concerning the proposed Business ~t~; Overlay Zanint~ C~istrict
Ordinance, whicr, is for properties fronting I3usa.ness ~t~ within
the City ct Itiennedale. The proposed =oning district is designed
to consolidate developn~er,t standards fc7r signage, building
material and setback, parking setbacks, screening and landscaping.
Roger Hurlbut, Hwy. ~S? Committee Chairman gave an overview of tt,2
proposed ordinance and a slide presentation. He stated that the
sprinkler system requirements were deleted.
Charles Wells, 2~t5 East Mansfield Highway, wondered if the
committee had soaked into and had documentation tram other
committees that had applied an overlay district and how successful
it was, including te~timany from the business owr7ers. He
questioned the mailing list of the survey taken appro:~imately two

He stated that was a weak way of over reacting. It the city would
enforce the present ordinances, take the crumbling buildings,
bulldoze them, and get rid of the trash we would be slot better
off. The people don"t need other layers of restrictions now. He
wondered if the city had done a study of the revenues generated by
the salvage yards and business along the highway.
If you put the salvage yards out of business the rest of the
businesses in Kennedale will suffer.
Ken Y'earce stated. that he had constructed eight buildings on the
highway and the city ordinance requires a ;~5 foot building
setback. There is only two or three lots on the highway that you
car, build a building on according to the proposed ordinance. He
stated that there was a water shortage and wondered where people
would get the water to beautify the greenbelt. "the present
ordinance states that you can't store anything outside and if it
was enforced, we would have a lot better city. ~

Leon Swiney, 1:305 Bowman Spring Road, stated that the present
ordinances are not being enforced now. if you are going to pass
the ordinance why don't you make it city wide. Hake the whole
city beautiful. He felt the ordinance is way out of line the way
it is presented now.

die. `The council has the responsibility to see what is best for
this community. He is proud to live in Kcnnedale. Some of t'r,e
people are correct when tYiey say the present ordinances have not
been enforced. He challenged council to not only think about X87,
'but also about cleaning up the rest of Kennedale. It is the
Council's responsibility to the city that wc~ live in. lie
encouraged council to find some ways to help t}',e business peo):~le
that are having trouble witYi the ordinance, not to run them c.ut of
business, but at the same time we don't need to Stay stagnant.
And do something about the future of our town by setting som~~
ordinances that won't let it continue to go down. kiennedale i
continuing to go down. Kennedale needs to start a plan and it i
time for a change. Make it a better place to live in ti-,e future.
Bill Abbott, ~~~ Little ~choal f~oad, stated that the ordinance is
a good basic document, however his problem was with the
implementation ~chtdule and the construction as far as the
percentage o2 the business. A statement in the dacurnent says ii
the construction exceeds 00"I. of the standing footage then they
fall rota the main part of the ardinance. koger Hurlbut e:~plained
that if the existing structure is increased by :~0'/. or more of the
overall square footage then the ordinance would be in effect.

Richard Havener. Er:ecutive Director, t_. Q. C. stated that the
Kennedale Chamber of Commerce Economic Uevelopment Committee and
Lone Star Gas Company's Economic Uevelopment Department felt that
the follawing were critical to the economic well-being of
Kennedale:
(1) Elimination of close proximity of sex-oriented
businesses.
t2) Improve appearance of salvage yards.
(3) Proximi ty to area land fills.
t4) Improve general community appearance.
(5) Reduce race track noise pollution.
{6) Improve negative image from outsiders.
(7) Recruit mare retaillconimercial businesses.
t8) Develop more office buildings.
d9) Develop more defined central business district.
f1@) Develop and improve city park system.
Dr. Kick F'luenneke, 6155 Uick Price Road, stated he was for the
concept of tt,e ordinance. A lot of areas need to be improved
along the highway including the school grounds.
Clarence 6tanley, 1G~0 Bowles Court, stated he was on the border
line of having to stop building in 1{ennedale because he couldn't
sell the homes due to the negative image. He doesn't dare bring a
prospective name buyer into town on Hwy 187, it`s a kiss of
death. He said every business is not against this ordinance.
Jan Hurlbut, 108 Creekside Caurt, stated that she is not
displeased with Kennedale. It is Highway 287 that's the mess. if
she had known that 287 was going to effect her life the way it
has, she would not have let her family move here. The salvage
yards and topless bars are not in the City of Kennedale, however,
i-Iwy. 28`7 is decreasing the real estate values. The "shop as you

drive" has caused her .four- rrear accidents i~rl the tiigYiway. I~;r.:~.
Hurlbut described a salvage yard locr~t.ed outside Oklahoma i::ity on
I~~~ as~ being beautiful with a stoci,ade fence. :she said rr,ey tiau
pride.
Gary Whightsil, 1~DL Meadowlake Gourt, stated that he has lived in
Itennedale fo-r five years and is a member of the school board and
T;oas-d of Ad ju~:tments. F3c felt that Iiennedaie has arz undeserved
reputation as the place where all the junk yards are located. i-i«
urged Gour~cil to consider the prapased ardinarice with
modifications if necessary. 'T'he BOA will work with businesses so
that. they will not be driven out of town. I'ht school boas i:=:
tryirip to address some of the image problems that they have.

rider there, if the parking regulations as they are imposed or,

lot makes it impassible to use that lot by rarcing the parking
back they: they can get an exception from the BOA. 'T'here i:; always
