Regular Meeting - June 8, 1989

Mayor Steve Radakovich called the meeting to order at 7:38 p.m.
Members present were Steve Radakovich, Bill Abbott, Pete Kirkpatrick,
Robert Mundy, and Mark Wright. Jerry Mitchell was absent.
Ted Rowe gave the invocation.
ITEM NO. 1 - Approval of Public Hearing and Regular Meeting Minutes
Dated May 11, 1989.
Linda Jones informed Council that page 1617, Item 11, third paragraph,
second line, last two words "option (b)" had been deleted and the word
"include" was inserted.
Motion was made by Robert Mundy, seconded by Bill Abbott, to approve
the minutes as corrected. Motion carried unanimously.
ITEM NO. 2 - Appointment of Mayor Pro-Tem for 1989-90.
Pete Kirkpatrick made a motion to appoint Jerry Mitchell Mayor Pro-Tem,
seconded by Mark Wright. Motion carried without opposition.
ITEM NO. 3 - Approval of Contract with United States Department of
Agriculture, Soil Conservation Service and Certification
of Adequacy of Real Property Rights.
Mayor Radakovich commended Ted Rowe for finding out about available services
from the Soil Conservation Service.
Ted Rowe stated that the services were specifically for damaged streams,
banks and debris that collects in streams due to flooding situations which
has happened on South New Hope Road on Jim Kite's property. The property
is in the floodplain and is qualified for this grant. The plans and
specifications have been drawn-up and bids will be received June 9th. The
work will commence on June 13th and be completed by July 3rd. The grant
will be in the amount of less than $60,000. It protects New Hope Road
from being covered with water.
Ken Pearce asked if they were caning on down the creek because it had
washed out about 300 feet of his fence and had damaged his fence in the
past.

Ted Rowe stated that the only thing they were trying to do is keep the
water from backing up over New Hope Road, according to the emergency
provision. The SCS will be looking down in that area, whether that
will meet their criteria is unknown.
The cooperative agreement lets the SCS off the hook for any future liability
as for as maintaining the structure they put in. They leave the rest of
the project up to the City of Kennedale but they are not going to require
anything from the city. They will be widening the creek, straightening
out the banks, moving dirt from one side of the creek to the other side,
putting in some rip-rap and cleaning out debris. The city's liability
is to make sure we coordinate with Mr. Kite, and if he receives any damage
in the rip-rap area, he has to add more rocks to the rip-rap.
Motion was made by Mark Wright, to approve the contract with the Soil
Conservation Service, seconded by Pete Kirkpatrick. Motion carried
unanimously.
ITEM NO. 4 - Approval of Move-In cost for New Police Facility.
Ted Rowe informed Council that the decision on the furniture, and landscaping
could be delayed for quite a while. The radio equipment, 9-1-1 equipment,
telephone lines and equipment, court and in-house computer, camera equip-
ment and intercom systems need to be considered at this time, so that the
wiring and outlets can be installed during the construction stage, instead
of locating them on the outside of the walls after completion.
Motion was made by Bill Abbott, seconded by Robert Mundy, to allocate
$16,000 for the installation of phone equipment, radio equipment lines,
911 lines, telephone lines, court computer lines, in-house computer lines,
camera equipment, cable and intercom system lines. Motion carried
unanimously.
ITEM NO. 5 - Report on the Cost of the Disaster efforts.
Ted Rowe explained that the insurance deductable was a total of $2,500
instead of $2,000 deductable for each building and $1,000 deductable for all of
the vehicles per occurence.

The flood damage on Jim Kite's creek is covered as some of the city losses;
there will be a contract signed by a federal agency that will be anywhere
from $20,000 to $60,000.
North Dick Price Road was under water and the engineer feels that it is
extensively damaged. FEMA will be evaluating the road and may pay some
damages on that road.
The sewer metering station is gone and it will take approximately $20,000
to replace it.
Manhours expended for the windstorm were approximately 200 at $2,100 with
180 volunteer hours. During the flood there were 550 manhours at $6,500
and 200 volunteer hours.
A form for the city has been turned in on disaster relief, estimated at
$1,000,000 during the flood and $500,000 windstorm to city property.
It will not pay for anything covered by the insurance, but will cover
the deductable.
Horton Tree Services lacks approximately one week on brush pick-up.
Bill Abbott thanked the employees and volunteers for all the hard work
during the storm and flooding in May.
OPEN DISCUSSION
Ms. Evalena Canter of 812 North Trent Street asked how she could get on the
agenda and she had about six or seven items to discuss. She announced that
she would see Mr. Rowe at City Hall.
Mark Wright questioned Al Singletary of Lone Star Gas, about the delay in
locating the gas line cut-off during the flooding of Village Creek Mobile
Home Park. Mr. Singletary reiterated that there is a problem and every-
time the street is widened without them knowing, the location has different
footage.
Mark Wright made a motion to enter into executive session at 8:38 p.m.,
seconded by Bill Abbott. Motion carried unanimously.

ITEM NO. 6 - Litigation with U.S. Department of Labor and with
City of Fort Worth and receive Fire Department
Briefing. (Section 2 (e), 6252-17 V.T.C.S.)

Pete Kirkpatrick made a motion to reconvene into open session at 10:46 p.m.,
seconded by Robert Mundy. Motion carried.
ITEM NO. 6
Motion was made by Bill Abbott, seconded by Pete Kirkpatrick, to pass
Ordinance No. 89-12, which rescinds Ordinance No. 69-15 disannexing land
situated within Block 54 of the Shelby County School Land Survey,
Abstract 1375, and which lies west of the west right-of-way line of
Dick Price Road. Motion carried.
Motion made by Bill Abbott, seconded by Pete Kirkpatrick, to pass
Resolution No. 89-2, which rescinds Resolution No. 69-4, a joint
resolution with the City of Fort Worth since Fort Worth had not
fulfilled its obligations under the provisions contained therein.
Motion carried.
There being no further business, Robert Mundy made a motion, seconded
by Pete Kirkpatrick, to adjourn the meeting at 10:48 p.m. Motion carried
unanimously.
