Chairman Deaver called the meeting to order at 7:01 p.m.
Members present: David Deaver, Mike Bevill, David Smith, Michael Chandler, and Elizabeth
Carrington.
Members absent: Donna Gerron, Mitch Blan and Yolanda Jones
Staff Present: Bob Hart, City Manager; Larry Hoover, Community Development Specialist; James
Cowey, Building Official; and Glenn Greenwood, Streets & Parks Supervisor.
Ms. Carrington and Mr. Smith were moved to regular voting members for the purposes of this
meeting.
A. VISITORS /CITIZENS FORUM
No one wished to speak. However, Mike Bevill did request at this time copies of tapes for the
last six meetings that have been held.
B. REGULAR ITEMS
1. Approval of Minutes dated December 5, 2007.
Mr. Chandler made a motion to approve the minutes as presented, seconded by Ms.
Carrington.
Motion passed unanimously.
2. Discuss and Consider Park Projects
a. Sonora Park
Mr. Hoover updated the Board on various items regarding Sonora Park including the land
acquisition, park design.
A brief discussion was held concerning the acquisition of the land for the park expansion.
Mr. Hart informed the Board the entrance to the park must be moved back 100 feet of the
railroad tracks.
A brief discussion was held concerning moving the entrance and having a barrier from the
tracks.
b. Rolling Acres Park

Mr. Hoover updated the Park Board on the ground breaking for the Rolling Acres Park. Mr.
Cowey, Project Manager for the Rolling Acres Park updated the Board on construction of
the park. A discussion ensued concerning basketball courts, landscaping, fencing, fund
availability and number of trees to be removed.
c. Town Center Park Plaza
Mr. Hoover updated the Park Board on the ground breaking for the Town Center Park
Plaza. Mr. Cowey, Project Manager for the Town Center Park Plaza updated the Board on
construction of the park. A discussion ensued concerning water feature changed and which
plan had been decided upon.
I Discuss and Consider Skate Parks
A discussion ensued concerning different aspects of a skate park such as liability issues
for City and funding. The Board advised staff take off agenda for now with possibility of
adding to agenda at a later date.
4. Discuss and Consider naming Rolling Acres Park
Mr. Hoover updated the Board on the approval from the City Council on the criteria of
naming parks and is seeking a recommendation from the Board. A discussion ensued on
having more community involvement on naming the park and a recommendation was made
by Mr. Hart to put an article in the next issue of the newsletter to receive community
involvement on naming the park. A brief discussion ensued on possible memorial for
Veterans at the Town Center Park Plaza,
5. Receive Citizen's Opinion Survey Results
Mr. Hart updated the Board on results from citizen survey.
6. Receive Staff Report for Park Dedication Fund
Mr. Hoover advised the Board there was no new information given by the Finance
department due to the audit.
C. ADJOURNMENT
Mr. Bevill made the motion to adjourn the meeting.
Mr. Deaver adjourned the meeting at 8:15 pm.

example, our local citizens that serve on the Kennedale ISD Education Foundation.
Dedicated people like Kelley Hunt, Sam Zoccali, Donna Eastman, Yvette Collins and
Lisa Richardson are a few KISD executive board members working to make our
classrooms a better place for learning.

The Parks and Recreation Board is seeking assistance in naming our newest park.
Construction has begun on the new park located in the Rolling Hills Subdivision and
on Sublett Road just west of Wildcat Way. We anticipate the park being completed in
early May. Kennedale's park naming policy states," names selected should normally
honor deceased residents of the City of Kennedale. In unusual circumstances, it may
be appropriate to honor deceased individuals other than Kennedale residents who
have made significant contributions to the benefit of the City of Kennedale."

ARTICLE I. IN GENERAL
Sec. 16 -1. Penalty.
Except as otherwise stated, violations of this chapter are punishable as provided in section
1 -6.

Sec. 16 -2. Definitions.
(a) The word "park" or "parks" when used in this chapter shall mean and include all that
land that may be selected, obtained, or acquired by the city for use as parks, parkways,
esplanades, median strips or grounds.
(b) The word "playground" or "playgrounds" when used in this chapter shall mean and
include those areas of land that may from time to time be placed under the control of and used
by the city park and recreation department for children's activities through the courtesy and
in cooperation with the Kennedale Independent School District or any other agency, corpora-
tion, or individual.

Sec. 16 -3. Publicly owned properties —Glass food and beverage containers prohib-
ited.
(a) It shall be unlawful for any person, firm or corporation to possess glass food or beverage
containers on any publicly owned property designated and dedicated for park and recreational
purposes at any time of the day or night.
(b) The terms of this section shall not apply to food or beverage containers utilized for
storage in a related concession stand or other city owned or franchised concession operation,
provided that the containers are not available or distributed to the public.

Sec. 16 -4. Same — Alcoholic beverage prohibited.
It shall be unlawful for any person, firm or corporation to consume, possess, transport or
store alcoholic beverages of any nature or kind, including beer, whiskey or wine, upon, over,
across or on any publicly owned property designated and dedicated for park and recreational
purposes at any time of the day or night.

Sec. 16 -5. Parks, recreation and open space master plan adopted.
The parks, recreation and open space master plan for Kennedale, Texas, attached to
Ordinance No. 298 as Exhibit "A," is hereby adopted. Exhibit "A" is on file in the city
secretary's office.

ARTICLE II. PARKS AND RECREATION BOARD
Sec. 16 -10. Created.
There is hereby created and established a park and recreation board to be composed of five
(5) regular members and three (3) alternate members. Such board shall be officially designated
as the Park and Recreation Board of the City of Kennedale, Texas.

Sec. 16 -11. Membership•, appointments, qualifications, terms, vacancy.
(a) The five (5) regular members are hereby designated by places, being place 1 through 5,
and the three (3) alternate members, places 6 through 8, on the park and recreation board.
Each city council member may appoint one (1) regular park board member to the park board
place corresponding to the city council member's place. The three (3) alternate members shall
be appointed by majority vote of the city council.
(b) Corresponding with the terms of office of the corresponding city council member:
(1) The initial term for regular board members serving in places 1, 3 and 5 shall be until
May of 1995. Thereafter, places 1, 3 and 5 shall be appointed in May of each
odd - numbered year. Alternate board member 7 shall also be appointed in each
odd - numbered year.
(2) The initial term for board members serving in places 2 and 4 shall be until May of
1996. Thereafter, places 2 and 4 shall be appointed in May of each even- numbered
year. Alternate board members 6 and 8 shall also be appointed in each even - numbered
year.
(c) The alternate members shall attend each meeting and shall, on a rotating basis, act in
the place of an absent regular member. If no standing member is absent, the alternate
members shall not vote on any matter.
(d) In the event of a vacancy on the park and recreation board, such vacancy shall be filled
in accordance with this section.
(e) If a city council member fails to make an appointment within ninety (90) calendar days
of the date of the vacancy or date of expiration, the city council may by majority vote make an
appointment.
(f) The members of the park and recreation board shall be resident citizens within the
corporate limits of the city, taxpayers, and qualified voters of the City of Kennedale, Texas.
(g) ,A board member may be removed by a majority vote of the city council for cause or
without cause.

Sec. 1612. Organization, operation, meetings and quorums.
(a) By June of each year, the membership shall determine by simple majority vote a
chairman, a secretary and a recording treasurer. The office of recording treasurer may be
combined with the office of secretary by decision by simple majority vote of the board. The
terms of office of chairman, secretary and recording treasurer will be for the period of one (1)
year from May 31st of each year.
It will be the duty of the chairman to preside over the meetings of the board and to assist
in setting meeting agendas. It will be the duty of the secretary to record and maintain minutes
of meetings of the board, to draft correspondence for the board, and to serve as chairman in his

absence. It will be the duty of the recording treasurer to provide reports of expenditures
recommended by the board for city council approval, and of special park and recreation rev-
enue fund balances.
(b) The board shall make such rules and regulations for its own government and shall
hold at least six (6) regular meetings per year. A quorum shall consist of three (3) members of
the park and recreation board.

Sec. 16-13. Absence from meetings, notification.
Should any member of the park and recreation board be absent from three (3) meetings
during any twelve -month period beginning from the date of the appointment to such board, it
shall be the responsibility of the chairman, or in his absence the secretary of the board, to
notify the city council, through the city administrator, with a record of such absences and of
any and all extenuating circumstances related to the absences.

Sec. 16-14. City departments to furnish board with reports, advice, and services at
direction of city administrator.
i The park and recreation board shall receive reports, advice and available services from the
various city departments as required and as directed by the city administrator, or his desig-
nated representative.-When directed by the city administrator, any department head or official
of the city shall be available to the board for advice and consultation, and they shall cooperate
with and render such services for the board as shall come within the scope of the duties of the
city administrator.

See. 16-15. Powers and duties of board.
The park and recreation board shall have the power and authority and it shall be its
duties:
(1) To make studies and project plans for the improvement and acquisition ofpublic parks
and open spaces with a view of park development and extension, and to recommend
all matters for the development and advancement of the city parks and open space
facilities, layout and appearance, and to perform the duties of advance planning for
future acquisition and. development of potential park and open space lands;
(2) lb confer with and advise property owners and developers pertaining to location and
development of private property with the view of having the same conform to the
overall city need for parks and open spaces- and to advise and confer with the city
administrator or his designated representative in the performance of his duties;
(3) qb aid and assist the city administrator in the procuring of financial and other aids
and assistance for the city from the state and federal governments and their agencies
for each and all of the purposes herein enumerated;

(4) Th act with and assist all other municipal boards, governmental agencies, regional
associations and especially the city council in formulating proper plans for municipal
park and open space development;
(5) To plan and recommend the location, plan, and extent of city parks, playgrounds, and
other public grounds and public improvements, for the location and planning of public
buildings, schools and other properties, and of recreational facilities, including those
public and privately owned improvements for water, lights, sanitation, sewer dispos-
al, and drainage;
(6) To monitor schedules of athletic fields to assure adequate maintenance and repair
time and to optimize the use of established recreational fields and facilities;
(7) To recommend general rules and regulations governing use of parks, open spaces,
community, recreational facilities and buildings;
(8) To recommend plans for improving, developing, expanding and beautifying the parks
and public buildings in or adjacent to the city and to cooperate with the city council
and other agencies of the city in advising, establishing, locating, improving, selecting,
expanding and maintaining the public parks, playgrounds and lakes for public rec-
reation;
(9) qb recommend programs to the city council, in an advisory capacity, to originate, plan
and coordinate a recreation program for all segments of the population, throughout all
seasons of the year. Efforts by the board should' be made to assure that all recom-
mendations will utilize existing facilities and organizations to provide recreational
and leisure time activities to the citizens. The board should concern itself with the
possibilities of gaining cooperative use of noncity owned facilities and implementing
proven programs to attract participants for recreational activities.

Sec. 1646. City administrator ex officio member of board.
The city administrator or his designated representative shall be an ex officio member of
the board without voting privileges and shall act in an advisory capacity to the board.

Sec. 16-17. Recommendations to council; procedure; budgeting.
(a) The park and recreation board shall have the authority to hold public hearings in the
city and to consider and make recommendations to the city council in writing from time to time
on any and all matters pertaining to the city's public parks and recreation system.
(b) All recommendations made by the board to the city council shall be by majority vote
of a quorum of the board, and such recommendations shall normally be made through the city
administrator.
(c) The city administrator shall confer with the park and recreation board during the
preparation of his annual park department budget recommendation to the city council. The

city administrator shall be required to inform the city of the board's recommendations con=
cerning annual park and recreation appropriations, and in those instances where his recom-
mendation differs from that of a majority of the board, the board chairman, may have a hearing
before the city council to directly report the majority's recommendation including the source of
funds to support such recommendation.

Sec. 16-18. Employee matters not within purview of board.
The park and recreation board shall have no authority in the choice of employees who may
be assigned to park and recreation activities nor in the establishment of salary ranges for such
employees.

Sec. 16-19. Disposition of revenues.
All revenues derived from park and recreation related activities which are under the
direct control of the city shall be deposited to the city general fiend and utilized to support park
and recreation related activities to the extent of city -wide needs as determined by the city
council during the annual budgeting of funds for all city departments.

ARTICLE III. PARKS AND PLAYGROUND REGULATIONS
Sec. 16-20. Safety of patrons generally; limitation of activities by permit.
It shall be unlawful for any individual or group of individuals to participate in any activity
on any park .or playground area when such activity will create a danger to the public or may
be considered a public nuisance. The city administrator, or his designee, may designate par-
ticular locations within the park and playground areas for specific activities by the issuance of
special permits upon application, which permits shall set out the particular conditions under
which activity is permitted. Overnight camping is prohibited on any park property except by
special permit issued by the city administrator, or his designee, for such activity on special
occasions.

Sec. 16-21. Restricted and public areas.
It shall be unlawful for any person to enter any portion of a park or recreation area which
is designated as restricted, or to enter any area during the hours of the day when said area is
not open to the public or to enter at any time any park and recreation area closed. Any section
of any park may be declared closed to the public by the city administrator at any time for any
interval of time. Hours during which the area is closed to the public shall be posted by the city
administrator or his designee.

§ 16-22 KENNEDALE CITY CODE
Sec. 16-22. Concessions — Authorized. .
The city council may from time to time, upon the recommendation of the city administra-
tor, grant concessions for the operation of amusements, refreshment stands and related con-
cessionaire facilities for operation in municipal parks and playgrounds. Any such concession
shall be granted upon a written contract detailing the privileges, duties and responsibilities of
the concessionaire and providing adequate protection for the city and its citizens.

Sec. 16-23. Same — Required for sale of merchandise.
It shall be unlawful for any person to sell or offer for sale any food, drinks, confections,
merchandise, or services in any park or playground unless such person has a written agree-
ment or a permit issued by the city permitting the sale of items in such park or playground.
Application for such agreements or permits shall be made to the city administrator.

Sec. 16-24. Parking vehicles.
Where vehicle parking lots or areas have been set aside in a park in the city, no vehicle
shall be driven over or across the curbs, sidewalks, grass, or lawn within such park, but shall
be parked in such parking lots or areas and not otherwise. Exceptions are park maintenance
vehicles and as may be directed by police or park department personnel.-

Sec. 16-26. Driving vehicles and animals
It shall be unlawful to drive or propel any vehicle over or through any park or playground
except along or upon park drives, parkways, or park boulevards, or to drive or propel along or
over any park drive, parkway or park boulevard, any heavily laden vehicle or vehicle carrying
merchandise, goods, material, or rubbish, or any market wagon, milk wagon, dirt cart, moving
van, dray, or truck; and it shall be unlawful for any person to ride or to drive any horse or other
animal over or through any park or playground except along an upon the designated paths.

Sec. 16-26. Erecting structures. .
It shall be unlawful to place or erect any structure, sign, bulletin board, post, pole, or
advertising device of any kind whatever in any park or playground, or to attach to any tree,
shrub, fence, railing, post, or structure within any park or playground; provided, however, the
city administrator, or his designee, may permit in writing the erection of temporary decora-
tions on occasions of public celebrations or holidays.
