12/14/1989, Public Hearing Meeting MinutesPage 1668 Kennedale City Council Public Hearing - December 14, 1989 Community Center Mayor Radakovich called the public hearings to order at 7:40 PM. Ted Rowe delivered the invocation. Members present were Steve Radakovich, Bill Abbott, Pete Kirkpatrick and Robert Mundy. Jerry Mitchell and Mark Wright were absent. Public Hearina Id o. 1 - The purpose of the hearing was to receive comments regarding a replat from Block 63 to Lots 1R and 2R, Block 63, Original Town of Kennedale, re- quested by Ms. Signe Edwards. Ho one spoke for or against the replat. Public Hearina Ho. 2 - The purpose of the hearing was to receive comments regarding abatement of a dilapidated structure on Lot 10, W.J. Boaz Subdivision located at 405 S. Dick Price Road, requested by Mr. Paul McLemore. Mr. Paul McLemore appeared before Council. Mr. McLemore asked if he was being allowed to rebuild/repair the structure or being ordered to remove the structure. The house is not a total loss per his estimate and insurance company and he is not getting a ~l Page 1669 total loss settlement on the property. The house would be cleaned out and he would replace the burned lumber. Mayor Radakovich stated that the structure would have to be brought up to city code. Ted Rowe stated that the ordinance states the anytime it's over 50% destroyed, then it becomes substandard. It's beyond economical repair in the normal case, but if you're a builder that might not be the same case. The structure appears to be 65% destroyed. Mr. McLemore agreed that it might be beyond economical repair, but he had not made that judgement yet. Don Driver stated that if the existing 1,000 square foot house was repaired it would not have to be brought up to the minimum 1,250 square foot required by city code. If it was bulldozed and a new house built, it would have to meet the code. Mr. McLemore stated that he house is repairable but he had not made the decision as to whether he wishes to repair it or not. It was an arson fire and is under investigation with the insurance company and the Tarrant County Fire Marshall's Office. The house has not been released. He estimated 530,000 to $35,000 to repair the house if an individual was contracting the work out. Mr. McLemore stated that he did not intend on doing anything to the foundation unless it was required of him. A slab or pier-beam foundation would be cost prohibitive. ~J Page 1670 Chief Jim Smith informed Council that the fire marshall has released the house. Mr. McLemore preferred to have six months to complete the house. He wouldn't be opposed to putting a construction type fence around the property due to it being a safety hazard. The TAD appraisal is 531,000 and the insurance is paying approximately 845,000. Motion was made by Pete Kirkpatrick, seconded by Bill Abbott, to adjourn the hearings at 8:05 PM.
