Kirkpatrick - present Councilmen - Jerry Mitchell - present Richard Bennett - present Larry Ledbetter - present Mark Wright - present Mayor Taylor opened this public hearing at 7:16 P.M. Public Hearing ~~ l: Proposed Annexation of approximately .672 acres of land located at the corner of Mansfield Highway and I-20/820 Access Road - Mr. Dallas Harris. Mr. Phil Heath with Southland Corporation wished to speak. He spoke in favor of this annexation. His Corporation would be interested in this property should it be annexed with proper zoning and with City Utilities accessible to the property. He stated that the characteristic of this property was favorable to the operations of his type of business and he felt it would be a positive step in Kennedale's growth process. Mr. Wright asked about water and sewer services. Mayor Taylor expressed that necessary arrangements were in process to supply water and sewer to this area. Mr. Wright also asked Mr. Heath about construction intentions. Mr. Heath answered as soon as possible upon completion of necessary arrangements. With no other persons wishing to testify, Council moved to the second public hearing at 7:20 P.M. Public Hearing ~~ 2: Proposed Amendment to City Code (Zoning Ordinance) for "G-1" Light Industrial District Mayor Taylor and City Attorney Don Driver explain to the citizens that our zoning ordinances does not address this type of operations. (rubber mixing plant) Classification would be under the "G-1" Light Industrial District. Planning and Zoning Commission has expressed approval of this action. Mr. Cooper spoke in favor of this type of operation. He spoke of Mr. Chase operation as being a very clean, low noise level business with no outside storage. They have been operating in Arlington with no violations. Mr. Tom Chase spoke of his operation. He described their product as being used commonly for rubber covered rollers, such as printing press. Kenne- dale has another operation "Bell Rubber" which does similar processing. The mills are operated by electric motors which rate upwards to two hundred horsepowers. They do have a dust collection system. They do not work with flammable solvents. They are a family operation with members actually work- ing there. They expect a building size of 30,000 feet with sprinkler system meeting all codes. Mr. Gardner now chose to speak. He asked about the road access on page 1410 J Mansfield - Cardinal regarding traffic and load limits. He mentioned getting access to Mansfield highway. Mr. Chase mentioned that they are attempting to get access to Mansfield Highway. With no other persons wishing to speak, Councilman Bennett made the motion to adjourn the public hearings at 7:38 P.M. Motion was seconded by J.D. Agenda Item ~~ 1 - Action on Public Hearing ~~ 2 - Proposed Amendment to City Code for "G-1" Light Industrial District Councilmember Wright made the motion to accept the amendment as presented by City Attorney - Mr. Driver, to .the City Code for ''G-1'' Light Industrial District. Councilman Mitchell seconded the motion. The vote was un- animously in favor of the amendment. Addedum to Agenda: Final Plat for Johnson Addition: age 1411 Mr. Johnson presented the plat to the Council. The Council had many questions regarding the houses he would be building on this property. Mr. Johnson presented many plans. Upon motion by J. D. Kirkpatrick and seconded by Richard Bennett, motion to approve the final plat of Johnson Addition as submitted. Motion carried by unanimous vote. Motion to recess into Close Session by Mark Wright and seconded by J. D. Kirkpatrick. Motion carried with an unanimous vote at 7;52 P.M. Motion to reconvene into Open Session by Mark Wright and seconded by Jerry Mitchell. Motion carried unanimously at 8:07 P.M. Motion to adjourn meeting by J. D. Mayor Pro-Tem - Kirkpatrick - present Councilmen: Mitchell - present Bennett - present Ledbetter - present Wright - present Call to order at 7:15 by Mayor Pro-Tem Kirkpatrick. Public Hearing ~~ 1 - Variance request by Mr. Sherman Bruce for renewal of variance to allow a security trailer at 1101-A North Bowman Springs Road.. Mr. R. L. Swiney spoke against the request variance citing the City Code page 1412 as being well established regarding placements o~ trailers,. He also cited that a request by himself had been made in previous years for this same property to allow a placement of a tra7,er park... This request had Veen denied. Mr. Clark spoke against the request variance. He stated that denial had been made to his daughter for placement of a trailer during construction time. Mr. Joe Thomas spoke against the variance. With no other comments, Council continued to the next public hearing. Public Hearing ~6 2 - Variance request by Mr. Sherman Bruce - Variance to Kennedale Zoning Ordinances to allow extraction and removal of dirt from his property located at 1101 North Bowman Springs. Mr. Swiney presented to Council picture of Mr. Bruces's operations. He also presented information regarding "flood plain" requirements. He also presented information to Don Driver, City Attorney, regarding a pending legal action by the City of Kennedale against Mr. Bruce. Mr. Driver was unable to determine whether suit was still pending or whether it pertained to this issue. Mr. Swiney also showed Council deeds and powers of attorney by Mrs. Swiney, showing restrictions. Mr. Swiney spoke against this subject variance. Mr. ~Ioe Thomas spoke similar responses as Mr. Swiney being against this subject variance, stating the flood plain and lowering property values. Mr. Thomas presented Mr. Larry Dryer, local real estate agent, Mr. Dryer spoke regarding values of property surrounding Mr. Bruce's property Shculd this type of construction operation occur, future development as high as quality current under construction on neighboring property would likely cease. Mr. Clark spoke against the subject variance. Mr. Bruce spoke in favor of his request. He explained that fie wished to get to the rock level to produce a lake so the property could lie used as a fish farm, thus available for sale. With no other comments, for or against, motion to adjourn the public hear- - ings by Richard Bennett and seconded by Jerry Mitchell. Motion carried unanimously at 8:06 P.M.
