KHS. He was a district winner for Physics
and Editorial writing this year. He is also a member of the Computer Science Society. i have also been
able to observe Carson in the educational setting when I taught him in Spanish 2 Pre-AP last year.
Athletically, Carson has also proven himself as a leader as part of the KHS cross country team for
the last 2 years.
I would strongly recommend Carson Ham to be a part of your Youth Advisory Council. He will be

resolve the difference in opinion?*
The best way to deal with a different opinion is to compromise. Last year in chemistry we had to make atom models
with partners that were assigned to us.My partner wanted to do a simple 2D drawing while I wanted to do a more
elaborate 3D design.After days of fighting about the project,we decided to put the two together and created a partial
2D model with 3D aspects.As a result of the compromise,we got the highest grade in the class.

Being able to be involved in my community brings me excitement as a whole. I love planning events and being a part

I've always wanted to be involved in our community but never really knew how to
start. Participating in local government is important because your voice can be heard.
Instead of hearing people constantly complain about Kennedale I could be a part of
trying to make it better. I've always eager to improve the community. I always have
something to contribute,and I hate waiting around for someone else to get the job
done. I am filled with ideas and enthusiasm when it comes to being a leader and
playing an important role in something. Being involved is what makes you part of a
community.
I think being involved in my local government and community is important
because you get to have a say in what goes on in your city.As a leader in our
community the goal is to make a difference,to improve the things no one else will.
You can't see change in your city or it's government without being a part of it and
contributing to the cause.To see a change you have to be a change,and that's why I
think being involved in the community would be exciting.Also, participating in
community events and government would bring me closer to the city of Kennedale.
I hope to leave a large positive impact as a member of YAC. I want Kennedale
to be a closer city with more events that bring people closer together. I hope to
participate in community activities and maybe even start new ones. Being a part of

How do you feel your personality and leadership style would help the YAC to achieve its goals?
I am very responsible and cooperative. I like listening to everyone's opinions and I like knowing what everyone is
thinking. I am also very determine to get things done.

Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
One time a friend told me that they think cheer is easy and that it's not considered a sport. In my opinion I think
cheer is a sport but not everyone acknowledges all of the hardwork that's put into it. I just told them that it's very
hard and involves a lot of teamwork but they can think what they would like.

Describe how you handle multiple responsibilities.For example, balancing schoolwork,afterschool activities,

I do well with managing time. I am one of those people that doesn't like puting things off so I make sure I get
everything I need to get done finished.

I recently deleted all of my social media accounts. I don't want to be apart of the negativity that's on there. I thought
it would be best if I took a break from social media for a while.

I would like to become more familiar in the finance division. I think it would be interesting to see where the majority of
Kennedale's money is going.

I am currently involved in school cheer, PTA,student council,and my church group. I would do the best I can to
attend every meeting of YAC and participate in all of the volunteer work YAC is doing.

Essay
I think participating in your local government is important because you have the
privilege to have the say to what goes on in your community.Your opinion about
something that you think should be happening in your area is finally heard and it's
always a good thing to voice what you think.You get to be open-minded about new
ideas to help better your community and local government. If I got the chance to be
apart of YAC, I would like to try to make sure that all go the negative stuff going on at
the Kennedale Schools gets handled and resolved.

How do you feel your personality and leadership style would help the YAC to achieve its goals?
I believe that the best thing a city government can do is serve others,and I see YAC as an excellent opportunity to l
improve my community. I am very dedicated to volunteer projects and helping those around me. In the spring of 2015
alone, I have already helped our Student Council organize multiple service projects,and I also volunteer alone in my
spare time. I work well with others,and I do whatever it takes to get the job done.My outgoing,self-motivating
personality would greatly benefit the Youth Advisory Council.
Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
I have several siblings,and one year we couldn't agree on what to get my mom for Mother's Day. Everyone had
different ideas and opinions,and while they were all excellent,we couldn't possibly get them all.We quickly realized
that squabbling over what we would buy wasn't going to make her gift any better,so we decided to each make her a
card and then get her the book she'd been wanting.Although no one ended up buying the present we'd originally
wanted,we put aside our differences to focus on our goal---making our mom feel special.

I believe time management is the key to success and health. I juggle band,four AP classes,a part time job,
volunteer work and multiple clubs,and I've learned that the best way for me to keep track of everything is to keep an
organized planner and to always know what I need to do each day. It's important to make arrangements for the
weeks ahead,but I also think that I need to remember what I have to do this second in order to make sure everything
gets taken care of. In the past year, I've matured a lot and nearly perfected a system of organization.

I always want to behave like someone who would be a good role model,and I do everything I can to reflect that
intention in my actions. I always use my social media accounts to lift others up rather than tear them down,and I
focus on my passions rather than things I dislike.My goal is to be a positive,honest person that others can look up
to.

Are there specific areas of city government and the City Council decision making process that you find exciting
and would like to be a part of?*
I don't know much about how city government works,and I am excited to learn more about what exactly goes into
running a city. I'm interested in helping plan local events,such as the food truck night put on by the YAC. I am also
interested in attending City Council meetings to learn about how decisions are made within city government.

I am the Student Council historian at Kennedale High School,and I am also first chair in Kennedale's top band. I am
involved in the Computer Science Society and have competed with our U I L programming team. I am on five separate
U I L academic teams,and I work at Johnny Rockets in Six Flags Over Texas. In addition to my school activities, I
volunteer for two hours per week at All Star Equestrian in Burleson. I expect to devote at least three to four hours
weekly to YAC meetings and events,and am totally willing to give more time whenever necessary.

Essay
If one hopes to live in a better city,it is necessary to be active in the City Council
decision making process.As Americans,we are blessed with the opportunity to have
a voice in our local government. It is up to us to use that voice to make our city a
better place. I believe that the most important thing a citizen can do is participate in
city government and community activities.A community with great citizen
involvement is always happier and healthier than one without any citizen participation.
Our system of government truly puts the decisions in the hands of the people,and I
believe that is not only a citizen's right but also their duty to step forward and become
actively involved in community activities and issues. As a member of the YAC, I
hope to improve my city and make it a happier place to live. I would like to encourage
community involvement and build on existing programs to offer more exciting events
and services for my fellow citizens to enjoy. I think it would be really beneficial to
make an effort to plan more youth-centered programs and to put on events for
students of all ages. If selected to the Youth Advisory Council, I would do my best to
offer new ideas for service projects and to organize more great events like the ones
put on by the YAC in years'past. I am dedicated to improving my community and
offering opportunities to everyone.

Youth Advisory Council,
Last year, and this year, I have had the privilege of educating Katie Randolph for Spanish 2 Pre-
AP and Leadership. I have been able to observe her work ethic and dedication to her academic
successes. Katie has been extremely active during her high school career at Kennedale High School. She
has been involved in various academic organizations, as well as several of our clubs/organizations.
Ms. Randolph has been able to show her musical talents as part of the Kennedale band. She has
proven herself to be musically talented by being 152 chair in the symphonic band and a member of the
All-Region band, in 2013
Katie has also been a part of many clubs and organizations at KHS. These clubs have taught her
valuable leadership skills,while also allowing her to interact with various students, and personalities.
Katie has been in Student Council for two years. She has served as the StuCo Historian this year and has
been a representative for 2 years.
Katie has also been very active in our UIL Academics teams the last two years. Katie has placed
1st in Ready Writing, 2nd in Feature Writing, Yd in Computer Applications, and 5th in Informative
Speaking. All these awards show that Ms. Randolph is extremely talented in speaking and writing. A
talent that will greatly help your council.'

I have known Katie Randolph for the past two years as her Computer Science teacher. Katie has
been an amazing student and advocate for Computer Science. She has worked very hard in my
class and has gone above and beyond in so many instances. She has consistently worked ahead
of her peers in my class and consistently comes in after school to get better! I've personally
seen her take a leadership role without fear of getting her hands dirty for the benefit of the
cause. She is not afraid of hard work!
Katie has competed several times on my UIL Computer Science team and is very involved in
my Computer Science Society club. She is consistent in her attendance and relentless in her

I think that I have a"go-getter"personality and I'm willing to go the extra mile to get things accomplished. I work well
with others and I am a good listener which I think is a good quality for a leader to have. Before making a decision, I
will listen to what everyone has to say,so that I can make a more accurate judgment based on the situation. I am a
good problem solver. I think that this is an important quality to have as a leader because problems will always
happen when in a leadership position and it's necessary to find a solution or an alternative quickly so that things still
run smoothly.

Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
The way I handle a situation is different every time based on the circumstance.Sometimes I will let things go and
not say anything because I know that it is not worth arguing over.Other times, I will fight for what I think is right
because I know what is going on is wrong.As a leader, I am faced with situations where I have to deal with people
that have different opinions than I do. I believe that the important thing is to work cooperatively with that person and
compromise to reach the best outcome.

I have a very busy schedule and time management is essential to me. I am a good multi-tasker and I can juggle
many things that I have going on without cracking under the pressure. I am the type of person that needs something
to do which is part of the reason I am involved in so many activities. If I was not as involved, I wouldn't know what
to do with all of my free time!Sometimes it is difficult to manage maintaining A's in all advanced classes, being a
part of clubs, having a job,and playing volleyball. However, I always have enough time to get everything done that I
need to and still have time to spend with friends and family.

Keeping what I post on social media"clean"is very important to me. I make sure that I do not post anything that has
inappropriate language or content on it. I think that keeping my posts positive and not getting involved in online
arguments or cyber-bullying is also important. I want my social media to reflect who I am as a person,a person with
high morals and class,so I steer clear of posting or reposting things that would be deemed inappropriate for school
behavior. I also know that colleges look at applicants'social media and I do not want a post to affect my acceptance
into that school or getting a scholarship.

I like being a part of student government for many reasons. I like the creative process of brainstorming ideas for
various fundraisers and other activities. I also like the planning and organizing that goes into making an event
happen. In my opinion,the most gratifying thing of being a leader is at the end of a successful event when you know
that of your hard work has paid off.

I am currently involved in many activities and clubs. I am in student council, key club,student leadership, National

Vibe in Mansfield,about 15 hours each week.Although I am very involved in these clubs and organizations, I still

Essay
II think that participating in local government or in other leadership positions is
important for multiple reasons. I think that it is important to know what is going on in
your community and to try to improve it. Being a part of the Youth Advisory Council
would be a great way for me to get more involved in the city of Kennedale because
although I am highly involved in activities at my school, I am not involved in anything
that directly betters the city of Kennedale itself. I think that being involved in this
organization would be an amazing experience and opportunity for me to learn more
about city government and help contribute to make it better. I think that is important
for youth to be involved in city government because we are the future.Also, I think

YAC Advisory Council:
This year, I have had the honor and privilege of being Marissa Brennan's Leadership teacher, as
well as her Student Council sponsor. I have had ample opportunities to watch this remarkable young
lady show her leadership skills in various aspects of her school career.
In Leadership, I have been able observe Marissa as the junior class president. She has held this
position for 3 consecutive years. This is a strong sign of the respect that her classmates have for her, if
they have elected her all 3 years she has run for election,as the leader for her class. Her strong leadership
skills have shown in her creative, hardworking style. Marissa is also good at multi-tasking and coming up
with creative ideals to motivate her classmates. She was a good leader during her class' homecoming
hallway decorating. This activity also allowed her to motivate her fellow classmates to work hard to
complete the task of getting their hallway decorated.
Aside from also being very punctual, Marissa is a very intelligent young woman that has a very
bright future ahead of her. Her participation in many clubs and organizations at Kennedale have helped
mold her into a natural-born leader. She has been a part of Student Council for 3 years, Leadership class
2 years, Key Club 2 years, National Honor Society 1 year, National Spanish Honor Society 1 year and
Spanish Club 1 year. Marissa has also been a member of the KHS Volleyball team for 3 years.
All these clubs and organizations have helped Marissa gain valuable work ethics and leadership
skills. Ms. Brennan has completed over 60 hours of community service in the past two years at various
club service projects. Those have included working at Mission Arlington and various church activities.
Outside of her extremely busy school schedule, Marissa has also worked at Vintage Vibe, 15 hours
a week, since October 2014.
1 would strongly recommend Marissa Brennan as one of your members of your Youth Advisory
Council. She would bring lots of leadership, intelligence and hard work to your organization.

Re: Marissa Brennan
I have had the honor of having Marissa Brennan as a student in my Pre-AP Algebra 2 course, and as a
teacher's assistant. Over the course of those two years I have been able to get to know her as both as a
student and person.
Marissa is a dedicated student and as such takes her academic endeavors very seriously. As a student
she was dedicated and hard-working. She was a self-starter that could analyze her areas of weakness
and hone in on them. 'Almost'was never good enough for Marissa—she would keep going until she had
fully mastered something. Marissa loves a challenge and never turns one down. She maintains an
excellent GPA and leads her class academically. As a teacher's assistant, she's highly organized,
accurate, and quick. She follows instruction well but she also is able to determine what should be done
and make sure it gets down without being told. Her abilities have made my life as a teacher much more
pleasant and more streamlined.
Outside of class Marissa shines. She is well liked and a leader of people. She is involved with her high
school in the capacity of President of her class and puts those organizational skills and high intellect to
good use. She is consistently among the top performers in her grade. She motivates her fellow students
to participate in school-wide activities and leads by example. As chair of the Junior Class of 2015 1 have
worked closely with Marissa and I have entrusted her with a great deal. She has handled money
responsibly, keep accurate records,created proposals and been all that one could hope for in a
President.
Marissa Brennan is the type of student that is an asset to Kennedale High School, both in and out of our
campus. I feel she would represent the best we have to offer at all times. It is my honor and privilege to

How do you feel your personality and leadership style would help the YAC to achieve its goals?
My personality and leadership style would help the YAC to achieve its goals because I like to keep a positive attitude
and encourage others to work diligently. By keeping goals in mind,it is easier to work more efficiently. I like to lead
others by encouraging the organized sharing of opinions and discussion of ideas. More ideas can lead to more
creative projects and opportunities. Even though there may be conflicting ideas, keeping a positive attitude is critical
so brainstorming is a peaceful process.
Tell us about a time when you had to deal with an opinion that was different from your own. How did you
resolve the difference in opinion?*
During a Spanish Club officer meeting,three officers were in disagreement with our sponsor and me over whether a
typical three boxes of lollipops or six boxes of lollipops should have been ordered for a fundraiser.To come to a
resolution,we decided to work together to draft a list of pros and cons to ordering more lollipops than usual.After a
few minutes,we all willingly agreed to order five boxes.This was a successful decision because only half a box
remained when the fundraiser was over,and the profit was greater than any previous fundraiser.
Describe how you handle multiple responsibilities.For example, balancing schoolwork,afterschool activities,
family,etc.*
I handle multiple responsibilities through efficient time management and reminding myself why responsibilities are
important. It is easier to balance everything when time is managed effectively and time is taken to acknowledge the
importance of day to day activities. For example, I know that excelling academically will lead to success in college
and the work force.Clubs and jobs are opportunities to expand knowledge and meet people with similar interests.
Family and friends are most important because they support me however they can. By reminding myself of why
these responsibilities are important, it becomes easier to balance and manage everything.
What values do you publicly display through social networking sites, blogs, pictures,bumper stickers,
clothing,etc. How do you present yourself to the world?*
I like to present myself as someone pleasant and approachable.On social media, I like to share my thoughts in a
humorous but inoffensive manner.Social media is definitely a place where opinions are shared without much filtering,
so it is important to express oneself without being profane or offensive to others. I have never portrayed myself
inappropriately. I have made sure to dress appropriately for the occasion and to not post or display anything that
could be hurtful or offensive. I want people to feel comfortable with me since I believe I can contribute much to my
community.

Are there specific areas of city government and the City Council decision making process that you find exciting
and would like to be a part of?*
There are many areas of the city government and the City Council decision making process I would like to be a part
of. I would like to participate in the planning of events such as Art in the Park, Food Truck Night,and the Kennedale
Tree Lighting because they are events that bring the community together.After attending the informational meeting
and observing how a YAC meeting operates, I am more excited for planning events. I'm interested in providing a
youth perspective on issues since I know the opinions of youth can impact the city and its decisions.
In what other activities are you currently involved(sports,clubs,groups,job,etc)?How much time do you
expect to devote to YAC meetings and activities?*
At school, I am currently involved in the following clubs and organizations:Spanish Club,Green Club,Student
Council, Key Club, National Honor Society, National Spanish Honor Society,and U I L Academics for mathematics
and science. I am currently president of the Spanish Club,and I have previously served as the Historian and Public
Relations officer. During the summer, I work at Shoe Carnival.Considering how important the role of the YAC
member is, I would expect to devote a few hours each week towards meetings.As for activities, I expect to devote
as many hours as necessary to make the activities and events as successful as possible.

Participating in one's local government and community is important because it
is important to give back to others,especially those that have provided support over
the years. It is important to voice opinions and share ideas with the local government
so that improvements can be made and suggestions can be implemented. If there is a
looming problem in a city and nothing is said about it,then the city government will not
know there is a problem.The city government can only rectify a problem it knows
about. In Kennedale,there have been multiple requests for a recycling program,and
on Wednesday,April 1st, Kennedale's recycling program will begin. Decisions like
these are the result of participation in the local government and community.Since the
community deemed recycling an issue,it was addressed,and now there is a solution.
In addition to city programs, it is also important to be involved in community service
projects because many people in need are able to benefit from volunteer work and
donations. People in less fortunate circumstances are in need of things like food and
clothing,so it is critical that communities have service projects to provide for people
like this.
As a member of the YAC, I would like to benefit as many people as possible through
improvements in the city. I hope to participate in events the YAC is involved in such
as the Food Truck Night and Art in the Park. From the last YAC meeting, I know there
are plans to beautify certain areas of the city and convert empty space into functional
areas. I believe I would be able to contribute time and ideas to these projects.
As a member of the Youth Advisory Council, I want to leave a lasting impact.
I want the community in Kennedale to be able to look at something or attend an event
and think of how the YAC contributed to make it a success. I would like to be part of
this group that impacts the community in a positive way. In conclusion, I hope to be
one of the voices that can help Kennedale continue to improve.

Council. I have known Son for three years now, and from my experience with him I can tell you
he is an extraordinary, polite, dedicated, hard-working and talented young man, and I believe
the City of Kennedale will benefit greatly by having him serve on this council.
I have been fortunate to have Son as a student twice now, first in my Pre-AP Biology class
during his freshman year and again this year in AP Biology. As a student, Son is my highest
achiever. His attendance has always been excellent, he turns in every assignment, pays
excellent attention, has a strong work ethic, and always does his very best. I could not ask for a
better student. In addition to his dedication to his education, Son is highly dedicated to the
clubs to which he belongs. He has been in Spanish Club all three years of high school, serving as
Historian and Public Relations Officer his sophomore year and serving as President this year.
Son has also been a Student Council member, Key Club member, Green Club member, and has
competed in UIL math and science all three years of high school. In addition, he is a member of
the National Honor Society, National Spanish Honor Society, Leadership class, and Tennis team.
Throughout each school year since I first met Son, he has consistently demonstrated leadership
abilities and is a role model who students admire. Son is a great person with an amazing
personality, is always extremely polite and has a wonderful attitude. I truly admire the type of
person he is and his great character.
I recommend Son to serve on the Youth Advisory Council with great confidence. For three years
now he has continued to make me extremely proud of the person he is and his
accomplishments. With his dedication, dependability, and great character, I have no doubt that

young man! Son Nguyen is a very intelligent young man, a diligent worker, fast thinker,
creative, and has a wonderful personality.
As a teacher I have known Son for the past several years as his AP and Pre-AP
Spanish teacher. It has been a great pleasure to know this young man's dedication to
the Spanish Language and his other courses.
Academically, he is passing with high marks, placing him at the top ten percent of his
junior class. Son has demonstrated hard work and understanding. Since he was a
freshman, he has only taken Pre-AP and AP courses.
Outside of the classroom, Son is actively involved in extracurricular activities. He has
been part of each organization for the past two years or more. He is a member of
Green Club, Student Council, Key Club, National Honor Society, National Spanish
Honor Society, UIL Academics, (excelling both in Math and Science). Son is currently
the Spanish Club President and is in KHS Leadership course. Son has also been part of
KHS Tennis Team for the past two years.
Son is very active in the community and has done many hours of volunteer work.

I believe with my charismatic,ambitious,and organized personality I will be able to bring new ideas and events to
the Youth Advisory Council.After demonstrating my leadership skills in other organizations such as Spanish Club,
National Honors Society,and Fellowship of Christian Athletes, I hope my influence on this organization will help
better my school and community.

Last year, my English teacher had taken off ten points on my essay because I did not have a clear thesis.When
saw my grade, I was shocked, believing it was one of the most exceptional essays I wrote. I went home and
decided to read my essay again,highlighting the points I made in my paper that I mentioned in my thesis.The next
day, I talked to my teacher about it and asked her to reconsider my grade. By simply talking to her about my opinion
on the essay,she was able to fix my grade.

At Kennedale High School, I am involved in many extracurricular activities. I am a squad leader for the marching

on one thing at a time. Family is always first,then my school work,and lastly,extra curricular activities.

One aspect that I find really quite exciting in the YAC program is that the youth gets to express their ideas and help
out their community. By bringing awareness to certain issues,we will unite the student body and the community into

out with the food trucks. I believe I could be the candidate to help the council plan more programs and events in our
community.

As previously mentioned, I am a squad leader for the Kennedale Marching Band, parliamentary for Spanish Club,and

Athletes, National Spanish Honors Society, Friends of Rachel,and a Peer Academic Leader(PAL).While these
activities do take up a large amount of my time, I will try to make it to all of the Youth Advisory Council's meetings. I
believe it is crucial to attend all meetings and be involved in a club as much as possible.

I believe,as a young adult,it is important for me to be involved with my local
government in order to connect the youth at our schools with the community.The City
Council wants to hear the students'opinions and I think it is necessary that we take
this opportunity to fix the flaws we see in our system. I understand that the school
board does not see all the wrongs in our school and this organization will allow the
youth to bring up these issues. By participating in the community,you can create
bonds with other people who share your beliefs,working together to create something
big with equal knowledge and contribution. Helping people has always been important
to me and working with students who also have the same values is truly an honor.
Knowing that your opinions matter and having the chance to make a difference in
someone's life is what this program is all about.
With my acceptance into the Youth Advisory Council, I believe my leadership
skills will assist the City Council into making decisions that will improve our school
district and government. I also hope to help the council plan more social events for our
community,such as adding more festivities at Art in the Park and the food truck
gathering. I believe I could introduce the council to more programs to bring into
Kennedale like a book club or even a cooking class. Interacting with the community
and getting them involved is a very important aspect in the success of a government
and I believe I can help achieve this goal.This is a great opportunity for me to be the

Dear Youth Advisory Council,
I consider it a privilege to write a letter of recommendation for Noet Avila. Noet
has been a student in my Human Services courses and has been a member of the
Peer Assistance and Leadership Program during her junior year at Kennedale High
School. In sixteen years of teaching I have rarely encountered such a committed and
compassionate student. It has been my pleasure to be a part of Noet's educational
experience at Kennedale High School.
A select few students are accepted into PAL, a program in which juniors and
seniors mentor younger students in the elementary,middle and junior high schools
in Kennedale ISD. Noet was accepted her junior year and has shown herself to be a
compassionate and capable mentor. It is easy for younger students to open up to
Noet because she has a genuine interest in understanding and helping them deal
with their concerns. Noet is an excellent role model,not only for the young
children she works with, but also for her peers.
Noet is a highly organized, goal oriented young woman who sets high expectations
for herself. She strives to make the best grades possible and exhibits great respect
for the learning process. A very special quality of Noet's is her ability to motivate
others. When there is an important goal to be reached Noet will be cheerfully
urging and encouraging others to use their talents, gifts and skills to achieve
success. Kennedale students and teachers are drawn to her because she is a hard

Shai Roos will present the draft guidelines for the area described as a Downtown Village in the comprehensive
land use plan.The district is proposed to be made up of four sub-districts within an expanded Old Town district,
each allowing a different range of uses and varying in lot requirements.The sub-districts are:
1) Single family residential;
2) Single family residential and retail in single family design;
3)TownCenter; and
4) Mixed use.
In addition to standard zoning regulations such as permitted/prohibited uses, lot sizes, and setbacks,the
district guidelines also calls for using historically-appropriate designs for new structures. Illustrated standards
will be provided to make it easier for both staff and the public to understand what is required. Design
guidelines are intended to ensure that, whatever the land use, new development fits the desired character of
the area.
The Planning&Zoning Commission has already reviewed the first draft of the regulations and will be
considered adopting the regulations and rezoning properties accordingly during its May meeting. After Ms.
Roos' presentation during the work session, if you have any concerns that you would like to see addressed in
the draft ordinance, please let us know so that we can make changes to the ordinance before you have a public
hearing on it.

WHEREAS, today's society is finding more citizens involved in motorcycling on the roads of our
country; and
WHEREAS, motorcyclists are roughly unprotected and therefore more prone to injury or death in
a crash than other vehicle drivers; and
WHEREAS, campaigns have helped inform riders and motorists alike on motorcycle safety issues
to reduce motorcycle related risks, injuries, and, most of all, fatalities, through a comprehensive
approach to motorcycle safety; and
WHEREAS, it is the responsibility of all who put themselves behind the wheel, to become aware
of motorcyclists,regarding them with the same respect as any other vehicle traveling the highways
of this country; and it is the responsibility of riders and motorists alike to obey all traffic laws and
safety rules; and
WHEREAS, urging all citizens of our community to become aware of the inherent danger
involved in operating a motorcycle, and for riders and motorists alike to give each other the mutual
respect they deserve;

POLICY TYPE: EXECUTIVE LIMITATIONS
POLICY TITLE: GLOBAL EXECUTIVE CONSTRAINT
The City Manager shall not cause or allow any organizational practice, activity, decision, or
circumstance that is either unlawful, imprudent, or in violation of commonly accepted business and
professional ethics.
City operations are in compliance with the global constraint policy.
POLICY TYPE: EXECUTIVE LIMITATIONS
POLICY TITLE: TREATMENT OF CUSTOMERS OF CITY SERVICES
With respect to interactions with customers, the City AI anager shall not cause or allow conditions,
procedures,or decisions that are unsafe, untimely, undignified, or unnecessarily intrusive.
The City Manager will not:
1. Elicit information for which there is no clear necessity.
2. Use methods of collecting, reviewing, transmitting, or storing customer information that fail to
protect against improper access to the material
3. Operate facilities without appropriate accessibility and privacy.
4. Operate without establishing with customers a clear understanding of what may be expected and
what may not be expected from the service offered.
5. Operate without informing customers of this policy or providing a way to be heard for persons
who believe that they have not been accorded a reasonable interpretation of their rights under this
policy.

POLICY TYPE: EXECUTIVE LIMITATIONS
POLICY TITLE: TREATMENT OF STAFF
With respect to the treatment of paid and volunteer staff, the City Manager shall not cause or allow
conditions that are unfair, undignified,disorganized, or unclear.
The City Manager will not
1. Operate without written personnel rules that (a) clarify rules for stair, (b) provide for effective
handling of grievances,and (c) protect against wrongful conditions, such as nepotism and grossly
preferential treatment for personal reasons.
2. Retaliate against any staff member for non-disruptive expression of dissent.
3. Allow staff to be unaware of City Manager's interpretations of their protections under this policy.
4. Allow staff to be unprepared to deal with emergency situations.
City operations are in compliance with the treatment of staff policy. Staff is heavily involved in the preparation
of an asset management plan.
POLICY TYPE: EXECUTIVE LIMITATIONS
POLICYTITLE: EMERGENCY CITYMANAGER SUCCESSION
In order to protect the Council from sudden loss of the City Manager Services, the City Manager
shall not permit there to be less than one other person familiar enough with Council and City
Manager issues and procedures to be able to maintain organization services.
Kelly Cooper is the most informed of staffmembers.The department heads collectively are aware of
on-going activities and projects, and I have been more attentive to this in staff meetings.

I. CALL TO ORDER
Mayor Johnson called the meeting to order at 5:35 p.m.
II. WORK SESSION
*NOTE:Pursuant to Section 551.071, Texas Government Code, the City Council reserves the right to
adjourn into Executive Session at any time during the work session or the regular session to discuss posted
executive session items or to seek legal advice from the City Attorney on any item posted on the agenda.
A.Joint Work Session with Planning and Zoning Board
Planning and Zoning Commission
Present: Carolyn Williamson, Harry Browne, Stephen Brim,Thomas Pirtle, Ernest Harvey, Donald Rawe,
Billy Gilley
Absent: None
City Council met jointly with the Planning and Zoning Commission to discuss future planning projects
and issues of concern. Items discussed included the Senior Housing Project, Downtown Village, the
Development Code Updates, and development along Kennedale Parkway. It was agreed that Council and
the Planning and Zoning Commission would jointly meet again in September/October 2015.
B. Discussion of items on regular agenda
Rachel Roberts provided a review of the Comprehensive Zoning Code and Subdivision Regulations
update, stating that staff is recommending LSL Planning to provide services for the city code updates.
Rachel added that the scope of work would include a diagnostic of our existing code. Additionally, Staff is
recommending that a Development Code Advisory Committee be created to participate in the code
updates.
Rachel Roberts informed the group that the Consultants for the Downtown Village submitted a "Draft"
code to Planning and Zoning, noting that consideration of the code has been postponed in lieu of

suggested changes made by the Planning and Zoning Commission.
Bob Hart provided an update on the Senior Housing project, stating that staff is working to get them into
our tax reinvestment zone. He added that the project would have 137 units, which is equivalent of 56
homes under the TIRZ financing plan, and the investment would add approximately$14.5 million to the
taxable rolls in the TIRZ.
Bob Hart informed Council that some very preliminary discussions with TxDot have taken place
concerning access issues on Kennedale Parkway. He stated that he has met with the District Engineer
about eliminating the continuous left turn lanes and putting in medians. He added that it seems like a
favorable environment for the project.
Bob Hart reminded Council that the ICMA International Fellows would be here on May 2, 2015 and that
staff with hold a reception in their honor to welcome them on May 4, 2015 at 5:30 pm.

Ernest Harvey, 604 Oak Leaf Drive, Kennedale spoke in favor of Council's decision to implement
a citywide recycling program.

community interest, including but not limited to recognition of individual officials, citizens or departments,
information regarding holiday schedules, upcoming or attended events, etc.

A. Updates from City Council
Frank Fernandez stated that the Police Department did a great job on Saturday night at the Brickworks
Festival dealing with all the inclement weather.
B. Updates from the Mayor

2. Proclamation presentation in recognition of the Kennedale High School Lady Kats Soccer Team—
Class 4A State Champion Title
Mayor Johnson commended the Brickworks Committee for their work on the Festival. He noted that Bob
Hart finished first in his age group in the 5K Run; and Kelly Turner finished second in the pie eating
contest.
Mayor Johnson read aloud a proclamation in recognition of Autism Awareness Month.
Mayor Johnson read aloud a proclamation presented to the Kennedale High School Lady Kats Soccer
Team in recognition of the Team's Class 4A State Champion Title. Mayor Johnson and Councilman Kelly
presented each player a proclamation certificate.
C. Updates from the City Manager

City Manager Bob Hart informed Council that this would be Finance Director Sakura Moten-Dedrick's
last meeting, stating that she has accepted a position with the City of Keller. Additionally, he stated that
the City Marshall was unable to attend and he would review the Use of Force/Racial Profiling and the
Great Texas Warrant Round-Up items with Council.
Bob stated that each year, the City Marshal's Office is required to submit an annual racial profile report to
the City Council. Because it is not the policy of this agency to make traffic stops in the routine
performance of the Marshal's official duties, a full exemption report is being submitted to the Texas
Commission on Law Enforcement for 2014. The submitted report by the Marshal's Office is purely for
Councils information and reference only.
Bob stated that the Great Texas Warrant Round-Up was held February 20 through March 15. He noted
that while the city did in fact generate more revenue for 2015, it retained approximately$7,000 less for
the City compared to this same time last year. This variance is based on the manner in which each ticket's
revenue is allocated.

Bob noted that the Balanced Scorecard and Executive Limitations Reports were attached for Council's
review.
Bob provided some highlights from the Brickworks Festival noting that approximately 6,000 people came
through the gates for the festival, with 70 participants in the 5K run. A total of five (5) scholarships were
given to Kennedale students in the Arts, an increase from last year. He added that due to the storm on
Saturday night, forty vendor booths were damaged, however, twenty vendors have already signed up for
next year. He concluded stating that Kelly Cooper did a fabulous job with the festival this year.

A. Case#PZ 15-03 Public hearing and consideration of approval of Ordinance 569 regarding a city-
initiated request for a zoning change from "C-2" General Commercial district to "OT" Old Town district for
approximately 1.15 acres at 400 North Rd, legal description of Jacob Prickett Survey A-1225 Tract 3A.

1. Staff presentation by Rachel Roberts who explained that this request is to rezone property located in
the Old Town zoning district, located at 400 North Road. She stated that staff is requesting the change
from "C-2" to "OT". She added that a change to the Old Town zoning would be the best fit for the future
land use plan.

Commercial district at 7205 Hudson Village Creek Rd, legal description of Wade H Hudson Survey A-716
Tract 2.

1. Staff Presentation made by City Planner Rachel Roberts who reviewed the purposed zoning change
for 7205 Hudson Village Creek Road; stating that to the west of the property is a manufactured home
area and to the east is an industrial area. Rachel noted that it is designated as neighborhood on the
future land use plan; however, the City would like to add a buffer between the industrial area and the
neighborhood area; adding that the C-2 zoning would best serve as the transition and support the TIRZ
district which is pointed out in the static plan.

3. Staff Summary and Recommendation
Rachel stated that this is not expected to have an adverse impact on the surrounding properties and the
Planning and Zoning Commission recommends the approval.

C. Consider the selection of LSL Planning to provide the Comprehensive Zoning Code and Subdivision
Regulations Update, and authorize the City Manager to execute a contract in an amount not to exceed

Rachel Roberts provided a review of the Comprehensive Zoning Code and Subdivision Regulations
updates, stating that staff had four responses to their request for proposals. Staff looked closely at two
firms, SJR Planning and LSL Planning; with LSL raising to the top.
Staff is recommending LSL Planning to provide services for the City Code Updates; all their references
have been checked.
Motion Approve a contract with LSL Planning to provide the Comprehensive Zoning Code and Subdivision
Regulation Updates. Action Approve, Moved By Kelly Turner, Seconded By Liz Carrington.

D. Discuss and approve calendar for FY2015-2016 budget preparations.

A. Presentation of the Ethical Climate Survey
The City of Kennedale Ethical Climate and Organizational Culture Analysis was presented to City Council
by Cathy Vallejo,Jasmine Lazarky and Oscar Lazarky, students from the Management School of Business
Administration & Professional Programs at Texas Wesleyan University. Students were under
the leadership of Professors Dr. Trisha Anderson and Dr. Rodney Erakovich. The analysis presented was
based on a survey of city employees during the fall semester.
B. Presentation of the Citizens Survey
Kristina Ashton, Jorge Pineda, Michael McFarland, and Jessica Serrano members of the Capstone Class
from UTA presented a report to Council on the Citizen's Opinion Survey conducted by their class. The
survey was conducted during the spring semester.
C. Presentation of the Asset Management Plan
Tom Dawe and Matthew Van Dommelen from the Public Sector Digest and William Fowler, Katelyn
Francis, Kyle Gordon, Kathya Hattaway, Ryan Keenan, Jesica McEachern, and Cory Kyle from the UTA
Capstone class presented an analysis of the City of Kennedale Asset Management Plan, which examined
the cost of maintaining and replacing city assets over their life cycle.

A RESOLUTION AMENDING AUTHORIZED REPRESENTATIVES OF
TEXPOOL LOCAL GOVERNMENT INVESTMENT POOL
WHEREAS, the City of Kennedale (the "Participant") is a local government of the State of Texas
and is empowered to delegate to a public funds investment Pool the authority to invest funds and to
act as custodian of investments purchased with local investment funds; and
WHEREAS, it is in the best interest of the City of Kennedale to invest local funds in investments
that provide for the preservation and safety of principal, liquidity, and yield consistent with the
Public Funds Investment Act; and
WHEREAS, the TexasPool Local Government Investment Portfolio, a public funds investment
pool (a "Pool"), was created on behalf of entities whose investment objectives in order of priority
are preservation and safety of principal, liquidity, and yield consistent with the Public Funds
Investment Act.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF KENNEDALE,TEXAS:
A. That the City of Kennedale shall amend authorized representatives, for the purpose
of transmitting local funds for investment in the TexasPool series. The form of application
for amendment to this resolution is approved.
B. That the individuals, whose signatures appear in this Resolution, are Authorized
Representatives of the City of Kennedale and are each hereby authorized to transmit funds
for investment in the Pool and are each further authorized to withdraw funds from time to
time, to issue letters of instruction, and to take all other actions deemed necessary or
appropriate for the investment of local funds.
C. That the City of Kennedale may by Amending Resolution change Authorized
Representatives provided the additional Authorized Representative is an officer, employee,
or agent of the City of Kennedale.

This is an annual agreement under which Tarrant County serves as the tax assessor and collector for the
City of Kennedale, Texas. The agreement is substantially the same in form as it has been for several
years. The main factor which generally changes from year to year is the costs that are charged by Tarrant
County to mail out tax statements.
For the 2015 Tax Year (FY2014-2015), the fee will be $1.10 cents per parcel. The prior year fee was
$1.10. This represents no change.
The City of Kennedale will be invoiced for all accounts based on the October billing roll certified to the
Tarrant County Tax Assessor/Collector by January 15 and payment must be received by February 15.
The contract must be executed and returned to the Tarrant County Tax Office no later than July 32, 2015.

I am pleased to enclose our tax collection contract for the coming year. Our collection fee for the coming year will
remain at$1.10 per property tax account,the lowest collection fee of any urban county in Texas. The fee for out of
county accounts will remain$2.60 per account
State law requires that I charge taxing entities my actual costs for tax collection.
Enclosed are three original renewal contracts for the assessment and collection of your ad valorem taxes by Tarrant
County for the tax year 2015. After the contracts have been signed,please return ALL copies to my office to the
attention of Sheila Moore,Entity Liaison. I will mail a fully executed contract to you after the Commissioner's
Court has made formal approval of the contract. This will be at the end of September,so the contract will be
returned in October. If you require more than one original,please make a copy of the contract and mail all four
back to my office. In order to have your contract in place prior to the upcoming tax season, I would ask that you
have the properly executed contract returned to me no later than July 31,2015.
In addition to your 2015 contract, I am enclosing an attorney confirmation form. Please fill out the requested
information,sign and return to my office along with the collection contracts.
You will be invoiced for your collection commission by January 31,2016 with payment due no later than
February 28,2016.
The time for rate calculations is rapidly approaching and many of you are already in budget preparations. Please
remember the importance of getting the rate and exemption information to us prior to the September 16`x'rate €
submission deadline. My office will provide more information on this requirement in the near future.

§ Agreement For the Collection of Taxes
COUNTY OFTARRANT §
Agreement made this day of 2015, by and between the Tarrant County Tax
Assessor/Collector,hereinafter referred to as ASS>� SOR/COLLECTOR, and Tarrant County, hereinafter referred to
as the COUNTY, both of whom are addressed at 1100 E. Weatherford Street, Fort Worth, Texas 76196-0301, and the
City of Kennedale hereinafter referred to as City,whose address is 405 Municipal Dr,Kennedale,TX 76060.
PURPOSE OFAGREEMENT
The purpose of this Agreement is to state the terms and conditions under which the ASSESSOR/COLLECTOR will
provide assessment and collection services of Ad Valorem taxes levied by the City.
NOW THEREFORE,in consideration of the mutual promises herein contained,the parties hereto agree as follows:

SERVICES TO BE PERFORMED
The ASSESSOR/COLLECTOR agrees to bill and collect the taxes due and owing on taxable property upon which the
City has imposed said taxes. The ASSESSOR/COLLECTOR shall perform the said services in the same manner and
fashion as Tarrant County collects its own taxes due and owing on taxable property. The services performed are as
follows: receiving the Certified Appraisal Roll from the appropriate Appraisal District and monthly changes thereto;
providing mortgage companies, property owners and tax representatives, tax roll and payment data; providing all
necessary assessments of taxes and Truth in Taxation calculations as required;the transmittal of tax statements via the
U.S. Mail or electronic transfer of data; and payment processing. All City disbursements, made by check or by
electronic transfer(ACH),for collected tax accounts will be made to the City on the day the COUNTY Depository Bank
indicates the mandatory assigned"float"period has elapsed and the funds are posted to the collected balance.If any daily
collection total is less than one hundred dollars($100.00),the disbursement may be withheld until the cumulative total of
taxes collected for the City equals at least one hundred dollars($100.00),or at the close of the month.
II.

The ASSESSOR/COLLECTOR will provide the City the following reports,if requested:

A selection of the above listed Reports will only be available by internet access. The ASSESSOR/COLLECTOR will
provide the City the General Ledger Revenue & Expense Report monthly as required by Sec. 31.10 of the Texas
Property Tax Code.
III.
COMPENSATION
In consideration of the services to be performed by the ASSESSOR/COLLECTOR, compensation for the services
rendered is a rate of one-dollar and ten cents ($1.10)per account located within Tarrant County, and two-dollars and
sixty cents($2.60)per account located outside Tarrant County. The number of accounts billed will be based on the July
25 billing roll certified to the ASSESSOR/COLLECTOR,net of subsequent account additions and deletions made by the
Appraisal District. The ASSESSOR/COLLECTOR will invoice for these accounts by January 31,2016 with payment
to be received from the City by February 28,2016.
The scope of services identified in this contract does not include the administration of a rollback election. In the event of
a successful rollback election,these costs incurred by the Tarrant County Tax Office will be separately identified,billed,
and paid by the entity.
IV.
AUDITS
The ASSESSOR/COLLECTOR will provide to the City auditor necessary explanations of all reports and access to
ASSESSOR/COLLECTOR in-house tax system computer terminals to assist the City auditor in verifying audit samples
of the financial data previously provided by the ASSESSOR/COLLECTOR during the past audit period. Additional
support for entity verification or entity auditor verification is not a part of this contract. Each request for support will be
reviewed individually. Costs for providing audit support will be determined by the ASSESSOR/COLLECTOR and will
be charged to and must be paid by the City.
V.
TAX RATE REQUIREMENT
The City will provide the ASSESSOR/COLLECTOR, in writing, the City's newly adopted tax rate and
exemption schedule to be applied for assessing purposes by Wednesday, September 16,2015. Under authority of
Section 31.01 (h) of the Property Tax Code, any additional cost of printing and mailing tax statements because of late
reporting of the tax rate or the exemption schedule will be charged to and must be paid by the City.
The tax rate and the exemption schedule for each of the last five(5)years in which an ad valorem tax was levied,or all
prior years where there remains delinquent tax, must be furnished in writing to the ASSESSOR/COLLECTOR at the
time of the initial contract.
VI.
COMPLIANCE WITHAPPLICABLE
STATUTES, ORDINANCES,AND REGULATIONS
In performing the services required under this Agreement, the ASSESSOR/COLLECTOR shall comply with all
applicable federal and state statutes,final Court orders and Comptroller regulations. If such compliance is impossible for
reasons beyond its control,the ASSESSOR/COLLECTOR shall immediately notify the City of that fact and the reasons
therefore.
VII.
DEPOSIT OF FUNDS
All funds collected by the ASSESSOR/COLLECTOR in the performance of the services stated herein for the City shall
be promptly transferred to the account of the City at the City's depository bank. All payments to entities will be made
electronically by the automated clearing house (ACH). The ASSESSOR/COLLECTOR has no liability for the funds
after initiation of the ACH transfer of the City's funds from the COUNTY Depository to the City's designated
depository.
VIII.
INVESTMENT OF FUNDS
The City hereby agrees that the COUNTY, acting through the COUNTY Auditor,may invest collected ad valorem tax
funds of the City during the period between collection and payment. The COUNTY agrees that it will invest such funds
in compliance with the Public Funds Investment Act. The COUNTY further agrees that it will pay to the City all interest
or other earnings attributable to taxes owed to the City. All parties agree that this Agreement will not be construed to
lengthen the time period during which the COUNTY or the ASSESSOR/COLLECTOR may hold such funds before
payment to the City.
REFUNDS
Refunds will be made by the ASSESSOR/COLLECTOR except as set forth herein. The ASSESSOR/COLLECTOR
will advise the City of changes in the tax roll which were mandated by the appropriate Appraisal District.
The ASSESSOR/COLLECTOR will not make refunds on prior year paid accounts unless the prior year paid accounts
for the past five(5)years are provided to the ASSESSOR/COLLECTOR.
All refunds of overpayments or erroneous payments due, but not requested, and as described in Section 31.11 of the
Texas Property Tax Code,will after three years from the date of payment,be proportionately disbursed to those entities
contracting with the ASSESSOR/COLLECTOR. The contract must have been in force,actual assessment and collection
functions begun and the tax account was at the time of the over or erroneous payment within the City's jurisdiction. The
proportional share is based upon the City's percent of the tax account's total levy assessed at the time of receipt of the
over or erroneous payment.
In the event any lawsuit regarding the collection of taxes provided for in this agreement to which the City is a party, is
settled or a final judgment rendered, and which final judgment is not appealed, and the terms of such settlement
agreement or final judgment require that a refund be issued by the City to the taxpayer, such refund shall be made by
ASSESSOR/COLLECTOR by debiting funds collected by ASSESSOR/COLLECTOR on behalf of the City and
remitting such refund to the taxpayer in conformity with the terms of the settlement agreement or final judgment.
X.
DELINQUENT COLLECTIONS
The ASSESSOR/COLLECTOR will assess and collect the collection fee pursuant to Sections, 33.07, 33.08, 33.11 and
33.48 of the Property Tax Code, when allowed. The ASSESSOR/COLLECTOR will collect attorney fees that are
specified by the City through written agreement with a delinquent collection Attorney. The ASSESSOR/COLLECTOR
will disburse the amount directly to the City for compensation to a Firm under contract to the City.
If the delinquent collection Attorney contracted by the City requires attendance of ASSESSOR/COLLECTOR personnel
at a court other than the District Courts in downtown Fort Worth, and the COUNTY is not a party, the employee's
expenses and proportionate salary will be the responsibility of the City and will be added to the collection expenses and
charged to the City.
The ASSESSOR/COLLECTOR will not be responsible for the collection of prior year delinquent accounts unless all
delinquent accounts information is provided to the ASSESSOR/COLLECTOR.

TERM OFAGREEMENT
This Agreement shall become effective as of the date hereinabove set out,and shall continue in effect during the 2015
tax year,unless sooner terminated by providing sixty(60)day written notice,as outlined in paragraph XII.

NOTICES
Any notices to be given hereunder by either party to the other may be effected,in writing,either by personal delivery or
by mail,registered or certified,postage prepaid with return receipt requested. Mailed notices shall be addressed to the
address of the parties as they appear in the introductory paragraph of this Agreement, but each party may change this
address by written notice in accordance with this paragraph.
XIII.
MISCELLANEOUS PROVISIONS
This instrument hereto contains the entice Agreement between the parties relating to the rights herein granted and
obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force or
effect.
This Agreement shall be construed under and in accordance with the laws of the State of Texas,and all obligations of the
parties created hereunder are performable in Tarrant County,Texas.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal
representatives and successors.
In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid,illegal,
or unenforceable in any respect, such invalidity, illegality, or enforceability shall not affect any other provision hereof
and this Agreement shall be construed as if such invalid,illegal,or unenforceable provisions had never been contained.
This Agreement and the attachments hereto constitutes the sole and only agreement of the parties hereto and supersedes
any prior understandings or written or oral agreements between the parties respecting the within subject matter.

The City of Kennedale is a member of a 153-member city coalition known as the Steering Committee of
Cities Served by Oncor. The resolution approves the assessment of an eleven cent ($0.11) per capita fee
to fund the activities of the Steering Committee.
The Steering Committee undertakes activities on behalf of municipalities for which it needs funding
support from its members. Municipalities have original jurisdiction over the electric distribution rates and
services within the city. The Steering Committee has been in existence since the late 1980s. It took on a
formal structure in the early 1990s. Empowered by city resolutions and funded by per capita
assessments, the Steering Committee has been the primary public interest advocate before the Public
Utility Commission, ERCOT, the courts, and the Legislature on electric utility regulation matters for over
two decades.
The Steering Committee is actively involved in rate cases, appeals, rulemakings, and legislative efforts
impacting the rates charged by Oncor Electric Delivery Company, LLC within the City. The Steering
Committee representation is also strong at ERCOT. It is possible that additional efforts will be necessary
on new issues that arise during the year, and it is important that the Steering Committee be able to fund
its participation on behalf of its member cities. A per capita assessment has historically been used, and is
a fair method for the members to bear the burdens associated with the benefits received from that
membership.

WHEREAS, the City of Kennedale is a regulatory authority under the Public Utility Regulatory
Act (PURA) and has exclusive original jurisdiction over the rates and services of
Oncor Electric Delivery Company, LLC (Oncor) within the municipal boundaries
of the city; and
WHEREAS, the Steering Committee has historically intervened in Oncor rate proceedings and
electric utility related rulemakings to protect the interests of municipalities and
electric customers residing within municipal boundaries; and
WHEREAS, the Steering Committee is participating in Public Utility Commission dockets and
projects, as well as court proceedings, and legislative activity, affecting
transmission and distribution utility rates; and
WHEREAS, the City is a member of the Steering Committee of Cities Served by Oncor; and
WHEREAS, the Steering Committee functions under the direction of an Executive Committee
(whose current members are identified in Attachment 1) which sets an annual
budget and directs interventions before state and federal agencies, courts and
legislatures, subject to the right of any member to request and cause its party
status to be withdrawn from such activities; and
WHEREAS, the Executive Committee in its December 2014 meeting set a budget for 2015 that
compels an assessment of eleven cents ($0.11)per capita; and
WHEREAS, in order for the Steering Committee to continue its participation in these activities
which affects the provision of electric utility service and the rates to be charged, it
must assess its members for such costs.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KENNEDALE, TEXAS:
I.
That the City is authorized to continue its membership with the Steering Committee of
Cities Served by Oncor to protect the interests of the City of Kennedale and protect the interests
of the customers of Oncor Electric Delivery Company, LLC residing and conducting business
within the City limits.

Consider approval of Resolution 452 approving a negotiated settlement between the atmos cities steering
committee and Atmos Energy Corp., mid-tex division regarding the company's 2014 and 2015 rate review

III. Summary:
The City, along with other similarly situated cities served by Atmos Energy Corp., Mid-Tex Division
("Atmos Mid-Tex" or"Company"), is a member of the Atmos Cities Steering Committee ("ACSC"). The
RRM Tariff was adopted by the City as an alternative to the Gas Reliability Infrastructure Program
("GRIP"), the statutory provision that allows Atmos to bypass the City's rate regulatory authority to
increase its rates annually to recover capital investments. In February 2014, Atmos Mid-Tex filed its
second annual filing under the Rate Review Mechanism ("RRM") Tariff, seeking an increase of$45.7
million. Although ACSC attempted to reach a settlement with the Company as it had in past years, the
wide differences between the Company and ACSC's consultants' recommendations made a compromise
impossible. On the recommendation of the ACSC Executive Committee and ACSC's legal counsel, the
City in 2014 adopted a Resolution denying the requested rate increase.
The Company appealed the City's denial to the Railroad Commission of Texas ("Commission"), and
revised its requested increase to $43.8 million. A hearing was held on the Company's appeal on
September 3, 2014. On April 28, 2015, the Commission's Hearings Examiner issued his Proposal for
Decision ("PFD") in the Company's appeal of the City's denial of the 2014 RRM rate increase. This PFD
was not favorable to ACSC, but did recommend a reduction of approximately $860,000 to the Company's
adjusted 2014 filing.
While the parties were waiting for the PFD from the Hearings Examiner in the appeal of the 2014 RRM
filing, on February 27, 2015, Atmos Mid-Tex filed with the City another rate increase request under the
RRM Tariff, seeking additional revenues in the amount of$28.762 million (total system) or$24.0 million
(affected cities). The City worked with ACSC to analyze the schedules and evidence offered by Atmos
Mid-Tex to support its 2015 request to increase rates. The Resolution and attached Settlement
Agreement and tariffs are the result of negotiation between the Mid-Tex Executive Committee and the
Company to resolve issues raised by ACSC during the review and evaluation of Atmos Mid-Tex's filing.
The recommended Settlement Agreement also requires Atmos to abate its appeal of the City's rejection
of the 2014 RRM rate increase pending approval by all ACSC cities of the Settlement Agreement. The
Agreement requires Atmos to give the City the benefit of the adjustments to the 2014 rate increase
recommended by the PFD.
The Resolution and Settlement tariffs approve rates that will increase the Company's revenues by$65.7
million for the Mid-Tex Rate Division, effective for bills rendered on or after June 1, 2015. The monthly
residential customer charge will be $18.60. The consumption charge will change from $0.08819 per Ccf
to $0.09931 per Ccf. The monthly bill impact for the typical residential customer consuming 60 Ccf will be
an increase of$1.14 (about a 1.59% increase in the base bill). The typical commercial customer will see
an increase of$2.69 or 0.96%.
The ACSC Executive Committee and its designated legal counsel and consultants recommend that all
Cities adopt the Resolution approving the negotiated Settlement Agreement resolving both the 2014 and
the 2015 RRM filings, and implementing the rate change.

ATTACHED RATE TARIFFS AND PROOF OF REVENUES; DECLARING EXISTING
RATES TO BE UNREASONABLE; ADOPTING TARIFFS THAT REFLECT RATE
ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED SETTLEMENT; FINDING
THE RATES TO BE SET BY THE SETTLEMENT TARIFFS TO BE JUST AND
REASONABLE AND IN THE PUBLIC INTEREST; REQUIRING THE COMPANY TO
REIMBURSE ACSC'S REASONABLE RATEMAKING EXPENSES; DETERMINING
THAT THIS RESOLUTION WAS PASSED IN ACCORDANCE WITH THE
REQUIREMENTS OF THE TEXAS OPEN MEETINGS ACT; ADOPTING A SAVINGS
CLAUSE; DECLARING AN EFFECTIVE DATE; AND REQUIRING DELIVERY OF
THIS RESOLUTION TO THE COMPANY AND THE ACSC'S LEGAL COUNSEL.
WHEREAS, the City of Kennedale, Texas ("City") is a gas utility customer of Atmos
Energy Corp., Mid-Tex Division ("Atmos Mid-Tex" or "Company"), and a regulatory authority
with an interest in the rates and charges of Atmos; and
WHEREAS, the City is a member of the Atmos Cities Steering Committee ("ACSC"), a
coalition of similarly-situated cities served by Atmos Mid-Tex ("ACSC Cities") that have joined
together to facilitate the review of and response to natural gas issues affecting rates charged in
the Atmos Mid-Tex service area; and
WHEREAS, ACSC and the Company worked collaboratively to develop a new Rate
Review Mechanism ("RRM") tariff that allows for an expedited rate review process by ACSC
Cities as a substitute to the Gas Reliability Infrastructure Program ("GRIP")process instituted by
the Legislature, and that will establish rates for the ACSC Cities based on the system-wide cost
of serving the Atmos Mid-Tex Division; and
WHEREAS, the initial RRM Tariff was in effect for four(4)years; and

WHEREAS, ACSC Cities and Atmos Mid-Tex entered into another settlement agreement
and revised the RRM Tariff; and
WHEREAS, ACSC Cities and Atmos Mid-Tex compromised and reached agreements on
the amount of the rate increases to be in effect for the RRM Tariff filings for 2012 and 2013; and
WHEREAS, ACSC Cities and Atmos Mid-Tex were unable to reach an agreement on the
2014 RRM Tariff filing, resulting in the ACSC Cities' rejection of the 2014 RRM filing; and
WHEREAS, Atmos Mid-Tex appealed the ACSC Cities' actions rejecting its 2014 RRM
filing to the Railroad Commission of Texas ("Commission"), pursuant to the provisions of the
RRM Tariff, and
WHEREAS, Atmos Mid-Tex and ACSC litigated the appeal of the 2014 RRM filing at
the Commission; and
WHEREAS, on February 27, 2015, Atmos Mid-Tex filed its 2015 RRM Tariff filing,
requesting to increase natural gas base rates system-wide by $28.762 million; and
WHEREAS, ACSC coordinated its review of Atmos Mid-Tex RRM filing through its
Executive Committee, assisted by ACSC's attorneys and consultants, to resolve issues identified
in the Company's RRM filing; and
WHEREAS, Atmos Mid-Tex has agreed to withdraw its appeal of ACSC's rejection of
its 2014 RRM Tariff rate increase; and
WHEREAS, the Executive Committee, as well as ACSC's counsel and consultants,
recommend that ACSC Cities approve the attached Settlement Agreement (Attachment A to this
Resolution) as well as the tariffs attached thereto, resolving both the 2014 and the 2015 RRM
Tariff filings, which together will increase the Company's revenues by $65.7 million over the
amount allowed under City-approved rates set in 2013; and

WHEREAS, the attached tariffs implementing new rates are consistent with the
negotiated Settlement Agreement and are just, reasonable, and in the public interest; and
WHEREAS, the RRM Tariff should be renewed for a period of time commencing in
2016 and continuing until the RRM Tariff is suspended by ordinance of the City; and
WHEREAS, the RRM Tariff contemplates reimbursement of ACSC's reasonable
expenses associated with RRM applications;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KENNEDALE, TEXAS:
Section 1. That the findings set forth in this Resolution are hereby in all things approved.
Section 2. That the City Council finds that the Settlement Agreement (Attachment A to
this Resolution) represents a comprehensive settlement of gas utility rate issues affecting the
rates, operations, and services offered by Atmos Mid-Tex within the municipal limits arising
from Atmos Mid-Tex's 2014 and 2015 RRM filings, is in the public interest, and is consistent
with the City's authority under Section 103.001 of the Texas Utilities Code.
Section 3. That the existing rates for natural gas service provided by Atmos Mid-Tex are
unreasonable. The new tariffs attached hereto and incorporated herein as Attachment C, are just
and reasonable, and are designed to allow Atmos Mid-Tex to recover annually an additional
$65.7 million in revenue over the amount allowed under currently approved rates, or $21 million
over currently-billed rates, as shown in the Proof of Revenues attached hereto and incorporated
herein as Attachment B; such tariffs are hereby adopted.
Section 4. That the ratemaking treatment for pensions and other post-employment
benefits in Atmos' next RRM filing shall be as set forth on Attachment D, attached hereto and
incorporated herein.

Section 5. That in an effort to streamline the regulatory review process, the Atmos Mid-
Tex RRM Tariff is renewed for a period commencing with the Company's March 1, 2016 RRM
filing for calendar year 2015, effective June 1, 2016, and continuing thereafter until such time as
the City adopts an ordinance suspending operation of the RRM Tariff.
Section 6. That Atmos Mid-Tex shall reimburse the reasonable ratemaking expenses of
the ACSC in processing the Company's RRM application.
Section 7. That to the extent any resolution previously adopted by the Council is
inconsistent with this Resolution, it is hereby repealed.
Section 8. That the meeting at which this Resolution was approved was in all things
conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code,
Chapter 551.
Section 9. That if any one or more sections or clauses of this Resolution is adjudged to
be unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remaining
provisions of this Resolution and the remaining provisions of the Resolution shall be interpreted
as if the offending section or clause never existed.
Section 10. That consistent with the City ordinance that established the RRM process,
this Resolution shall become effective from and after its passage with rates authorized by
attached tariffs to be effective for bills rendered on or after June 1, 2015.
Section 11. That a copy of this Resolution shall be sent to Atmos Mid-Tex, care of Chris

AN ORDINANCE OF THE CITY OF KENNEDALE, TEXAS
APPOINTING THE JUDGE AND ASSOCIATE JUDGES OF THE
MUNICIPAL COURT OF RECORD IN THE CITY OF KENNEDALE;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Kennedale, Texas is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Local Government Code; and
WHEREAS, the City Council has created a municipal court of record pursuant to
Chapter 30 of the Texas Government Code; and
WHEREAS, Chapter 30 of the Texas Government Code relating to municipal courts of
record provides that the judge of the municipal court of record shall be appointed by the City
Council by ordinance; and
WHEREAS, the workload of the Kennedale Municipal Court is not large enough to
support a full time Municipal Court Judge; and
WHEREAS, it is of great benefit to the City of Kennedale to have an experienced
municipal court judge sit on the bench of the municipal court of the City of Kennedale; and
WHEREAS, Section 574.001, Texas Government Code requires that a finding be made
to the effect that a person who serves as an officer in more than one appointed position obtain a
finding from the governing body that such officer has satisfied Article XVI, Section 40, of the
Texas Constitution; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF KENNEDALE, TEXAS:
SECTION 1.
It is hereby found that the office of municipal court judge of the City of Kennedale is of
benefit to the State of Texas and to the City of Kennedale and that there is no conflict between
the office of municipal court judge of Kennedale and the office of municipal judge in any other
city.
SECTION 2.
William "Bill" Lane is hereby reappointed as the Municipal Judge of the municipal court
of record in the City of Kennedale, Texas for a one year term beginning May 1, 2015. At the
expiration of said term, in accordance with Article 16, Section 17 of the Texas Constitution,
Judge Lane shall continue to serve until his successor shall be duly qualified.
SECTION 3.
Craig Magnuson and Erin Bakker are hereby appointed as the associate judges to serve
when the Municipal Judge is temporarily absent or unable to serve.
SECTION 4.
This ordinance shall be cumulative of all other ordinances of the City of Kennedale, and
shall not repeal any of the provision of such ordinances except in those instances when
provisions of such ordinances are in direct conflict with the provisions of this ordinance, in
which the event the conflicting provisions of such ordinances are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 6.
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.

The current handbook was last updated September 2012. Staff continues to evaluate current policy with
best practices and trends in the local government and compares current policies and benefits with other
area cities to ensure the city remains competitive.
The policy changes proposed are changes that will allow the city to remain competitive with benefit
structures for employees who are leaving employment in good standing. Currently, when an employee
resigns, he/she is eligible for payment of earned vacation (up to 160 hours) and a portion of accrued sick
time (min of 20% to a maximum of 60%). The attached document shows that the majority of metroplex
cities surveyed allow for payment of all earned vacation to the maximum accrual. In addition, six of the
eight cities surveyed do not pay out any sick leave when an employee resigns. There are two cities that
pay a portion of sick leave accrual if employed for a minimum of five to10 years. Giving consideration for
current turnover trends, the need to remain competitive is important.
In addition to vacation and sick leave policy changes, staff is also recommending a change in the
probationary period for new hire employees in police and fire departments. The current policy allows one
year for evaluation, however it takes almost an entire year to get a new hire through the academy and
field training program. This provides no time for the command staff to evaluate on the job performance
effectiveness. This policy change will correct this issue.
The management team has reviewed and also recommends these changes.

4.6 PAID VACATION LEAVE
Compensation For Leave Time. Vacation leave is paid at the employee's base
pay rate at the time of vacation. Vacation leave will be paid only for time that

Probationary Employees. Newly hired, probationary employees are not eligible

4.8 SICK LEAVE
Eligibility. All regular full-time employees begin accruing paid sick leave during
their first full pay period of employment. Part-time, temporary and seasonal
employees do not accrue sick leave. Employees may use sick leave as it
accrues.
Payment for Unused Sick Leave. Employees who terminate employment in
good standing (Section 8.1), have not been terminated for disciplinary reasons,
and have been employed for five years, are eligible to receive compensation
for a portion of their accrued sick leave. No compensation will be paid unless
the employee has accrued a minimum of 101 hours, then compensation will be
calculated as a percent of the employee's regular hourly rate as listed below,
rounded to the nearest hour.

Using the accrued sick leave compensation schedule, an employee with 210
accrued sick leave hours would be paid 30 percent of their hourly rate for those
210 hours upon separation from employment. The maximum sick leave
payment would be 60 percent of an employee's hourly rate times 600 hours
unless specified differently in the City Charter, Ordinance or employment
agreement.
8.1 TYPES OF SEPARATION
Resignation. To resign "in good standing," the City requires that employees give
at least two weeks advance written notice, return all City-issued property, pay
all debts owed to the City, and attend an exit interview before terminating their
employment so that an orderly transition can be made. Employees who resign
in good standing may be eligible for payment of unused vacation (Section 4.6),
sick leave (Section 4.8, after 5 years employment) and accrued longevity
(Section 3.11 ). Employees who resign are asked to furnish written notice to their
supervisor or Department Head, giving the reasons for and the effective date of
their resignation. Employees who fail to give a two-week notice will not be paid
for unused vacation and sick leave nor accrued longevity, and may not be
eligible for rehire.
2.7 PROBATIONARY EMPLOYEES
All newly hired or rehired employees hired to fill a regular role and employees
who have been promoted must satisfactorily complete a probationary period.
During an employee's probationary period, the employee has no appeal rights
for disciplinary actions. Temporary employees do not serve a probationary
period and have no appeal rights. Only those employees who meet
acceptable performance and other standards during their probationary period
will be retained as employees. If an employee successfully completes his/her
probationary period he/she is still employed at the will of the City; the employee
will, however, have a right to appeal disciplinary action, as set forth in the City's
Employee Appeals policy.
Probationary Periods. Probationary periods are as follows:
A one year probationary period will apply for all newly hired or promoted sworn
and non-sworn public safety employees. Probation begins after completion of
the required FTO training. and then oontini ioc for o period of Six Months.
A six month probationary period will apply to all other newly hired or promoted
employees of the City.
A probationary employee is ineligible for a pay increase and probationary
employee has no right to appeal disciplinary actions.
The probationary period may be extended up to an additional 90 days if the
employee's performance has been marginal and/or if the employee has missed
a substantial amount of work time during the probationary period due to
extenuating circumstances. Any extensions to a probationary period must be
recommended by the Supervisor and agreed jointly by Human Resources, the
MoR, Department Head and the City Manager.
Employees are required to successfully complete their probationary period (and
any extensions thereof) before they are eligible for transfer or promotion unless
otherwise approved by the City Manager.
An employee who is re-employed, demoted, or transferred to another role as
part of a disciplinary action is required to satisfactorily complete an additional
probationary period of not less than 90 days. During this time period, the
employee has no right to appeal disciplinary actions.

III. Summary:
Effective March 1st of 2015 the Texas Legislature removed the violation of Displaying an Expired
Inspection Sticker from the Transportation Code. Inspections are now included in the requirement for a
renewed vehicle registration. This change in the law has necessitated a change to our nuisance
ordinance covering inoperable vehicles. The term "fails to display a current motor vehicle inspection
sticker"was recommended for removal by the city attorney. There were additional ordinance updates that
were recommended as well. The updates covered time requirements for a vehicle to be in violation as
well as covering other types of vehicles. In addition it gives guidelines about granting extensions for
violators who are attempting to comply. The city attorney has made those changes and they are attached
in the new ordinance.

Ordinance 572— Revised Nuisance Ordinance
This ordinance is substantially broader than the current City regulations on nuisances. It tracks
state law with regard to two basic types of nuisances. First, it addresses the abatement of
junked vehicles in accordance with the Texas Transportation Code by providing notice and
hearing procedures for the removal of junked vehicles on private and public property. We have
added aircraft and watercraft to the definition of junked vehicles as authorized by state law.
Second, the ordinance addresses high grass and weeds and the accumulation of junk, trash and
debris in accordance with the Texas Health and Safety Code. There are elaborate notice and
hearing procedures for the abatement of weeds, junk, trash and debris that mirror state law.
There are separate procedures for high grass and weeds (above 48") that are dangerous, which
the City can abate without prior notice. All this is a little complicated but it provides the City
with options to abate or ticket which comply with state statute.
I kept in the ordinance current provisions in the City Code which address blowing dust from
unpaved driveways and junkyards/wrecking yards because I was not directed to remove them.
If these are not deemed to be necessary, we can easily delete them.

NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Kennedale Texas is a Home Rule municipality acting under
its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and
WHEREAS, the City has previously enacted ordinances now codified in Chapter 15
of the Kennedale Code of Ordinances and regulating nuisances within the city limits;
and
WHEREAS, the City Council has determined that it is in the best interest of the
citizens to amend the existing ordinance to regulate nuisance vehicles and overgrown
vegetation, rubbish and other unsanitary matter; and
WHEREAS, the City Council has determined that this amendment to the City Code
of Ordinances will advance the health, safety, and general welfare of the citizens of the
City of Kennedale.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF KENNEDALE, TEXAS:
SECTION 1
Chapter 15, "Nuisances", Article I, "In General", of the Kennedale City Code is
hereby amended by revising Sections 15-3 through 15-6 and adding new Sections 15-7
through 15-20 to read as follows:
"Sec. 15-3. — Definitions.
The following words, terms and phrases, when used in this article, shall have the
meaning ascribed to them in this section, except where the context clearly indicates a
different meaning:
Antique vehicle means a passenger car or truck that is at least 35 years old.
Brush shall mean scrub vegetation or dense undergrowth.
Carrion shall mean the dead and putrefying flesh of any animal, fowl, or fish.
Costs shall mean the actual cost the city incurs in abating or causing to be
abated a nuisance, including without limitation, the cost of mowing, weeding, removing
objectionable, unsightly, or unsanitary matter, etc.
Cultivated shall mean vegetation that is deliberately grown and currently and
continuously maintained by the owner, occupant, or agent of the property.
Expenses shall mean the total of the administrative fee and costs incurred by the
city in abating or causing to be abated a nuisance.
Filth shall mean any matter in a putrescent state.
Garbage shall mean all decayable waste.
Impure or unwholesome matter shall mean any putrescible or non-putrescible
condition, object, or matter which tends to, may, or could produce injury, death, or
disease to human beings.
Inoperable shall mean, in addition to its ordinary meaning, failing to display a
valid or unexpired license plate and having one or more flat tires.
Junk shall mean all worn out, useless, worthless, discarded, or scrap material,
including, but not limited to, odds and ends, old metal, scrap lumber, building debris or
old building materials, used tires, vehicle parts, and other items no longer used in the
manner in which they were intended, including, but not limited to, upholstered furniture,
working and nonworking appliances, and machinery and parts thereof.
Junked vehicle means a motor vehicle that:
(a) Is self-propelled;
(b) Displays an expired license plate or does not display a license plate; and
(c) Is:
(1) Wrecked, dismantled or partially dismantled, or discarded; or
(2) Inoperable and has remained inoperable for more than:
i. Seventy-two consecutive hours, if the vehicle is on public
property; or
ii. Thirty consecutive days, if the vehicle is on private property.
Junked vehicle also includes:
(a) An aircraft that does not have lawfully printed on the aircraft an unexpired
federal aircraft identification number registered under Federal Aviation
Administration aircraft registration regulations in 14 C.F.R. Part 47; and
(b) A watercraft that does not have lawfully on board an unexpired certificate
of number and is not a watercraft described by V.T.C.A., Parks and
Wildlife Code § 31.055.
Maintained shall mean watered, pruned, trimmed, treated, and controlled in such
a manner as to enhance the use or enjoyment of one's property, without interfering with
the enjoyment or use of neighboring property or public access.
Motor vehicle collector means a person who:
(a) Owns one or more antique or special interest vehicles; and
(b) Acquires, collects, or disposes of an antique or special interest vehicle or
part of an antique or special interest vehicle for personal use to restore
and preserve an antique or special interest vehicle for historic interest.
Nuisance shall mean anything which is injurious to the health or morals, or
indecent or offensive to the senses, or an obstruction to the free use of property so as to
interfere with the comfortable enjoyment of life or property.
Objectionable, unsightly, or unsanitary matter shall mean any matter, condition,
or object which is or should be objectionable, unsightly, or unsanitary to a person of
ordinary sensitivities.
Owner shall mean a person having title to real property.
Person shall include a firm, association, organization, partnership, trust,
company, or corporation, as well as an individual.
Refuse shall mean a heterogeneous accumulation of worn out, used, broken,
rejected, or worthless materials, including garbage, rubbish, or litter, and other
decayable or non-decayable waste.
Rubbish shall mean both garbage and trash and shall include all animal,
vegetable and inorganic matter subject to discard that is generated from within a
household, residence, or business, such as, but not limited to, coffee grounds, tin cans,
paper bags, boxes, glass, and food articles. It shall also include all animal, vegetable,
and inorganic matter subject to discard that is not typically generated from within a
household, residence, or business, such as, but not limited to, shrubbery, grass
clippings, brush, yard cleaning materials, leaves, tree trimmings, stoves, refrigerators,
iceboxes, clothes washers or dryers, pieces of metal scrap, feathers, furniture, dead
animals, rocks, shingles, building materials, junk, trash, refuse, and other worn-out,
wrecked or dismantled machinery, tractors, automobiles, household appliances, and
other similar wastes.
Special interest vehicle means a motor vehicle of any age that has not been
changed from original manufacturer's specifications and, because of its historic interest,
is being preserved by a hobbyist.
Trash shall mean all non-decayable waste.
Undeveloped property shall mean tracts of land or lots, upon which no structure
exists.
Vegetation shall mean any grass, weeds, shrubs, trees, brush, bushes, or vines.
Weeds shall mean vegetation that because of its height is objectionable,
unsightly or unsanitary, but excluding cultivated crops, shrubs, bushes, trees, flowers,
and vines."
Sec. 15-4. — Blowing dust from unpaved driveway.
Blowing dust from an unpaved driveway is a nuisance. No person shall suffer or
permit such a nuisance to exist on any property under his care, custody or control.
Sec. 15-5. —Junkyards, wrecking yards, etc.
Any place used or maintained as a junkyard or dumping ground, or for the
wrecking or disassembling of automobiles, trucks tractors or machinery of any kind, or
for the storing or leaving of worn out, wrecked or abandoned automobiles, trucks,
tractors or machinery of any kind, or of any of the parts thereof, or for the maintenance
or operation of such place for the accumulation of rubbish of any description, is hereby
declared to be a nuisance. No person shall create or maintain such a nuisance.
Sec. 15-6. —Junked vehicles declared a nuisance.
A junked vehicle, including part of a junked vehicle that is visible at any time of
the year from a public place or right-of-way:
(1) Is detrimental to the safety and welfare of the public;
(2) Tends to reduce the value of private property;
(3) Invites vandalism;
(4) Creates a fire hazard;
(5) Is an attractive nuisance creating a hazard to the health and safety of
minors;
(6) Produces urban blight adverse to the maintenance and continuing
development of municipalities; and
(7) Is a public nuisance.
Sec. 15-7. — Penalty.
It shall be unlawful for any person to allow a junked vehicle to be placed or
maintained on any private or public property within the city. A violation of this provision
shall be punishable by a fine not to exceed two hundred dollars ($200.00) each day that
a violation exists.
Sec. 15-8. —Abatement and removal of junked vehicles; procedures.
(a) General. The city, acting through the city manager or his designated
representative, shall have the right at all times to abate and remove junked
vehicles, or a part of a junked vehicle, and such abatement and removal shall be
accomplished according to the requirements set forth in this section.
(b) Notice.
(1) Prior to any official action being taken to abate and remove a junked
vehicle constituting a public nuisance from private property, public
property or public right-of-way, not less than ten (10) days' notice shall be
given, except as hereinafter provided, to the following parties;
a. The last known registered owner of the junked vehicle as shown on
the certificate of title;
b. Any Iienholder of record; and
C. The owner or occupant of the property upon which the junked
vehicle is located or the owner or occupant of the premises
adjacent to the public right-of-way on which the junked vehicle is
located.
(2) The notice shall be either personally delivered, mailed by certified mail
with a five-day return requested, or delivered by the United States Postal
Service with signature confirmation service. A copy of the notice shall
also be affixed to the front windshield of the vehicle. The notice shall state
the following:
a. The nature of the public nuisance;
b. That it must be removed and abated not later than the tenth day
after the date on which the notice was mailed or personally
delivered;
C. The addressee is entitled to a public hearing if requested in writing
prior to the expiration of the ten-day period, and that the public
hearing, if requested, must be held prior to the removal of the
vehicle or vehicle part by the city;
d. That the person entitled to notice shall be entitled to speak at the
public hearing, either by making a request prior to the time of the
hearing or by making a request at the time of the hearing;
e. In the event that no request for hearing is received before the
expiration of the ten (10) day period, or the persons entitled to
notice fail to attend a requested hearing, it shall be conclusively
presumed the vehicle is a junked vehicle as defined under state law
and this article; and
f. That failure to abate the nuisance, failure to request a public
hearing, or failure to attend a public hearing that has been
requested constitutes a waiver by the owner and Iienholders of all
right, title and interest in the vehicle and their consent to disposal of
the junked vehicle under the terms of this article.
(3) If the post office address of the last known registered owner of the junked
vehicle is unknown, notice may be placed on the junked vehicle, or, if the
owner is located, hand delivered.
(4) If any notice is returned undelivered by the United States Post Office,
official action to abate the nuisance shall be continued to a date not less
than eleven (11) days after the date of return of the notice.
(c) Hearing.
(1) A request for a public hearing shall be in writing and shall be addressed to
the municipal court clerk of the city. A public hearing, when requested,
shall be held before the judge of the municipal court not earlier than the
eleventh (11th) day after the date on which the notice was delivered or
mailed. At the public hearing, the municipal judge shall hear and consider
all relevant evidence, objections and protests, and shall receive testimony
from the owner, witnesses, city personnel and interested persons relative
to the alleged public nuisance. The hearing may be continued from time
to time.
(2) At the hearing the junked motor vehicle is presumed, unless demonstrated
otherwise by the owner, to be inoperable.
(3) Following the public hearing, the municipal judge shall consider all
evidence to determine whether the vehicle or any part thereof constitutes
a public nuisance as alleged. If the municipal judge finds that the junked
vehicle constitutes a public nuisance and there is sufficient cause to abate
the nuisance, and if the notice requirements provided in this article have
been met, the municipal judge shall make a written order setting forth his
findings and ordering that the junked vehicle be abated.
(4) The order shall include a description of the motor vehicle and a correct
vehicle identification number and license plate number if such information
is available at the site of the vehicle. For an aircraft, the order shall
include the aircraft's description and federal aircraft identification number
as described by Federal Aviation Administration aircraft registration
regulations in 14 C.F.R. Part 47. For a watercraft, the order shall include
the watercraft's description and identification number as set forth in the
watercraft's certificate of number.
(d) Relocation of junked vehicle. The relocation of a junked vehicle that is a public
nuisance to another location within the city limits after a proceeding for the
abatement or removal of the public nuisance has commenced has no effect on
the proceeding if the junked vehicle constitutes a public nuisance at the new
location.
(e) Abatement of nuisance. In the event the municipal judge orders abatement of
the junked vehicle, any duly authorized person may remove and dispose of the
junked vehicle.
(f) Junked vehicles not to be made operable after removal. After any junked vehicle
has been removed under the authority of this article, it shall not be reconstructed
or made operable again.
(g) Notice to department of transportation. No later than the fifth day after the date
of removal of a junked vehicle pursuant to this article, notice shall be given to the
Texas Department of Transportation. Such notice shall identify the vehicle.
(h) Disposal of junked vehicle. Any junked vehicles or a part of a junked vehicle
taken into custody by the city or any duly authorized person pursuant to a
provision of this article shall be removed to a scrapyard, a motor vehicle
demolisher, or a suitable site operated by a municipality or county as authorized
by Chapter 683, subchapter E of the Texas Transportation Code.
(i) Enforcement. The municipal court of the city shall have authority to issue all
orders necessary to enforce the provisions of this article.
Sec. 15-9. — Right of entry for abatement of junked vehicle.
Any person authorized by the city to administer the provisions of this article may
enter upon private property for the purposes described in this article to examine
vehicles or parts thereof believed to be a public nuisance, to obtain information to
identify the vehicle believed to be a nuisance, and to remove or direct the removal of the
vehicle if found to be a nuisance.
Sec. 15-10. — Traffic obstruction; removal.
Nothing in this article shall affect statutes that permit immediate removal of a
vehicle left on public property which constitutes an obstruction to traffic.
Sec. 15-11. — Exemptions from junked vehicle abatement.
The provisions of this article pertaining to the abatement and removal of junked
vehicles shall not apply to a vehicle or vehicle part:
(1) That is completely enclosed within a building in a lawful manner consistent
with all applicable zoning laws, ordinances and regulations, and is not
visible from the street or other public or private property; or
(2) That is stored or parked in a lawful manner on private property in
connection with the business of a licensed vehicle dealer or junk yard or
that is an antique or special interest vehicle stored by a motor vehicle
collector on the collector's property, if the vehicle or part and the outdoor
storage area, if any, are:
a. Maintained in an orderly manner;
b. Not a health hazard; and
C. Screened from ordinary public view by appropriate means,
including a fence, rapidly growing trees, or shrubbery.
Sec. 15-12. — Armed forces personnel exemption from junked vehicle abatement.
The provisions of this article pertaining to the abatement and removal of a junked
vehicle as a public nuisance shall not apply to a motor vehicle, the title of which stands
in the name of an individual who is currently on active duty with the armed forces of the
United States of America and stationed outside the continental limits of the United
States of America, so long as the owner of the motor vehicle maintains the status as
above described. However, when such owner has returned to the continental limits of
the United States of America for a period of no less than two weeks, then the provisions
of this article pertaining to the removal and abatement of a junked vehicle shall from that
date forward apply.
Secs. 15-13 — 5-14. – Reserved.
Sec. 15-15. – Overgrown vegetation, rubbish, and other unsanitary matter
declared nuisance.
All grass, weeds, vegetation, or brush not regularly cultivated and which exceed
twelve (12) inches in height as prohibited herein, and all rubbish and other unsanitary
matter shall be presumed to be objectionable, unsightly, and unsanitary, and are hereby
declared a public nuisance.
Sec. 15-16. – Unlawful accumulations of overgrown vegetation, rubbish or
unsanitary matter.
It shall be unlawful for any person owning, leasing, claiming, occupying, or
having supervision or control of any real property, occupied or unoccupied, improved or
unimproved, developed or undeveloped, within the corporate limits of the city, to suffer,
permit, or allow:
(1) Uncultivated grass, weeds, or brush to grow to a height greater than
twelve inches on average upon such premises or to grow in rank profusion
upon such premises, including along the sidewalk or street adjacent to the
premises between the property line and the curb or, if there is no curb,
between the property line and the driving surface; or
(2) Refuse, rubbish, junk, litter, trash, debris (vegetation, building or other),
garbage, discarded items, carrion, filth, animal or human feces, or any
other unsightly or unsanitary matter to accumulate or remain upon said
premises or to grow in rank profusion upon such premises, including along
the sidewalk or street adjacent to the premises between the property line
and the curb or, if there is no curb, between the property line and the
driving surface.
Sec. 15-17. Duty to comply with ordinance.
(a) Removal of matter. It shall be the duty of any person owning, leasing, claiming,
occupying, or having supervision or control of any real property, occupied or
unoccupied, improved or unimproved, developed or undeveloped, within the
corporate limits of the city, to cut, or cause to be cut, grass, weeds and brush and
to remove, or cause to be removed, rubbish and other objectionable, unsightly or
unsanitary matter as often as necessary to comply with the requirements of this
article, and to otherwise maintain that property in full compliance with this article.
(b) Violations. Any person who violates this section shall be punished by a fine not
to exceed two thousand dollars ($2,000.00) for each offense. Each day that a
violation exists shall constitute a separate offense.
Sec. 15-18. — Notice of violation prior to abatement by city.
(a) Notice required. Except as provided by section 15-20 of this article, if the owner
of land fails to comply with the requirements of sections 15-16 and 15-17, a city
official may cause the property owner to be notified to cut the grass, weeds, or
brush or to remove the rubbish, brush, or other unsanitary or unsightly matter
within ten days of the date of the notice.
(b) Where notice given. The notice must be given:
(1) Personally to the owner in writing;
(2) By letter addressed to the owner at the owner's post office address; or
(3) If personal service cannot be obtained or the owner's post office address
is unknown:
a. By publication in the city's official newspaper at least twice within
ten days;
b. By posting the notice on or near the front door of each building on
the property to which the violation relates; or
C. If the property contains no buildings, by posting the notice on a
placard attached to a stake driven into the ground on the property
to which the violation relates.
(c) Consequence of failure to abate nuisance. If the owner does not cut the weeds,
grass, or plants, or remove the rubbish within ten days of the notice, the city may
go on such property or authorize another to go on such property, and do or
cause the work to be done and charge the expenses incurred to the owner of the
property and assess the expenses against the real estate on which the work is
done. The remedy provided in this section is in addition to any criminal penalties
or other remedies authorized by this article or other law.
(d) Additional notice and authority to abate. Although it is not required, if the notice is
given by certified mail, return receipt requested, then the city may:
(1) Inform the owner in the notice that if the owner commits another violation
of the same kind (failure to mow weeds) on or before one year from the
date of the notice, the city without further notice may correct the violation
and assess the expenses against the property; and
(2) If a violation occurs within the one-year period and the city has not been
informed in writing by the owner of an ownership change, then the city,
without notice, may take corrective action and assess the expenses
against the owner and the property.
(e) Contents of notice. The notice shall contain:
(1) The name and address of the record owner;
(2) An identification, which is not required to be a legal description, of the
property upon which the violation is located;
(3) A statement describing the violation and the work necessary to correct the
violation;
(4) A statement advising the owner that if the work is not completed within ten
days, the city will complete the work and charge the expenses to the
owner;
(5) A statement that if the city performs the work and the owner fails to pay
the expenses, a priority lien may be placed on the property;
(6) A statement that the city may, at any time, file a criminal misdemeanor
complaint in municipal court with a maximum fine of $2,000.00 for each
day the violation exists, in addition to or in lieu of any other remedy
provided by law.
(f) Notice filed with county clerk. If notice is provided to the owner as permitted by
subsection (d) of this section, the city manager or his designee shall cause a
copy of the entire notice to be filed with the county clerk.
Sec. 15-19. —Assessment of expenses; lien; appeal.
(a) Contents of notice. In assessing the expenses incurred pursuant to subsection
15-18(c) against the property on which the work is done or improvements made,
the city shall send the owner of the property upon which the work was done a
notice which shall include:
(1) Identification of the property;
(2) Description of the violation;
(3) A statement that the city abated the condition;
(4) A statement of the city's expenses in abating the condition;
(5) An explanation of the property owner's right to request a hearing within ten
days of the date of the letter; and
(6) A statement that if the owner fails or refuses to pay the expenses within 30
days of the date of the notice, the mayor or his designee shall place a lien
against the property by filing with the county clerk a notice of lien and
statement of expenses incurred.
(b) Where notice given. The notice shall be sent in the same manner as provided in
subsection 15-18(b).
(c) Hearing. The city manager will conduct a hearing if the property owner submits a
written request within ten days of the date of the notice. The hearing shall be held
within 30 days of the receipt of a request for a hearing. At the hearing:
(1) The owner and the city may testify or present witnesses or written
information related to the city's abatement of the nuisance.
(2) The city has the burden to show that a violation of this article existed,
notice was given in substantial compliance with this article, and expenses
incurred to abate the violation were reasonable.
(3) At the close of the hearing, the city manager or his designee may approve
the expenses, deny the expenses, or adjust the amount of the expenses
and approve them as adjusted.
(d) Lien on property. If no hearing is requested, or a hearing is held and the
expenses are determined to be valid or are otherwise appropriately adjusted, and
the owner fails or refuses to pay the expenses within 30 days after written
notification to pay, the mayor or his designee shall place a lien against the
property by filing with the county clerk a notice of lien and statement of expenses
incurred.
(e) Security provided by lien. The lien is security for the expenses and interest
accruing at the rate of ten percent per annum from the date the work was
performed or the expenses were incurred by the city.
(f) Privileged lien. When the statement is filed, the city shall have a privileged lien on
that property, second only to tax liens and liens for street improvements.
(g) Suit or foreclosure to recover expenses. The city may institute suit to recover the
expenses, with interest, and may foreclose on the property. The original or a
certified copy of the statement of expenses is prima facie proof of the expenses
incurred by the city in doing the work or making the improvements.
Sec. 15-20. –Additional authority to abate dangerous weeds without prior notice.
(a) Authority to abate dangerous weeds. The city may abate, without prior notice,
weeds that:
(1) have grown higher than 48 inches, and
(2) are an immediate danger to the health, life, or safety of any person.
(b) Notice of abatement. Not later than the tenth day after the date the city abates
weeds under this section, the city shall give notice to the property owner in the
same manner provided in subsection 15-18(b). The notice shall contain the items
specified in subsection 15-19(a).
(c) Hearing. The city manager or his designee shall conduct an administrative
hearing under this section if, not later than the 30th day after the date of the
abatement of the weeds, the property owner files with the city a written request
for a hearing. The hearing shall be conducted by the city manager or his
designee not later than the 20th day after the date a request for hearing is filed.
At the hearing:
(1) The owner and the city may testify or present witnesses or written
information related to the city's abatement of the nuisance.
(2) The city has the burden to show that a violation of this section existed,
notice was given in substantial compliance with this section, and expenses
incurred to abate the violation were reasonable.
(3) The city manager or his designee may approve the expenses, deny the
expenses, or adjust the amount of the expenses and approve them as
adjusted.
Secs. 15-21 — 15-45. – Reserved."
SECTION 2
This ordinance shall be cumulative of all provisions of ordinances and the Code
of the City of Kennedale except where the provisions of this ordinance are in direct
conflict with the provisions of other ordinances or the Code in which event the conflicting
provisions of the other ordinances or Code are hereby repealed.
SECTION 3
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs, and sections of this ordinance are severable and if a
phrase, clause, sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of a court of competent jurisdiction,
such unconstitutionality shall not affect the remaining phrases, clauses, sentences,
paragraphs, and sections of this ordinance since the same would have been enacted by
the City Council without the incorporation in this ordinance of the unconstitutional
phrase clause sentence paragraph or section.
SECTION 4
All rights and remedies of the City of Kennedale are expressly saved as to any
and all violations of the provisions of Sections 15-3 through 15-6 of the Code of
Ordinances of the City of Kennedale Texas or any other ordinances regulating
nuisances which have accrued at the time of the effective date of this ordinance and as
to such accrued violations and all pending litigation both civil and criminal whether
pending in court or not under such ordinances same shall not be affected by this
ordinance but may be prosecuted until final disposition by the courts.
SECTION 5
Any person, firm, or corporation who violates, disobeys, omits, neglects, or
refuses to comply with or who resists the enforcement of any of the provisions of this
ordinance shall be fined for each offense as provided in Section 1-6 of the City Code.
Each day that a violation is permitted to exist shall constitute a separate offense.
SECTION 6
The City Secretary of the City of Kennedale is hereby directed to publish in the
official newspaper of the City of Kennedale the caption, penalty clause, publication
clause and effective date clause of this ordinance two (2) days as authorized by Section
52.013 of the Local Government Code.
SECTION 7
This ordinance shall be in full force and effect from and after its passage and
publication as required by law and it is so ordained.

As a membership of CJAC (Cambodia-Japan Association of Cambodia),which provide assistant and
sharing knowledge to students and public officials since 2012 and a membership of Public Official of
Ministry of Interior Association since 2008.The main activity is obtaining the good working
environment,rights,and protection to ministry officials.
I graduated from International University of Japan,Master's degree of Public Management and Policy
Analysis Program (PMPP),June 2014,through the JDS scholarship.In 2006,as Khmer Law Compilation
Coordinator I had coordinated in the production of the first CD-Rom version of the Cambodian

Mr.Bounmy Sibounheuang was born in the remote area in the northern part of
Laos where education is very rare access. Many people in his community lack
opportunity to access the higher education. Because of his parents are very
poor.They have no money to afford him to school he decided to become a novice to live at the temple for
study.As a monk,he went to university in Chiangmai,Thailand and became the only one person in his
village who graduated.He always dreams to get higher education from abroad in order to model the
young people in his community.In the future,he wishes to educate young people in his community to
come along with him and reach the international. During doing his degree in Chiangmai,he worked as
volunteer for Religious and Cultural Confict Resolution at Payap International University. He was also an
English Teacher at Secondary School as part-time. He enjoyed teaching English to the children.In the
evening,he actively joined Monk Chat Program where he improved his English speaking.Monkchat
gives both monks and foreigners chance to discuss about Buddhism,religious,and exchange the culture
differences. After he graduated,he returned to Laos and taught English part-time for colleges in
Vientiane capital. He got his first job as Trainer-Language Skills at Training Centre,LXML Sepon Mine
Industry.He has been trained to be professional trainer such as TESOL(Teaching English to Seakers of
Other Languages) program and TKT(Teaching Knowledge Test),Presentation Skills,Communication
Skills and Teamwork Model. His pedominantly accountable is to train Lao employees across site and
upgrade their languages competence especially English Language. However,planning,development,
evaluation of the couses is also involved. Based on his knowledge and experience at the Training
Centre,he was interested to work for Education Sector after MMG.He and his friend in Germany
initiated a small project called"Education Technical Promotion"at Luang Namtha Teacher Training
College.This project aims to educate the pedagogue on teaching technique and creating learning
material at LTTC as it produces thousand of teachers every year.Although,he is very busy working for
MMG but he wishes to continue his project to promote education in the remote area of Laos. He has
recently moved to take new managerial role in Vientiane Office as HR Coordinator-Career&
Employment,LXML Company.This role provides him new challenge as mostly involves the
management,key relationship and communication for all levels both internal and external LXML,MMG,
conducting research on Lao labour market and creates an optimal plan and advertising activities to
inspire more people throughout Laos.This role also gives him skills,experience and knowledge in terms
of Human Resource Management as it's completely different between his previously position as trainer.
However,he strongly believe that learning to know more different areas of job is the way to improve his
future career.

WHEREAS, Mr. Hong Muyheng (Cambodia) is a participant in the U.S. Department of State-
sponsored International Fellows Exchange Program;and
WHEREAS, He is a member of the International Young South East Asian Leaders Initiative
(YSEALI)and Legislative Process and Governance Professional Fellows Program(PFP);and
WHEREAS, the exchange has been arranged by the International City/County Management
Association (ICMA), the organization that develops and advances professional local government
management worldwide;and

WHEREAS, Mr. Bounmy Sibounheaung (Laos) is a participant in the U.S. Department of State-
sponsored International Fellows Exchange Program;and
WHEREAS, He is a member of the International Young South East Asian Leaders Initiative
(YSEALI)and Legislative Process and Governance Professional Fellows Program(PFP);and
WHEREAS, the exchange has been arranged by the International City/County Management
Association (ICMA), the organization that develops and advances professional local government
management worldwide;and
WHEREAS, this year the Professional Fellows Program is providing professional development
opportunities to up-and-coming leaders in the fields of legislative process and governance, media and
economic empowerment;and
WHEREAS, Bounmy was placed at the City of Kennedale and have for the month of May
participated in the City's budget process, Tarrant County Asian Recognition Day, Kennedale Rotary Club,
Economic Development Corporation, received tours of the City, County offices and court houses, Tarrant
County College South Campus, Austin State Capital, and met with Senator Konni Burton and State
Representative Bill Zedler;and
WHEREAS, Bounmy experienced Texas culture and hospitality by attending Fort Worth
Stockyards,Kimball Art Museum and the Amon Carter Museum as well as the LBJ Library, ,University of
Texas,State Museum and the host home of Bob and Lois Hart,

Youth Advisory Council,
This year, I have the honor of teaching Emily Marr in my Spanish 2 Pre-AP class at Kennedale
High School. I have been able to observe this young lady in an academic setting that has shown me she
possesses strong leadership and people skills. I have also been able to work with Emily as her Student
Council sponsor this year.
Despite being young, Emily Marr has already shown she is willing to take part in several
groups/organizations at KHS and has gained some valuable experience in her freshman year.
Emily has been a part of the Kennedale Student Council this year,serving as a class
representative. She also was in Student Council her 91h grade year. During her freshman year,she was
able to take part in the StuCo volunteer program at Mission Arlington. She,along with her fellow StuCo
representatives,sorted and boxed up over 50 boxes of donated toys.
Emily was also a part of the National Junior Honor Society,and was on the 71h and 81h A-Honor
Roll in Junior High.
This year, Emily has also worked on her leadership skills,and her school pride, by being a part of
the Kennedale cheer squad.She has been a member of the cheer squad for 3 years. She has also been
nominated,and won,for Best Flyer by her fellow squad members.
Emily is also working on her school support by being a member of the PTA. I would highly
recommend Emily Marr to be a member of your Youth Advisory Council.She has proven that she will be
one of our future school leaders by already taking park in several activities and groups in our school.
