PUBLIC HEARING 1) BOA 06 -20 to receive citizen's comments for a Variance to the City Code Section 17 -508 (a), to allow for a marquee sign in R -3 District (Single Family Residential) at James A Arthur Intermediate School located at 100 Mistletoe Drive. Legal description being Tract 2133 & 2138 of the E R Mingus Survey, Abstract 1075 and Lots 7 -12, Block K of the Crestdale Addition, and Lot 1A, Block L of the Crestdale Addition in the City of Kennedale, Tarrant County, Texas as requested by Kennedale Independent School District. Mark Biondi, 100 Mistletoe, Kennedale, TX, addressed the Board representing the Kennedale Independent School District in favor of the variance and explained the reason for wanting. the sign to be allowed so that the school might communicate with the community. A discussion commenced regarding the size and height of the sign among the members of the Board, Mr. Biondi, and Mr. Ford, who is the designer of the sign. 2) BOA 07 -01 to receive citizen's comments for a Variance to the City Code Section 17 -405 (i) to allow for an accessory building to be more than 15 feet in height located at 207 Oak Ridge Trail. Legal description being Lot 19R3A, Block 2 of the Shady Creek Addition in the City of Kennedale, Tarrant County, Texas as requested by Gavan and Kelley Hunt. Kelley Hunt, 207 Oak Ridge Trail, Kennedale, TX, addressed the Board in favor of the variance explained the reasons for the request being that the applicants would like to put in a second garage with a second story as a game room and a pool house on the back of the garage. Due to the garage being two stories then the structure would be more than 15 feet in height. A discussion was held among the applicant and the Board regarding the hardship requirement. Chairman closed the public hearings at 7:09 pm. E. REGULAR ITEMS 1) Approval of Minutes dated December 5, 2006. A discussion about the minutes was held among the members of the Board and a unanimous vote was taken to accept the minutes. 2) BOA 06 -20 to consider approval of a Variance to the City Code Section 17 -508 (a), to allow for a marquee sign in R -3 District (Single Family Residential) at James A Arthur Intermediate School located at 100 Mistletoe Drive. Legal description being Tract 2133 & 268 of the E R Mingus Survey, Abstract 1075 and Lots 7 -12, Block K of the Crestdale Addition, and Lot 1A, Block L of the Crestdale Addition in the City of Kennedale, Tarrant County, Texas as requested by Kennedale Independent School District. The Board and the applicants discussed the possibility of designing a different sign that was not so large and placed so high up. Mr. Vader made a motion to table this item until next month, so that the School might come up with another design that was close in dimensions to the High School Sign, seconded by Mr. Gray. Motion passed with no opposition. 3) BOA 07 -01 to consider approval of a Variance to the City Code Section 17 -405 (i) to allow for an accessory building to be more than 15 feet in height located at 207 Oak Ridge Trail. A motion was made after a discussion concerning the hardship requirement in granting a variance and that the hardship must not be financial in nature. The property is zoned R -3 (Single Family Residential) and the portion of the ordinance does not allow pole signs in a residential district. Our zoning ordinance does not have a separate zoning designation of "public" as some municipalities do therefore the applicant must request a variance from the Board. At the last meeting, this item was tabled so that a new design could be provided. Seven feet is the measurement from the ground to the bottom of the sign of the High School Marquee. We are asking for eight feet of clearance on the Arthur marquee but can easily readjust to seven feet should that be the BOA recommendation. We are asking for at least eight feet of clearance to deter vandalism to the marquee. We have modeled this marquee after the one currently used by the city located at 100 Kennedale Parkway. This marquee has a ten foot clearance from the ground. (2) The outlining of a window on two (2) or more of any sides with lighting, luminescent gaseous tubing, or by any similar means shall constitute one hundred (100) percent of the total window area as a sign.
