11/14/1991, Public Hearing Meeting MinutesPage 1841 MINUTES OF KENNEDALE CITY COUNCIL PUBLIC HEARING - NOVEMBER 14, 1991 COMMUNITY CENTER Mayor Steve Radakovich called the public hearing to order at 7:35 PM. Members present were Mayor Radakovich, Mark Wright, Pete Kirkpatrick and Tom Boone. Robert Mundy and Ron Kovach were absent. Staff in attendance were Ted Rowe, Linda Jones, Vicki Thompson, Jerry Kirkpatrick and Attorney, Don Driver. Public Hearin No. 1 - To receive comments regarding a replat rom o an o .M. Estes Home Tracts to Lot 4-R and Lot 5-R, J.M. Estes Home Tracts, 1100 Block of East Sublett Road. Requested by Mr. and Mrs. Jack Good. Mrs. Good explained that she would like to sell two acres of land that has a house and barns located at 1114 East Sublett Road. Because it would take all of the road frontage for Lot 5 she was required to replat the property so that the back portion of the property would not be land locked...--DGe to the requirements of the master plan she has dedicated a 20' right-of-way of Lot 5-R to widen Sublett Road. Mrs. Good requested that no right-of-way dedication be required on Lot 4-R until such time as the property is developed. Mrs. Good stated that the city may want the right-of-way before the land is developed, therefore the city would have to purchase the land. Requested by Mr. and Mrs. Kim Brimer. Ho one spoke for or against the proposed replat. Public Hearin Ho. 3 - To receive comments regarding abatement of ew ope oa Requested by Mr. Sam Rives. Mr. Jim Cannon stated that he was in the process of purchasing the property from Mr. Sam Rives. He agreed to bring the electrical and plumbing up to code. However, he did not want to raise the house the required 18" to bring it up to code because it would tear the house to pieces. Ken Carlton, Building Inspector, explained that he sent a letter to Mr. Rives on June 28th requesting that the house be repaired. The house is 1/2 pier and beam and the floor joust are setting on the ground. The added-on part of the house is built on a slab. The house is below grade and Mr. Carlton agreed that to raise it would tear it to pieces. It is in such bad shape and full of rotted wood, it would be hard to fix it. He has been given since June to repair the house and there has been no effort. The house was built in 1945 with 960 sq. ft. and Tarrant Appraisal District has valued the total property at 515,000. Ted Rowe stated that the loan company called Wednesday, November 13th to remove the item from the agenda because bids were taken to bring the house up to code and it would cost more than it would to build another house. So they intended to bulldoze it and remove it. Mr. Cannon said it would take approximately 510,000 to 512,000 to repair the house, but he needed a week to talk to a person about the foundation. Mr. Cannon intended to fix the house enough to live in a couple of years and then build a new one. There is also another building on the lot that needs to be torn down. [' Page 1843 Mr. Don Driver said that it was not legal for someone other than the property owner to appeal the abatement, unless he has a contract. Mr. Cannon stated that he had faxed a contract to the loan company, but hadn't received it back from them. Mr. Don Driver stated that Mr. Cannon is not the legal owner and he has no standing. The Council can declare the house substandard and withhold taking action for a week or 10 days. No other persons spoke for or against the abatement.
