12/23/1991, Special Meeting MinutesPage 1857 MINUTES OF KENNEDALE CITY COUNCIL SPECIAL MEETING - DECEMBER 23, 1991 MAYOR'S OFFICE Mayor Steve Radakovich called the meeting to order at 5:30 PM. Members present were Mayor Radakovich, Pete Kirkpatrick, Tom Boone and Ron Kovach. Robert Mundy and Mark Wright were absent. Staff in attendance was Ted Rowe. ITEM NO. 1 - Approval of a Tax Abatement Agreement with Heidelberg Harris Corporation. Ted Rowe and Melvyn Douglas, Attorney for Heidelberg Harris, pointed out that Page 3 (3) had been amended to read "Failure by COMPANY to either create ten (10> additional positions or, in the alternative, maintain at least one hundred (100) full-time, permanent employees shall constitute default by COMPANY of this CONTRACT.", and (5)(b> was amended to read "COMPANY violates any of the terms and conditions of the CONTRACT, and fails to cure during the CURE PERIOD (as hereafter provided), this CONTRACT shall be deemed in default, and then may be terminated by the CITY, and all TA}{ES,~otherwise abated by virtue of this CONTRACT will be recaptured and paid to the CITY by COMPANY within sixty (60) days of the termination." City Attorney Don Driver and Mr. Douglas agreed to the changes on December 20, 1991. No other changes were made to the agreement. LJ Page 1858 Ted Rowe informed Council that the Kennedale ISD Board adopted a resolution to adopt the agreement as accepted by the City. Bill Gress, Director of Heidelberg Harris stated unofficially, that the Kennedale plant would be receiving equipment from the France and Germany plants. Tom Boone made a motion to approve the tax abatement agreement with Heidelberg Harris Corporation. Second by Pete Kirkpatrick and passed unanimously. Motion by Pete Kirkpatrick to authorize Ted Rowe to sign the tax abatement agreement. Second by Ron Kovach and passed unanimously. Ron Kovach moved to adjourn at 9:00 PM. Motion carried unanimously.
