Cowey, Building Official Summary: The applicants, Jason and Elaine Biles have filed for a Special Exception to allow a guest house at 708 E. Mansfield Cardinal Road with the legal description being Block 1, Lot 14R2 of the Boaz Subdivision. According to Section 17 -421 a guest house is permitted in an R -3 Zoning with a Special Exception. 708 E. Mansfield Cardinal Road is currently a separate vacant lot to the right of 712 E. Mansfield Cardinal Road. 712 E. Mansfield Cardinal is currently where the applicants reside. The owners have applied for a re -plat to combine 708 and 712 E. Mansfield Cardinal into one lot, which will go before the Planning and Zoning Commission on June 19, 2008. The applicants are seeking approval of the Special Exception, prior to the re- plat. If the Special Exception is denied, they will pursue other options on the existing vacant lot at 708 E. Mansfield Cardinal Road. The applicants have provided a detailed summary explaining the need for their request and a site plan of the proposed development, which is included in your packet. Required public notices have been done by Staff and as of this date we have not received any feedback from neighbors or citizens regarding this Special Exception. Recommendation: Staff has no issues with approving this request with the understanding that the proposed re -plat is approved and that all applicable City Ordinances and adopted Codes will be adhered to in constructing the Guest House. Currently, we are in the process of plating both properties together. It is our desire to build a guesthouse on the new section of property. Per the City Code of Kennedale (sec. 17 -421), a guesthouse is only permitted with special exception based on meeting certain criteria. We believe the new structure will meet the following criteria as outlined in the application: , 1. The structure will not be of endangerment to public health, safety, morals, or general welfare. 2. That the use or enjoyment of other property in the neighborhood will not be diminished, { by the structure. 3. The structure will not impede normal and orderly development and surrounding property for uses permitted in the district. 4. The structure will have adequate utilities, access roads, drainage and other necessary improvements. 5. The structure will cause no traffic congestion in public streets. 6. The structure will conform to all regulations of the district. Our need for a guesthouse is based on the fact that all of our family lives out of state. When we have birthday parties for our children, school functions, etc., family members want to attend. Our house now only has one spare bedroom and the extra space is greatly needed. The actual well site has been assigned an address of 5620 East 1 -20. As per the City's Ordinances, this requires a Special Exception from the Board of Adjustments before they can receive a gas drilling permit from the City. Please find enclosed in your packet the application submitted by EOG Resources Inc., along with supporting documentation. This proposed drill site has four structures that are within the 300 to 600 foot radius that require waiver letters from the letters The status of these applicant is be given process of obtaining all required n at the meeting. The access road to the drilling site will utilize an existing driveway and will be re- constructed if necessary to provide an all- weather driving surface and stabilized entrance from the paved surface. The access road and entrance will meet Fire Department access requirements in accordance with the fire code. 7. If the necessary peak volume of water is available through the City's water system, mobile frac tanks will be utilized during the fracturing process. Otherwise, one (1) frac pond will be constructed in conjunction with this site on the Moore Unit. The frac pond will be secured and enclosed by a minimum 4' chain link fence. 8. Depending on available capacity, water for drilling and fracturing operations will be from a water well or purchased through the city. 9. The drilling site will be graded to provide a flat surface for drilling and completion operations. The drilling pad will be constructed of 6" minimum of compacted, crushed limestone, providing an all- weather surface and safe work area. The drilling site will accommodate all parking and truck movements necessary for drilling and completion operation and will be enclosed with a 6' chain link fence. 10. Prior to construction activities, erosion control devices will be installed and will comply with all local, state, and federal requirements. 11. Equipment associated with the operation site will comply with existing City of Kennedale ordinances. Proposed equipment will not exceed 8' in height. 13. Emergency Response Plan Hazardous Materials Management Plan Production & Drilling Operations Fort Worth Operations INTRODUCTION EOG Resources, Inc. (EOG) makes every effort through administration, engineering and training to prevent an emergency from occurring. However, regardless of the efforts to prevent such events, serious incidents have the potential to occur. This plan describes EOG Resources, Inc.'s response for normal and abnormal conditions on production locations located in the Fort Worth Division. Provisions of the Texas Railroad Commission's Oil and Gas Division govern the production operations on these leases. This document provides written procedures to follow in the event of an unplanned release of a potentially hazardous volume of natural gas or natural gas condensate. The plan is to be activated immediately upon observance or notification of an accidental or intentional release of a potentially hazardous volume of natural gas or natural gas condensate. Though the risk of this occurrence is low, this contingency plan has been developed so that the appropriate response actions can be taken to minimi and control the hazards connected with a release of natural gas or natural gas condensate. The cited leases lie inside the city limits of Kennedale, Texas. Prevailing winds in this geographical location are from the southeast to the northwest. Production is from the Barnett Shale. The gas production is sweet with no concentrations of hydrogen sulfide. The hazardous materials produced at these locations will consist of natural gas, natural gas condensate and produced water. Material Safety Data Sheets for each material has been included under Tab 2. The production locations will consist of a wellhead, three -phase separator, production tanks, and associated piping. All natural gas production operations within the City of Kennedale shall comply with applicable sections of City Oil and Gas Ordinance, Section 17 -426 o.)On -site Operation Requirements through u.) Reworking well; notice. Pressure relief devices will protect all pressurized production equipment. The production tanks will include three 250 barrel (bbl) produced water tanks. The produced water and natural gas condensate tanks will have spill containment that complies with the Federal Regulations set forward in 40 CFR Part 112. A map of the well sites and surrounding area has been included under Tab 3 to graphically display the well sites and other structures proximal to the site. NATURAL GAS AND NATURAL GAS CONDENSATE AWARENESS The gas wells in the Fort Worth Division produce natural gas or natural gas condensate. The EOG Emergency Response Plan and Hazardous Materials Management Plan is an effective plan to coordinate the activities of government agencies, EOG employees, contract personnel and the general public if a significant release of natural gas or natural gas condensate ever occurs. Potential hazards from natural gas include the following: • Natural gas is extremely flammable with a lower explosive level of 3.2% and an upper explosive limit of 14.0% by volume • Natural gas will be easily ignited by heat, sparks or flames • Vapors may travel to source of ignition and flash back; do not extinguish a leaking .gas fire unless the leak can be stopped • Vessels exposed to fire may vent and release flammable gas through pressure relief devices • Vessels may explode when heated • Overexposure to high concentrations of natural gas may result in loss of consciousness, dizziness and even death. All of the well sites in the cited leases and the flow lines that transport natural gas are potential sources for releases. COUNCIL CHAMBERS 7:00 PM Chairman Adams called the meeting to order at 7:04 PM. Members present: Rick Adams, Charles Gray, Patrick Vader, Donnie Graham, and Linda Elam. Members absent: Brian Cassady, Charles Overstreet, Cheryl Abbott, Richard West. Staff Present: James E. Cowey, Building Official; Larry Hoover, Community Development Specialist, Bob Hart, City Manager, and Crystal Tort, BOA Secretary. Mr. Graham was moved to a regular voting member for the purpose of this meeting. Ms. Tort performed the swearing in of the citizens that would like to address the Board. A. VISITORS /CITIZENS FORUM No one wished to speak. B. CONSIDER BOA CASE # 08 -02 A request to an extension of an existing SPECIAL EXCEPTION for a metal recycling business at 437 East Kennedale Parkway with the Legal Description being Lot 4131 of the C.A. Boaz Subdivision of the JB Renfro Survey and Lot 1R of the Johnson Addition in the City of Kennedale, Tarrant County, Texas as requested by Monty Johnson of Don's Scrap Metal. 1) STAFF PRESENTATION OF CASE Larry Hoover addressed the Board and discussed the history of the prior Special Exception and explained that all conditions of the Special Exception were met and is due to expire in February 2014. Mr. Hoover also explained that the granting of the Special Exception in 1994 was inappropriately applied under the Schedule of Uses and under a C -2 District a Metal recycling business would not have been permitted. The Board was also made aware that Don's Scrap Metal is a nonconforming use and is located in the Overlay District and therefore needs to follow the guidelines set forth in the City Code. Mr. Hoover also notified the Board that the extension of the Special Exception would be for 15 years and would vacate the previous Special Exception. 2) APPLICANT PRESENTATION OF CASE Monty Johnson, 6311 Sonora, Granbury, TX owner of Don's Scrap Metal addressed the Board in favor of the extension of an existing Special Exception for Don's Scrap Metal. Mr. Johnson explained that he has been approached by a Financial Group to purchase the company and due to the Capital Expenditure would like the investment guaranteed, therefore asks the City to (0-4 150 grant a 15 year extension. Mr. Johnson also explained the purchase of new baler system which would increase production and would reduce the time the machine would be running. A discussion ensued among the applicant and the members of the Board as to the description and functions of the business. Danny Finlan, 2005 Crown Colony, Prosper, TX representative of Investor Group addressed the Board in favor of the extension of an existing Special Exception for Don's Scrap Metal. Mr. Finlan gave a description of the Investor Group and explained their desire to purchase this location and would like to work with the City to do so. He also mentioned their vision is to expand, but the expansion would be in another location, which would not cause an overflow of traffic or noise at the current location. A lengthy discussion ensued among Mr. Finlan, Mr. Johnson, and the members of the Board. 3) PUBLIC HEARING ON BOA CASE #08 -02 Eric Elam, 349 Sublett Road, Kennedale, TX addressed the Board against the extension of an existing Special Exception for Dons Scrap Metal. Mr. Elam stated that Don's Scrap Metal is a Salvage Yard and should not be allowed in a C -2 Zoning. He also addressed the need for proper disposal of oils or waste from vehicles or other equipment being brought in. MG Movassashi, 4700 Butterfield Road, Arlington, TX addressed the Board against the extension of an existing Special Exception for Dons Scrap Metal and explained that this business is currently in the wrong location and needs to be moved to an Industrial Zoning. 4) APPLICANT RESPONSE Monty Johnson, 6311 Sonora, Granbury, TX addressed the Board and explained how Don's Scrap Metal has been here since 1967 and has been a good neighbor and will continue to improve the business. Mr. Johnson also addressed the disposal of hazardous materials and explained all items are drained before arriving to the site and soil samples are currently turned into the State for quarterly environmental testing. 5) STAFF RESPONSE AND SUMMARY OF CASE Larry Hoover gave a summary of the case and informed the Board of the Special Exception standards found in Sec 17 -422 and briefly explained the descriptions of recycling collection facility and salvage. A discussion was then held between the Board members and Mr. Hoover. Chairman Adams closed the public hearing at 8:31 PM. 6) ACTION ON CASE Mr. Vader made a motion to deny the extension of an existing Special Exception for Don's Scrap Metal, seconded by Mrs. Elam. Motion passed without opposition. C. REGULAR ITEMS IV 151 1) Approval of Minutes dated March 4, 2008. Mansfield Cardinal Road. 712 E. Mansfield Cardinal is currently where the applicants reside. The owners have applied for a re -plat to combine 708 and 712 E. Mansfield Cardinal into one lot, which will go before the Planning and Zoning Commission on June 19, 2008. The applicants are seeking approval of the Special Exception, prior to the re- plat. If the Special Exception is denied, they will pursue other options on the existing vacant lot at 708 E. Mansfield Cardinal Road. Currently, we are in the process of plating both properties together. It is our desire to build a guesthouse on the new section of property. Per the City Code of Kennedale (sec. 17 -421), a guesthouse is only permitted with special exception based on meeting certain criteria. We believe the new structure will meet the following criteria as outlined in the application: ; 1. The structure will not be of endangerment to public health, safety, morals, or general welfare. 2. That the use or enjoyment of other property in the neighborhood will not be diminished, by the structure. 3. The structure will not impede normal and orderly development and surrounding property for uses permitted in the district. 4. The structure will have adequate utilities, access roads, drainage and other necessary improvements. 5. The structure will cause no traffic congestion in public streets. 6. The structure will conform to all regulations of the district. Our need for a guesthouse is based on the fact that all of our family lives out of state. (EOG) makes every effort through administration, engineering and training to prevent an emergency from occurring. However, regardless of the efforts to prevent such events, serious incidents have the potential to occur. This plan describes EOG Resources, Inc.'s response for normal and abnormal conditions on production locations located in the Fort Worth Division. Provisions of the Texas Railroad Commission's Oil and Gas Division govern the production operations on these leases. This document provides written procedures to follow in the event of an unplanned release of a potentially hazardous volume of natural gas or natural gas condensate. The plan is to be activated immediately upon observance or notification of an accidental or intentional release of a potentially hazardous volume of natural gas or natural gas condensate. Though the risk of this occurrence is low, this contingency plan has been developed so that the appropriate response actions can be taken to minimize and control the hazards connected with a release of natural gas or natural gas condensate. The cited leases lie inside the city limits of Kennedale, Texas. Prevailing winds in this geographical location are from the southeast to the northwest. Production is from the Barnett Shale. The gas production is sweet with no concentrations of hydrogen sulfide. The hazardous materials produced at these locations will consist of natural gas, natural gas condensate and produced water. Material Safety Data Sheets for each material has been included under Tab 2. The production locations will consist of a wellhead, three -phase separator, production tanks, and associated piping. All natural gas production operations within the City of Kennedale shall comply with applicable sections of City Oil and Gas Ordinance, Section 17 -426 o.)On -site Operation Requirements through u.) Reworking well; notice. Pressure relief devices will protect all pressurized production equipment. The production tanks will include three 250 barrel (bbl) produced water tanks. The produced water and natural gas condensate tanks will have spill containment that complies with the Federal Regulations set forward in 40 CFR Part 112. A map of the well sites and surrounding area has been included under Tab 3 to graphically display the well sites and other structures proximal to the site. 0 The gas wells in the Fort Worth Division produce natural gas or natural gas condensate. The EOG Emergency Response Plan and Hazardous Materials Management Plan is an effective plan to coordinate the activities of government agencies, EOG employees, contract personnel and the general public if a significant release of natural gas or natural gas condensate ever occurs. Potential hazards from natural gas include the following: • Natural gas is extremely flammable with a lower explosive level of 3.2% - and an upper explosive limit of 14.0% by volume • Natural gas will be easily ignited by heat, sparks or flames • Vapors may travel to source of ignition and flash back; do not extinguish a leaking gas fire unless the leak can be stopped • Vessels exposed to fire may vent and release flammable gas through pressure relief devices ® Vessels may explode when heated ® Overexposure to high concentrations of natural gas may result in loss of consciousness, dizziness and even death. All of the well sites in the cited leases and the flow lines that transport natural gas are potential sources for releases. (- Caution should be used when working around wellheads and flow lines ® See the Material Safety Data Sheet or the 2004 Emergency Response Guidebook guide 115 (Gases — Flammable) for more information Potential hazards from natural gas condensate include the following: • Natural gas condensate is extremely flammable with a lower explosive level of 1% and an upper explosive limit of 13% by volume • Natural gas condensate will be easily ignited by heat, sparks or flames • Vapors may travel to source of ignition and flash back • Vapors are heavier than air; they will travel along the ground and collect in low areas • Vessels exposed to fire may vent and release flammable gas through pressure relief devices • Vessels may explode when heated • Natural gas condensate is lighter than water with a specific gravity of 0.37 -0.50 • Exposure to natural gas condensate vapors may result in loss of consciousness, dizziness and even death. All of the well sites in the cited leases and the flow lines that transport natural gas condensate are potential sources for releases. Return to the area only after being informed by EOG personnel or public officials that it is safe to return to the area. Cowey, Building Official; Larry Hoover, Community Development Specialist, Bob Hart, City Manager, and Crystal Tort, BOA Secretary. Mr. Graham was moved to a regular voting member for the purpose of this meeting. Ms. Tort performed the swearing in of the citizens that would like to address the Board. A. VISITORS /CITIZENS FORUM No one wished to speak. B. CONSIDER BOA CASE # 08 -02 A request to an extension of an existing SPECIAL EXCEPTION for a metal recycling business at 437 East Kennedale Parkway with the Legal Description being Lot 4131 of the C.A. Boaz Subdivision of the JB Renfro Survey and Lot 1 R of the Johnson Addition in the City of Kennedale, Tarrant County, Texas as requested by Monty Johnson of Don's Scrap Metal. 1) STAFF PRESENTATION OF CASE Larry Hoover addressed the Board and discussed the history of the prior Special Exception and explained that all conditions of the Special Exception were met and is due to expire in February 2014. Mr. Hoover also explained that the granting of the Special Exception in 1994 was inappropriately applied under the Schedule of Uses and under a C -2 District a Metal recycling business would not have been permitted. The Board was also made aware that Don's Scrap Metal is a nonconforming use and is located in the Overlay District and therefore needs to follow the guidelines set forth in the City Code. Mr. Hoover also notified the Board that the extension of the Special Exception would be for 15 years and would vacate the previous Special Exception. 2) APPLICANT PRESENTATION OF CASE Monty Johnson, 6311 Sonora, Granbury, TX owner of Don's Scrap Metal addressed the Board in favor of the extension of an existing Special Exception for Don's Scrap Metal. Mr. Johnson explained that he has been approached by a Financial Group to purchase the company and due to the Capital Expenditure would like the investment guaranteed, therefore asks the City to Lraifl 150 grant a 15 year extension. Mr. Johnson also explained the purchase of new baler system which would increase production and would reduce the time the machine would be running. A discussion ensued among the applicant and the members of the Board as to the description and functions of the business. Danny Finlan, 2005 Crown Colony, Prosper, TX representative of Investor Group addressed the Board in favor of the extension of an existing Special Exception for Don's Scrap Metal. Mr. Finlan gave a description of the Investor Group and explained their desire to purchase this location and would like to work with the City to do so. He also mentioned their vision is to expand, but the expansion would be in another location, which would not cause an overflow of traffic or noise at the current location. A lengthy discussion ensued among Mr. Finlan, Mr. Johnson, and the members of the Board. 3) PUBLIC HEARING ON BOA CASE #08 -02 Eric Elam, 349 Sublett Road, Kennedale, TX addressed the Board against the extension of an existing Special Exception for Dons Scrap Metal. Mr. Elam stated that Don's Scrap Metal is a Salvage Yard and should not be allowed in a C -2 Zoning. He also addressed the need for proper disposal of oils or waste from vehicles or other equipment being brought in... MG Movassashi, 4700 Butterfield Road, Arlington, TX addressed the Board against the extension of an existing Special Exception for Dons Scrap Metal and explained that this business is currently in the wrong location and needs to be moved to an Industrial Zoning. 4) APPLICANT RESPONSE Monty Johnson, 6311 Sonora, Granbury, TX addressed the Board and explained how Don's Scrap Metal has been here since 1967 and has been a good neighbor and will continue to improve the business. Mr. Johnson also addressed the disposal of hazardous materials and explained all items are drained before arriving to the site and soil samples are currently turned into the State for quarterly environmental testing. 5) STAFF RESPONSE AND SUMMARY OF CASE Larry Hoover gave a summary of the case and informed the Board of the Special Exception standards found in Sec 17 -422 and briefly explained the descriptions of recycling collection facility and salvage. A discussion was then held between the Board members and Mr. Hoover.
